Income: 2007.. Approx. $ 26,000.00 . Work, Unemployement, workmans Compensation

2008.. Approx. $ 19,225.00 . Work

2009.. Approx. $ 25,500.00 Work

2010.. Unemployment. 12,500.00 WorkmensComp $9,500.00, Cashed out 401-K $5000.00

Current Income: Unemployment. $360.00 per week USD.

I'm a Union Painter and my rate of pay is about $ 20.00 per hour but I know that don't matter. Employment benefits will end just as Spring arrive here and if there is No work at the Union I will take a lower paying job to meet Currant Income Requirements. But,

I fear that is too late. Mav will have her interview about Spring when my work starts to open. I have a letter from the Union on letterhead stating my wage but Its just a piece of paper to me. Means nothing really.

There is No Savings really, My average Bank balance is about $800.00 for the past year.

Please Kill me Now and Offer some some advice and don't hold back.

I'm getting to Old to Paint Bridges and thats why Workmans Compensation Claim are made. But I'm released from any injuries 100%

I stay i contact with the Union every week for work, but there is none.

Well, I just spilled my guts. Tell me. I'am a man. I can take it.

The problem is that I don't think the Manila consulate accepts co-sponsors (even if the OP did have a willing person to serve as co-sponsor).

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

Mav was afraid I would ask this question and she will read this. She knows I worry about it. But, life is about the truth. There are No exceptions. I been told Workmans Compensation, Unemployement Compensation Count as Income. Retirement plans Cashed out with proof as well. But, I feel it won't mean a thing. It is Tempory as a source of Income. I'm not afraid to work but, I'm a painter. 2 inches of snow this morning and 32 degrees in Portland Oregon. I'm not afraid to look for another job but when I fill out a application for a lower paying job they look at me and look at what I make with the Union and fell I won't stay there when the weather gets better. This maybe true when I alone. But, I feel alone now even more. Her heart is going to be broke. Dam...

Manila doesn't usually accept joint sponsors with K visas, but they have no choice with CR visas. If you can't get your income situation sorted out before the interview then pull the petition, take a little holiday in the PI, and marry your fiancee. File for a CR1.

You can't fix what you can't fix.

Manila doesn't usually accept joint sponsors with K visas, but they have no choice with CR visas. If you can't get your income situation sorted out before the interview then pull the petition, take a little holiday in the PI, and marry your fiancee. File for a CR1.

Jim. What If can get a job before the interview that meets the income requirements. I only need to make about $12.00 per hour . Jim what would you say then? I would do that but, still those jobs are swamped by hundreds of applications for employment from others. I have been painting professoinally for 22 years and a Non-Unoin job pays about 12.00 to 15.00 per hour full-time. But, I'm kidding myself. That work is not there right now. I'll take any job that meets the Requirements.

If you wish to proceed with the K visa you have answered your own question "meet the income requirements". What jimVaphuong said for the CR1 will work only if you get your income sorted out or, a co sponsor for your 'low income'. With out a co-sponsor for the CR you'll just be a married couple living in two different countries until you sort out you income/co-sponsor problems. Your in a tuff spot try to find a job that will meet the reqirements, or a co-sponsor.

Hey there OP! It seems to me that if you are relying only on your income, then you are correct. Your income for 2010 will be too low for the most previous tax year, which at this point is 2010. However, if the other methods of income can be attributed then you may just squeak by (if I'm adding up the totals you've provided accuartely). I'm also assuming that your income needs to be sufficient for two people (no kids, etc?).

Have you taken the time to accurately go through your finances? I know you said your bank account would not suffice. What about other assets? Are you sure what you made in the last year will not meet the 125% poverty guideline. What is it... $18,212 for two people? If you needed to go the co-sponsor route are you certain you have no one that could help you? Close relative etc? Dig deep.

*Edited to add - Technically, it seems if you were on unemployment for the entire year at the rate you make now you would be just over the 125% guideline for two people. However, each state determines what is a "means-tested public benefit"... so idk if Unemployment would be considered one or not.

Hey guy - make sure your numbers are correct. If you meet the 125% guideline go for it. If not, paint like hell this summer and go marry the girl. Bottom line - find a way.

I am concerned about you and your fiance. Everyone else is looking at your situation and has no clue how to actually help you. You need to help yourself. Put my idea into action. This is between me and you. You need steady income and nothing else besides your fiance with you.

My driving record consists of 1 Basic speed law in the past 10 years. No felonys. But a CDL requires Schooling. $$$ Swift Transport generally requires 2 years Over-the-Road Experince just to start. My father just retired from Snitzer. (The Orange Fleet) and drove for years. Painting is to Seasonal I agree. Thanks Kuya. Tell me more

Read the Original Post. I'm over 125% of the guildlines for the past 3 years. However, I myself feel Unemployment is Bullshi......et. When it will come to sending Mav to a Manila Consulate. Even at my rate of Unemployment, which I worked for: $ 328.00 per week, less I have 10% taken out for taxes. So $328.00 plus $32.80 is $360.80 per week TIMES 52 weeks = $ 18,756.16. Which is Over again for the 4th year over 125% of the poverty Line. However, If I was the consulate in Manila. I would reject my application on such #######. I'm not afraid to work. I have a couple months of Unemployment left and call my Union every week. I'm not afraid to take a less paying Job. I agree, Unemployment is not Income even though they say it is Countable as Income. It is short term and not reliable. Keep the flow going. the more you write , the more I learn. I hope not at the exspense of Mav that will see every post later. Thanks Tim
