we waited to long to apply for ssn.

hi guys,

our 1-94 is going to expire in 18 days and ss department said its too late because they have to send some things to uscis. and by the time they get it , it will expire so we have to wait for the green card to get ssn. does this sound right? any ideas? my work says i need a ssn for my spouse to add to health plan for next yr. we got married 8 days ago.

Your hr does NOT need a ssn to enroll your spouse into health plan. Ask them to use her passport number or some other auto generated number until she gets her social.

You should've gotten a social for fiancée a week after arrival as it does take a while for SSA to verify everything with USCIS. Too late now, you'll just have to wait until your spouse gets an EAD to go back to SSA and get social.

my hr is really sure on there answer i even talked to the manager and told me that without ssn i have to wait till next enrollment when she has ssn. i work for southwest airlines and they are self insured under obama care. they said there policy is different than other companies and they dont have to. is there a law that forces them to? i only have 20 more days before i can add her. also i didnt know i can use the ead to get ssn, i thought i have to wait for green card.

Put all 9s or list your social. You're the primary on health insurance. In the meantime file for AOS asap so you can get ssn when you get EAD.

My child didn't have a social and I had no issues with enrollment. When I got the social I updated the insurance.

That is interesting, I also work for a company that is self insured, but they have a process to make changes to benefits when a major family change takes place such as marriage, divorce, birth, etc. I can't imagine a company not allowing you to put your new spouse or new child on your insurance immediately, but who knows. As already stated, you missed the window for getting the SSN, so you will have to wait until you get either the EAD or the GC, file the AOS ASAP, and hopefully you can apply for the SSN in about 90 days.

I believe the social security office is mistaken. Your wife should be able to get her social security number up until two weeks before her I-94 expires. Talk to a supervisor at the social security office or try another social security office.

OP said that the office told him they need to send papers of to USCIS. This means that they needed the lvl 3 SAVE verification which can take 4-10 weeks. The card can't be issued until the verification is complete, which will be passed the i-94 date for sure.
