Husband left before greencard was approved

Good luck. It's a long road ahead. Expect a lot of scrutiny.  I understand why you would be hurt and angry. Quite frankly, what he did was was just plain stupid. He could have waited long enough for the AP and then gone to visit. The message he sent whether he intended to or not was I'm done, I'm sneaking back home and not coming back.

Yep. I'd stack up as much relationship proof as possible. While you may understand why he left, USCIS is just going to see it as he abandoned you and his GC app, and that the relationship wasn't a priority, so why should they think it'll be a priority in the future? They may even ask where he stayed when he went back, where were the kids at? USCIS may have a lot of questions.

You said they were included on the K-1 but just hadn't came over yet, was there a reason they haven't moved over here yet? 

I totally understand what you are saying and I am well aware that there will be alot of scrutinity and I wont blame them for doubting him.

 

This was dependent on the mom letting them but I included them just in case it was okay. We really were not sure if she would let them at the same time I wanted to make sure if she would be okay with them moving then they already included on the petition instead of petitioning all over again.

My sentiments exactly when I first found out he had left.  Trust me I have had a lot of soul searching and I have revisited what you are saying alot of times. Its really sad but again I want to atleast try again. I'm trying to be positive about the whole situation...its been tough.

that makes a HUGE difference.

also, how long have u known him? how many times did u meet??

 

maybe you should take some time to visit him and see if you still want to be married to him and if he still wants to be in america.

With a K-1, your husband's unmarried children under age 21 were eligible for K-2 visas.  By leaving the US, the children are no longer eligible for K-2 visas.

 

With a CR-1, only your husband is eligible for a visa.  You will have to file separate I-130 for your stepchildren who were under age 18 when you got married.

I think the confusion is, because the OP said that not only did she withdrawl the I-864 for her husbands AOS, but she also canceled the K-1 visa. There wouldn't have been a way to cancel the K-1 as her husbands clearly already here, unless she intended to cancel the children's K-2's.

Hi there!! I went through same process. I applied for i485 in august 2015 but left US on January 2016 without advance parole. I had family emergency and had to leave right away.  After coming back my wife hired attorney. My attorney sent a letter NBC to transfer my i130 from my local office to NVC. Then we started cr1 process and i am recently approved for that. 

 

My Time line is Updated!

you left bc of a family emergency. he left bc he missed home.. big difference... also, sounds like u were here on a b2 visa. this person spent the time/money to come on a K1 and knew the consequences.

i really think it depends how long has this relationship been and how many times they have visited ect.
