Does the 1040 need to be signed?

Me and my husband got a request for initial evidence on our affidavit because he had sent in the wrong paper (something with a w) when he was supposed to send the 1040.

He uses Turbotax and therefor there's no signature on it since he e-filed it and the signature and date is blank. Should he still sign it or is it okay?

He tried to call USCIS and ask but they wouldn't talk to him because he wasn't the petitioner. I'd love to call but I'm in Sweden and calling a landline from skype is usually like talking into a soda can. I can call them next week when I get home but I'm hoping someone here knows :)

Why don't you consider to send IRS transcript? Then to overkill it, you can send all the 1040's too. (Signature or not, it really doesn't matter much at all in this case) The truth is they prefer IRS transcript.

As far as i know, you can't download IRS transcript online right now. But your spouse can quickly order by mail on irs website. It will only take several days to be mailed to your mail box.

W2 ? Forget the tax return 1040 form he filed and get IRS tax transcripts, they have the complete schedules.

Call and request them by mail and you will have them in about a week.

If you are set on sending the e filed tax return then yes sign and date it. E filed doesn't need a wet signature for IRS purposes but

I would definitely sign them for USCIS and not risk a denial.

Tax transcripts are best.

And I'm assuming the transcript from IRS is a more formal 1040 than the turbotax printout? And not some completely different form?

It's on IRS letter head and it's the line items that have been electronically received by the IRS. It's the same information as the tax return that you would print out; only looks a little different and is from the IRS directly. No place to sign! :)

Nobody can be 100% sure WHAT exactly USCIS prefers - tax transcripts or completed Tax returns along with W-2s.. We also received RFE. And USCIS requested for photocopies of Tax return along with W-2s. No word about tax transcripts. So, you never know... I would send Tax return.. It doesn't hurt anyway. And yes, definitely sign them for USCIS - don't take any risk to get denied for failed response to RFE.

Good luck! :)

Send exactly what they asked for... If the USCIS letter says "1040" - send this. And don't forget to sign :) :)

1040 - it is completed Tax return

???? - tax transcripts.

If USCIS requested for 1040 - they asked you for Tax Return, not for tax transcripts! So, definitely sent THIS, along with W-2s.

Once again - GOOD LUCK!!!!

correct no one can be 100 percent sure what USCIS prefer but considering that a tax transcript comes from the IRS and a tax form comes from the individual. I am pretty sure they will prefer the tax transcript

Yeah, a tax return is technically the form. They don't really want a form, they are looking for the information on the form. You sign a tax return to demonstrate under penalty of perjury that the information is correct and such. Technically, you are signing it for the tax regulator - not for immigration purposes. The tax transcripts would negate that because the signature was already stamped when the return was e-filed.

Transcripts are higher level of proof than printed returns.

Signature coming soon...

"...but there is really no proof that the info on the form is correct or was even sent to the I.R.S".. Well, that's why you should sign the copies of your Tax return - you are responsible for the information you gave. And that's why USCIS takes some time to make a decision after your response to RFE - to check and to review.

If USCIS requested for Tax transcripts - they would have asked for it, they know exactly what it is :)

But ONCE again - RFE letter has mentioned 1040, which is COPLETED TAX RETURN. Period.

So, Tax return mast be send ANYWAY, without any guessing "why and what USCIS prefers".

Tax transcripts - up to you, guys. It doesn't hurt to send BOTH documents:) :)

Once again A !040 1040a 0r 1040ez is not tax returns they are forms that anyone can fill out and put whatever they want.

A tax transcript is an official record from then IRS. that makes the transcripts more closer to a tax return then a 1040 form is

as mention the NVC does not care about the form they want to see what is on the form and proof that the income is correct a tax transcript does that. A copy of a 1040 form does not without copies of w-2 1099 or anything else sent in with the 1040.

I have no idea what you're talking about but we're not sending anything to NVC, we're sending it to USCIS and they specifically asked for the 1040. People have told me to get the transcripts so that's what we have ordered from the IRS.
