Can we delay the interview ?

Hi,

 

I have a very bad news. I have to cancel the K1 for at least one year because it doesn't fit with her school/family ...

 

I have already paid for the interview and just canceled it right now, I wanted to know If it's "unlimited" (schedule the interview in like next march) or in 3 months it will expire ?

I heard you only have up to 2-3 times of free rescheduling. After that, you'll have to pay a new $265.

 

Btw, your NOA2 has a validity date so you need to factor that in.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

I would try contacting the embassy and ask them. I'm not sure if they would be willing to delay the interview for a year or more, they may suggest that you start the K1 process over.  As mentioned above, remember that your NOA2 expires around 6 months after the approval date. Also if she has already done the medical exam, she will need to redo that as well should you reschedule to a much later date, as it is also usually valid for 6 months.

Try requesting an extension from the embassy...if they won't give you one...I'm afraid you will have to go through the whole process all over again. The K1 petition has a validity date (on the NOA2).

January 16, 2022 - Naturalization application received

the Petition is valid for 4 months.  You can request an additional 4 month extension.  That should get you at least 6-7 months.  Then, have the interview, and get the approval (thinking positive) and that is valid for another 4 (maybe 6?) months.  That puts you right at 11-12 months.   You may be able to request a 2nd extension if needed.  Wait for the medical until closer to the actual interview because those are only good for 6 months.  You shouldn't need to reapply if you do that.  I hope it all goes well for you!!

the only good thing in the story is that I see her for around 2 months in mid-July

bought the tickets in the morning: 12th July to 30th August in San Francisco !! B-)

I've already checked but still worried lol, I won't get in troubles at the customs because I started a K1 right ?

Congrats on your tickets!  As long as you have a valid Electronic Travel Authorization or Visa (of another type) you shouldn't have any problems from starting your K1 process.  Having the return ticket, enough finances to cover your trip, solid connections to home, etc - the same basic things that the border patrol officials would want anyway - should be just fine!  Save things from your trip for your interview! Boarding passes, pictures, etc.  Meeting in person and evidence of relationship are two things you can't have too much of when you interview! :)
