I hear ya! When I started this process, I thought we had to AOS by the 90 days. When I found out we didn't need to, I was so relieved! I plan to AOS this November (if we can get the embassy and visa moving again...), but it's a large investment for my salary level! But the flexibility is a much needed comfort level! Phew!

Exactly, I am hearing different things. I have people telling me that you have to filer for your AOS before you I94 expires or you will be deported. Our I94 expires on 10/15/2015 we are getting married this Saturday 8/29/15. People are saying that they know friends that got deported because they didnt filer thier AOS before the I94 expired. I just wanted clarification and make sure all my ducks are in a row.

Technically you are out of status once the I-94 expires and you have not submitted your AOS. But, there have been those who have waited, much like you and for the same reasons, and nothing ever happened to them. If ICE wanted to be AH, then yes they could push the issue.

Just get it done in a reasonable time frame 1-3 months, and it sounds like that is what your plans are. Don't leave the country as the door will shut and lock behind you.

You can AOS after you get married. It's normally easier to get the SSN before, while you still have time on the I-94, but you should be getting an SSN with the EAD. For us, we'll get SSN first, included it in the petition, then change his name and wait for the new social security card/EAD. (The first social security card should say "Not authorized to work" or something to that effect.)

You can file for EAD and AP (advance parole) with the AOS. The EAD and AP take about 2.5 months right now, but the conditional green card can take over 8 months to be approved. You can travel out of US after you get the AP approved. Good thing the EAD and AP are faster than the conditional green card!!!

If you have a EAD card OR a Green Card then yes you can travel outside the US BUT..... don't be out of the country more than one year or you may not get back in without some difficulty and you may find that USCIS thinks you have abandon your conditional permanent residency.

6 month, 6 weeks no problem. Just travel with your passport and either of those two documents.

Do you mean AP or EAD? I really don't think the employment authorization document is for re-entry purposes...

You're all very lucky. We filed in March and our application has not been touched yet. No one has looked at it.......By the time they do we will have 8 years together.

We're waiting too. Luck of the draw as to which cases get looked at in which order it seems.
