Hi everyone! question.

For married permanent resident (2 more yrs before citizenship), is it better to file k3 or IR for spouse (no children)?

You have to file IR1. You cannot file for K3 until you have a pending I130 immigrant visa in category IR1/CR1.

I applied for K3 and was converted to an IR 1 anyway. The whole process has been expensive and extremely time consuming. Save yourself time and money- go for the IR.

(My opinion!)

Plus with the IR, the work permit is included when it isn't with the K3(you have to apply separately)

You should apply now. The process will be completed by two years. If the process is not completed by then you can always upgrade your petition from F2A to IR1/CR1.

Why not start now get things started and rolling? It's already a 8 to 12 month if you are a citizen barring any issues. So why waste time and wait Upgrade when the time comes but at least your petition is done. Hopefully just sitting at NVC at that point waiting for upgrade from you. K3 is really is a dead issue it gains you nothing. It's not the Visa it use to be.

You would be filing a I-130 that will go the IR1/CR1 path. That will bring your spouse here. Even if you also filed the I-129F to try and go the K3 path the I-129F would be administratively closed because the I-130 and I129F are pretty much approved together. And if there's a n approved I-130 in the system The I-129F will be closed.

K3 is moot on two fronts:

• Only US Citizens can begin the process for a K visa.
• Current USCIS and State Department procedures have rendered the K3 virtually unobtainable; issuance of one is a rare occurrence.

An LPR can neither file for a K3 or an IR.

An LPR files for a spouse in the F2a category.

You file an I-130 for your spouse in the F2a category.

When you become a US citizen, then you can upgrade from the F2a to the IR category.
