Get Divorced to Remarry in NY State due to ON certificate wait time

Hi -

We got married in late August. I no longer have any remaining patience for the Ontario wait time to get a marriage certificate and would like to "remarry" in NY State so we can get the certificate more quickly. Do we need to get divorced in Ontario before we can legally do this?

Late August 2010? 4 Weeks does not seem unreasonable....just saying. There will be a lot more waiting in the immigration process then 4 weeks.

Yea I'd get used to waiting if I were you.

Also getting divorced just to get remarried because you're tired of waiting for a certificate seems a little dramatic. Plus I think you'd get the certificate before you finalize a divorce.

Is that even possible to divorce because of that? Does it not go on record the reason for divorce so even if you lied to make the divorce work because i doubt saying "we need a divorce because we cant get the certificate fast enough " would get you a divorce. You have to provide your divorce records for any petition and they will see you married the same person a second time and the reason for divorce? Seems rediculous.

If you can't wait 4 weeks for the marriage certificate, one has to wonder...how are you going to handle the immigration wait?

I agree, by the time you'd even GET a divorce decree, you would have gotten your marriage cert a loooooong time ago.

You can contact your local Member of Provincial Parliament and ask his/her office to try and expedite the certificate. You can explain you need it for immigration purposes. Some MPPs are really good at this; others not so much, but it is worth a try. Sometimes just having that extra clout will help you get it a little bit faster. 4 weeks isn't long, but it is still darn frustrating when you know you can't proceed to the next stage until the document arrives.

Sucks waiting, but if you divorce if I remember right Ontario has a 1yr separation period before you can divorce then you still have the waiting period before you can remarry.

And you need your marriage certificate when you file.
