Firing our lawyer

Need Advice....... :help:

Does anyone know if firing our lawyer while in waiting for our interview and package 3 from the embassy will effect our case status? We are planning to do the rest of the paperwork ourselves due to an ongoing communication problem with our lawyer. Will this have an effect on our case in a negative way? Also, where to find a list of what is needed for the interview perhaps a checklist or something.

Thanks in advance.

They could care less if you are represented or not...

Since checklists are consulate specific the best place to start looking is the consulate's website

YMMV

I posted this awhile back:

Our packet III is electronic, supplied to us back in october, and contained:

A form called "document prep for K interview"

Police certificate information form

DS-230 form

List of area sworn translators, for translating documents to english from foreign language

A one-page document titled "photograph requirements"

A list of area panel physicians

A form called DS-2053 (medical exam form for the physician to fill out)

A form called DS-3024 (chest X-ray form)

A form called DS-3025 Vaccination worksheet

A form called DS-3026 (typical medical history questionaire, like you would fill out as a new patient anywhere)

From the document prep form, directly copied:

The list of documents that we were told to provide:

1. Passport

2. DS-230 Part I

3. Birth Certificate(s)

4. Marriage Certificate (if applicable)

5. Name Change Certificate (if applicable)

6. Death or Divorce Decree (if applicable) from Petitioner and Beneficiary

7. Police Certificate

Each applicant aged 16 or older must have police clearance from any country where the applicant resided for one year or more.

If you have lived in more than one cities in Indonesia for six months or longer you should get the police certificate from the police region of each city (POLDA) or from the police headquarters in Jakarta (MABES POLRI, Jl. Trunojoyo, Kebayoran Baru) which covers all the districts in Indonesia.

8. Evidence of Support. The applicant must provide evidence that he/she will not become a public charge. Evidence of support could include fax copies of applicant's petitioner most recent Federal Income Tax Return (1040) and Tax Statement (W-2), or an employment letter stating salary or wage.

9. Photographs. Two (2) color photos of each applicant in the correct format

The only thing missing is filling out the non-immigrant visa petition, that's done electronically though.

They wanted my Original divorce decree, directly from the clerk of court with the stamp etc etc.

Her birth cert and our marriage books were translated by a translator from their list.

She scheduled an appointment for medical with a doctor from the list, the results were sent directly to the embassy and are being held pending receipt of the package from NVC.

The photograph requirements are directly from the department of state website.

Her name change was done through Indonesian Immigration directly in her passport, per instructions from the Jakarta Consulate.

The police certificate instructions are different for all the countries, I copied mine directly as an example.

Hope this helps. I actually have all these forms electronically

Regards,

David and Nitadyah

PS: The few messed-up petitions that I have seen on here have come through lawyers. Its not that they know less, its that they don't seem to care as much. Always glad to see a laywer fired.

I think firing your lawyer is a good move. Save the money and do your interview yourself. I think all the lawyer did for your case is fill out the papers and let you wait like the rest of us. Good luck!

I can't say how true this is but it does make sense - we did our paperwork and things ourselves and yeah - it was a steep learning curve with some mistakes along the way but nothing that was bad enough to even get us an RFE which we were half expecting :) You'll be fine on your own for the last leg of this part of the journey ;)

We are using a lawyer because i filed the petition immediately

after i returned from living abroad in Morocco. i was

between jobs and addresses and we also had questions regarding

my husband's (fiance) job and address.

Our petition sat on a paralegal's desk for 6 weeks, and only after i

inquired on a whim did we discover that it was never sent in. i had

done most of the paperwork myself. Basically, we were paying for

a second pair of eyes to make sure we filled out everything correctly.

We were delayed for 6 weeks because of someone's negligence, and now

we have a much unexpected RFE. i have no idea what any of it means.

Hayati has been very positive about the whole thing and patient.

i have been a wreck and crying frequently.

Anyway, i'm sorry... i cannot give you advice about firing your lawyer.

i can commiserate though and wish you good luck...

Sorry to hear you have had such a rough time - Like I said above - it has been a steep learning curve but I am very glad I have found this place and that we have done things ourselves - yes we've had our setbacks but I am very glad I have some understanding of the process now - I feel that with a lawyer we would be living in blissful (maybe) ignorance and if anything did arise that we would be completely clueless.

On another note - I hear tell that AoS is meant to be even more complicated but by then we will be with our OHs and that along with this wonderful forum will allow us to all figure things out eventually :) Luckily in this place for the most part there is always someone who has been through what you have so there is always advice on hand :)

I wish you all the best :) *hugs*

Wow I am so sorry to hear that but it almost doesnt seem fair that these lawyers get paid for doing nothing. You know the saying "if I knew then what I know now" We all have to be strong and hang in there together and support one another through this process. Things will work out for you just have faith, you were not denied right they asked for an RFE i believe that's further proof so that's a good thing. I will say a prayer for you. We fired our lawyer today and will do the rest of this grueling process by ourselves. Wish us luck!

Thanks so much for your prayers Semih and El!

Good for you for firing your lawyer. Did he / she say anything? Apologize at the least?

Regarding our situation: i can't help thinking about how we've lost six weeks. how that has impacted so much.

i am in Morocco now and with Hayati, thank God. At least we are together.

Good luck to you and many prayers,

Oh don't I just!! We've kicked ourselves so much over so many things - our petition was delayed by 4 weeks because of the mail so I know how you feel... it really does suck but you move on and keep strong - we'll all get there eventually :)
