Gathered all applicable evidence since our K-1 Visa attempt and our attorney submitted them today. NOA1 likely to follow in the next week. September 2, 2023: (K-1 Visa Attempt) Sent in the evidence for why we were unable to meet during the previous 2 years (military training, covid). Received a reply late July stating that military training and covid (and travel bans that resulted as a result) were not sufficient to consider our inability to meet due to "undue hardship", and were ultimately denied. We have abandoned the K1 visa, and have gotten married in order to pursue the CR1 visa. Originally started putting all this documentation together in late 2021 with expectations of her possibly being able to join me early mid 2023. Now it seems that will not happen until late 2025, early 2026. Pretty let down. April 11, 2023: (K-1 Visa Attempt) Received an RFE requesting either additional evidence for why we could not meet within the last two years, or that I had not requested a waiver. They did not state which. In my initial submission, I included all proof (DoD documentation, denial of OCONUS leave, inability of fiancee to travel to the states, and documents from the Ministry of Foreign Affairs of Japan stating that I would be denied entry upon arrival) but was still met with the RFE.
