When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 20 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

6 RepliesHey Everyone! I don't know if this is the correct forum to ask, but I'm an American about to get married to a Canadian in January. I plan on residing with my husband in Canada while we wait for our CR-1 to be processed and once it's approved we will be moving to America. I'll be staying on a visitor record while we wait for it to get completed. I plan on keeping multiple ties to the US (bank account, job, phone plan, etc.) to establish domicile and intent to have ties to America. Is there anything I should know about concerning having my name on a Canadian rental agreement, as me and my husband will be renting while we wait for our CR-1 Visa to complete? Thank you in advance.

2 RepliesGood day, guys. Today I called and asked for an Info Pass appointment. They gave me an application number but were quite vague with their response. They said I might be contacted anywhere from 2 days to 30 days, either by email or phone call, to schedule an appointment. I m in Miami Beach, FL. Has anyone had experience with this process or knows what to expect? Thank you.

My case: Me and my spouse applied on 09-May 2025 at 4 year 9 months completion. our 5 years of GC completed by August 2025.
Biometrics was marked as completed on day 1 by 09-May itself. since then, interview scheduling status has not moved.

I'm dealing with an annoying issue. My conditional green card expires on 11/06/2025. I put in for removal of conditions on 08/11/2025. I have an online account and I can find the Receipt Notice I-797C, Account Acceptance Notice and Appointment Scheduled Notice there. I also received those notices in the mail, except for the I-797C containing the 48 months extension. I do need this original notice for work as well as travel.
I got in touch with USCIS several times. Initially they told me to contact LockboxSupport. I did, but they replied saying they don't print notices and to contact the center processing my application.
I started a case for Non-Delivery of Document requesting they send me a copy of the I-797C on 10/03/2025. Yesterday (10/22/2025) I received the following reply
The status of this service request is:
You or your representative contacted U.S. Citizenship and Immigration Services (USCIS) about the non-delivery of your extension notice.
The local field office can provide you with temporary proof of your resident status. If you are need of temporary proof of your resident status, please request an appointment to receive an ADIT stamp. You may contact the USCIS Contact Center for an ADIT stamp appointment at 1 (800) 375-5283.This is not what I am looking for so I called USCIS again today and the agent told me a Notice was sent to me in the mail and returned back to them as non-delivered. I find that hard to believe since I never moved from this address and I received all other notices. She said she can see my non-delivery request but that they will not issue another receipt and that my only option is to get an ADIT stamp.
Has anyone else experienced this and successfully managed to receive a copy of the I-797C in the mail? Any tips or suggestions?
