I took a lot of passport-style photo to have new passport when I was in my country. So, can I use this photo(which is the same photo in my visa) to apply AOS? and.. What will happen if I used the old photos?

Thanks

As long as they're the US 2" x 2" size photos, and they're not old photos, you should be able to use them, no worries. The only thing I wouldn't necessarily do is use two different types of photos....just to reduce confusion that leads USCIS workers to do stupid things like issue RFE's. ;) If you're applying for the whole shebang, AOS/EAD/AP, and have 6 of those passport photos you took back in your country, then go ahead an use them. But if you only have, say 3 and need to go take three more, I wouldn't do that. They may not like the fact that the photos are different. But that's just my suggestion.

Good luck,

-P

I am pretty certain the instructions say the photos should be no more than a few months old, but I cannot get on USCIS to verify. I agree with P&M's statement that if you need 6 and only have 3 (etc) you should get all new ones.

I think the small print on passport style photos states the photo is supposed to be less than 6 months old. But I doubt they are going ask you the exact date.

i submitted 3 sets of different photos for each (AOS/EAD/AP). as of now i haven't got any RFE for that, in fact i already have my interview date. so do you think it's just fine i did that? i hope it will not create any problem during the interview. :( having pictures taken here are too far expensive than in my country.

GOD BLESS!

I believe it will never be a problem during the interview. What you need to think about is all the evidences that you will need for that.

Good luck!

Yes the instructions say that for the photo you take to the visa interview, someplace but the photos you mail in with petitions and applications are for reference only. The adjudicator needs to be able to identify that the person sitting before them is the person in the picture file, and is the person pictured on any passport and ID. USCIS will takes its own pictures for EAD and Green Card use during the biometrics appointments.

For my wife and daughter all photos used for their own new passports and all submissions except the actual visas, were identical and not 2X2. The face dimensions were correct but not the overall dimension. All are cut to fit. The pictures with submitted with AOS were right on the top page of both their files on the adjudicators desk during the interview.

I would advise new pictures, if the old ones can no longer be reliably used to identify you.

Facts are cheap...knowing how to use them is precious...
