Just an update guys! We finally have a court date of September 9th. We should interview for the i130 before this if the timelines are right. Submitted good info (photos, statements from sons teacher, bank acct, and will be bringing even more with us) with that package, and we as well as the lawyer are confident about it. If all goes as planned and hoped then we will bring an approved i130 to court, and things will be closed and passed on to USCIS for the AOS package.

Husband and I were starting to think court might not happen til 2016!

Back again!

VSC processing time is tracking at 5mo for the i-130. That means we should be up around end of July. Crossing fingers that we interview before the court date, because having the lawyer ask to extend and come back afterwards is just going to suck to the tune of another 3-6mo.

In the meantime since I just graduated, I'm keeping busy by doing postgrad work and job hunting so I can make the income levels for our family size. We are still as positive as ever about things, the only issue on our mind is me making the income. No other worries :)

Well guys, our i130 was transferred from the vsc to csc in August. Lawyer said this has happened to many petitions as they are "balancing workloads" as the notice put it. So here we are, 8mo into waiting for either an approval or interview. Reality says the i130 process is taking almost a year which really, really sucks. Tier 2 inquiry just said we are still pending approval or something similar.

As for court, we had the first master hearing in September. We were literally the first case to go before the judge and while listening to the judge ask our lawyers one things I found out that we did NOT get married during removal. I had assumed we did, since the first piece of mail that came to his old address was dated before we wed. His removal wasn't officially in process til that day we went to the ICE office 6wk after we married. That makes me feel better.

So we spent maybe 3min in court. The usual, yes he has a relief option and a pending i130. Come back in 6mo. So March 2016 we will be back in court unless we get approved first....which my goodness, I would hope would happen by then.

Will update again if anything else happens. Thanks for following!

Hello again VJers,

Our i130 got approved yesterday without an interview!

After the transfer to the CSC, and another 3.5mo withou hearing anything more, I decided to enlist our local congresswoman's office to try and find out anything about the case earlier this month.

I'm pretty convinced that is what moved things along to the finish line. Next step, we will try and ask the IJ to close the case without us coming back to court again in March. 50-50 whether the judge would get to our written request before said court date. If not, we ask for closure on that date so we can go ahead and file adjustment of status.

Again, I hope this thread helps someone who is in the same boat :)

Still waiting to see if the judge and ice attorney will join in a motion to close; lawyer said its 50-50. So that was sent in around the first week of January. No news yet. I'm thinking we will end up back in court to close the case which is fine. We just want things closed to proceed normally.

Currently gathering documents and info for the AOS packet, planning on having it in hand to show the judge!

Inquiry about case status again: Oct. 2016- Due to factors not related to your case, anticipate a delay in processing

Today we went to a second master hearing. No one ever got around to seeing the motion we sent in advance, for whatever reasons. However....

Case closed today!! We have survived the dreaded immigration court. Things will be remanded to USCIS and Monday we will file the AOS packet.

Guys, I can't stress enough that if you come across this because you're in the same boat, have a lawyer who is familiar with removals and who can guide you through things.

That being said, I think this is my final post on this thread. I hope it can help out someone else possibly to read an account of been there done that and won the trophy.

**Adjusting from initial Q1/changed to B1 then overstay, termination of removal proceedings**

(STAND ALONE i-130/TERMINATION OF REMOVAL)

First met: Totally random by asking for directions, June 2014 while on vacation at Disney World (L)

Engaged: Aug. 21, 2014

Married: Dec. 1, 2014

ICE phone contact: sometime in early Dec. 2014- Co-operated, retained attorney who advised the same.

Filed stand alone i-130: January 2015 (VSC)

ICE home visit, schedule time to go to DHS office and NTA issued, date TBD, was not detained and released on own recognizance within an hour: January, 2015.

NOA1: Feb. 20, 2015.

Transfer to CSC to balance workloads: August 2015
