K-1 Visa Denial, 2007 to present

Timeline

As I read many of the posts in VJ, all I can read are from people writing about their experiences in their journey to secure a K-1 visas. What I haven't seen are situations where visas are denied at the U.S. Embassies or Consulates. I am opening this thread with the hope that others who have had such sad and sorry experiences would share and write about what happened and what they did or are doing to remedy the situation. I know, because my fiancee's visa application was denied at the U.S. Consulate in Lagos, Nigeria, in 2007.

Timeline

There are many cases of denials or returns everyday, i had one returned in June that expired so we just married and refiled. There have been a few that got the denys overturned but not many each case being different, did you try to get yours stopped?

Not any pattern with any country other than the fact some country immigrants seem to have a problem following proper USA immigration laws and procedures, thus you see a pattern, just matter of following the US immigration law and policy, and it has only gotten more strict due to the number of fraudulent immigrant marriages, sadly used to gain access to the USA at any method or cost. :whistle:

As far as I understand, they are a bit biased against some countries. I should not say that but it seems to me like this..

yah, i think so. it doesn't take much to see the pattern

No, I did not try to get it stopped. I don't even know if I could have even stopped it. The letter my fiancee was given only stated that the petition would be returned to the USCIS office that approved the petition for possible revocation because, according to the ConOf at the Consulate, she didn't think a genuine relationship existed between my fiancee and I. But that wasn't true.

I was here in the U.S. and my fiancee went to the U.S. Consulate herself, as many significant others do. Our plan was for her to obtain a K-1 visa, get to the U.S. and we would then marry within 90 days of her arrival. Since the visa was denied (in September 2007), I then travelled to Nigeria in December 2007, we got married in January 2008, and have since filed an I-130 and subsequently another I-129F for a K-3 visa with the Vermont Service Center. The whole experience was a shame because a ConOf at the Lagos Consulate had to play Almighty and decided what constituted a genuine relationship.

That's where you will find experiences like your own and ways people have overcame their problems.

I'm sorry to hear about your situation, but your on the right track your really showing your love for her...I'm sure your next petition will be approved.

I am so happy for u both 15 more days and i go to be with my love waiting on interview.. So pray for us K I am soooooo happy for you both,,

We did show that we were not married with a certified letter from the US goverment ! Also with emails to the goverment office and Contacts of when and who we talked to in these offices. The Consulate officer told my fiancee that it did not matter what we had it was his belief that we were married and today he was denying our case !!!! Can you give us any advice !!! We are looking for rays of hope ! Where do we go from here !!

Sorry to hear that , is that a consulate/embassy specific requirement- a "letter from the us you are not married"? normally a single certificate from the benificiaries country is required, name check in the USA would have shown if you were married in the US, but the govt has no way to determine your status abroad thats why they ask for a single certificate from the benificiary.

June 28th 2007 sent 1-129f to NSC

July 11th 2007 NOA-1 received date on NOA-1 (now at CSC)

July 19th 2007 NAO 1 Reciept date on NOA-1

Nov 21st 2007 NOA-2

Dec 13th 2007 - arrives at NVC

Dec 20th 2007 - leaves NVC on route to GUZ

March 10th 2008- P3 sent & returned

April 9th 2008- P-4

May 22nd 2008 interview

Tracking:

Filing to Noa -1 -13 days

NOA-1 to NOA-2 - 133 days

NOA-2 to NVC - 22 days

NVC Processing - 7 days

NVC to GUZ - 81 days

P-3 to interview - 73 days

Interview to visa - 10 days

Filing to visa- 341 days

IMO, a certified letter from the U.S. government is not the right document to prove you are BOTH single and free to marry. Which government authority issued such document?

In the case of the foreign fiance, she might have gotten a "certificación de soltería" issued by civil registrar's office in her country. That is the document that proves her civil status is single. In the case of the US Citizen a sworn statement, could be accepted.

As I've said before on similar threads, it just goes beyond my understanding how a CO can automatically interpret as a legal wedding an act/celebration that is not even close to be considered a legal wedding in the country where it took place!

I'd be interested to know if there is a chance to "appeal" the CO decisions when the denial its based on something like this? Is there a chance to go back to the embassy? I hope you get some more feed back from more experienced members on this matter.

04.18.2022- Interview done at Minneapolis USCIS Local Office   ✔️ Received N-652 "Congratulations your application has been recommended for approval" during the interview.

05.19.2022- Oath Ceremony in MN
