Timeline

I moved here about 2 years ago from Scotland and got married to my wife (US Citizen). Been married for 2 years. I currently have no status (immigration wise) So I have not done anything with immigration yet due to the cost of it all. I was going to file the papers at the end of next month. Yesterday my wife told me she was pregnant so does this change anything? What forms do I need to file? I have tried to find answers in the forums but no luck lol please help much appreciated thanks.

I don't think you need to file anything else just because she is pregnant! The only thing is that when you file for the 10-year-green card, your wife will have to meet a higher than 125% of the poverty level income. That is what I am thinking, since it is based on the number of people in the household, but they wouldn't count that until the baby is born I don't think! :) And actually you will probably even get the 10 year green card right away, since you've already been here for two years, if there are no issues with your case... so you can probably forget what I said about the poverty level income...

You should definitely finally file for AOS though! You might need a co-sponsor though as it would be your wife who would have to support you since she is the USC...

October 17, 2007 - K1 interview - approved

October 19, 2007 - K1 arrived in mail

October 21, 2007 - US entry

October 23, 2007 - Wedding day

November 27, 2007 - AOS, EAD, AP package sent

December 7, 2007 - Received all 3 NOA's for AOS, AP & EAD

December 10, 2007 - Received letter for biometrics appointment

January 2, 2008 - I-485 transferred to California

January 3, 2008 - Biometrics

January 16, 2008 - RFE for I-485

January 22, 2008 - RFE for I-485 arrived

January 23, 2008 - AP approved

January 25, 2008 - Case status finally updated: AP approved January 23!

January 31, 2008 - EAD card production ordered

February 2, 2008 - AP arrived in mail

February 5, 2008 - Sending a letter/RFE to CSC

February 5, 2008 - EAD card production ordered (again?!)

February 7, 2008 - RFE/letter arrived at CSC

February 7, 2008 - EAD approval sent

February 9, 2008 - EAD card received, dated January 23rd!

February 25, 2008 - CSC finally acknowledges receiving RFE

February 27, 2008 - I-485 APPROVED!

February 27, 2008 - Online case status: notice mailed welcoming new permanent resident.

March 3, 2008 - Received welcome letter

March 3, 2008 - I-485 approval letter sent

March 6, 2008 - Green card arrived in mail.

November 2009 - Removal of conditions...

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Since the child will be born a USC, the USCIS is simply is not involved....

The cost will unfortunately be even higher now that the new immigration fees took effect in July of 2007. $1010 for Adjustment of Status. Nothing extra to file immigration wise due to the pregnancy.
