Fiancéé is pregnant.. what can I do now?

That is soo cute :)

Thing is (i am canadian myself) we also talked about that specific case yesterday night.... (I am at his place till the end of the week and spent a month and a half there)... what would we do if i end up beeing pregnant (and we probably still have 8/9 months to go in the process).

We thought about the same possibilities, for the same reason.

Get married, get US insurance, file for a K3 and... me to go visit 3 months or something. (like the last 3 months)....

Or just wait in canada (montreal), deliver the baby there and move with him/her after (then you wonder if a newborn can safely fly (not so sure about that))

Tell me what you guyz had decided (good to know anyway)

So I found out this morning that my Canadian fiancéé is pregnant. This is wonderful news for us both and we're very happy, but.. I cannot add her to my health insurance I have through my work until we are married, and if we don't add her soon, they will consider it a pre-existing condition and not cover any expenses until the child is born.

So, I'm wondering what my options are. She has health insurance in Canada of course, but I would obviously want to be there for her during as much of the pregnancy as possible.

One potential option would be to just get married now and add her to my policy. I realize we would likely have to re-file, which is not optimal, but something we might be willing to go through. Would the USCIS be more likely to deny us the second time around though for doing it this way?

We would really like for her to go through the pregnancy here in our own home, together, in the US. Obviously we will do whatever is best for the baby, but... has anyone got any suggestions? Anyone gone through this before that can relate their story?

Under HIPAA, if an employer health insurance plan covers pregnancy for employees, it may not exclude pregnancy as a pre-existing condition for a new employee or spouse added to the plan. It's that simple. You can find plenty of information on HIPAA.

BTW, my wife was pregnant well before I added her. No problem.

Under HIPAA, I think you could literally add her to your insurance one day before delivery and it would be covered. :lol:

She will have the baby here in the US now that we know she will be covered. I want to be with her for as much of it as possible, if not all of it :)

Not true.

If you had a medical condition in the past, but have not received any medical advise, diagnosis, care or treatment within the 6 months prior to your enrollment date in the plan, your old condition is not a preexisting condition to which an exclusion can be applied.
Moreover, under HIPAA, preexisting condition exclusions cannot be applied to pregnancy, regardless of whether the woman had previous health coverage.

You're very welcome. If your insurance carrier does turn you down, be sure to file a complaint with the Department of Labor. Actually all you're going to have to do is threaten to file a complaint, and your insurance company will fold. Don't accept any other answer, even if they come up with some other reason for denial. The law is very clear on this point: Pregnancy is NOT a pre-existing condition and they cannot deny coverage, period. (sorry I'm so passionate on this, but as I said I used to work in managed care, and saw this kind of ####### *all* the time. Insurance companies know the law, but they operate under the knowledge that most of their customers don't know the law. Don't let them get away with this.)

I just got off the phone with an insurance agent for multiple companies. We had an argument that pregnancy was not a pre-existing condition. He stated it was and that most insurance carriers will not cover it. I even told him about the HIPPA law. He said HIPPA was only for pregnancy complications.

now i have to start from scratch again since i dont trust him and wont do business with him. I just contacted Blue Cross/Blue Shield. Maybe they will have something. From what i hear, most insurance companies dont offer maternity coverage anymore. And some wont insure if Gretchen hasnt been in the USA for 6 months or longer. What is so hard about getting insurance?

Yes, but if I understand correctly, they do not have an existing policy. That was what they were trying to buy, but weren´t able to.

it should of course even if canadians heatlh care is way different...it should still be consider as " previous" health care.

Anyway, in my opinion you are almost at the end of process for visa so just hang in there.... ( a pregnancy last 9 months after all loll ) so youll be with her soon enough...and you could always even check to find her the best doctor in us to take care of her and the baby :P

Actually pregnancy last 10 months if you go full term, people always mistake for 9 months, when it's 10 months, wooo a long time.

Congrats though! Hope you get coverage. Health insurance is a big pain in the ###. It's like why make things so bloody difficult, it's our health for god sake! :huh:

Shoulda kept it in your pants until you got married - or at least wrapped that willy! Being knocked up is not going to provide any kind of 'edge' as far as the immigration process goes.

Recommend stay in Canada - use the public benefits - or, get an abortion now and then get knocked up again once she is in the US and you are married - after you've added her to health insurance.

PEOPLE: READ THE APPLICATION FORM INSTRUCTIONS!!!! They have a lot of good information in them! Most of the questions I see on VJ are clearly addressed by the form instructions. Give them a read!! If you are unable to understand the form instructions, I highly recommend hiring someone who does to help you with the process. Our process, from K-1 to Citizenship and U.S. Passport is completed. Good luck with your process.
