I-765 = Why do we answer (c)(9) for question 16

Hi... obviously I'm filling in all of my forms today. :)

As I was going through the directions for the I-765, I thought that I should mark (a)(6) for question 16 (my husband entered on a K-1 visa). Then, when I looked on the "Tips for Adjustment of Status for K-1 Visa Holders" ( http://www.visajourney.com/forums/index.ph...&page=k1aos ), it says that I should be sure to mark ©(9). The example document also has the same information. Why should we mark it that way?

David does not already have an EAD as he did not enter through a POE that gave him a stamp...

I apologize in advance if I'm going crazy after spending the last two days doing these forms and I can't make sense of anything anymore! :)

7/8/08 Got list of vaccines he still needed from CS by fax/phone; tested for immunity to MMR (only vaccine still needed) at our family dr

7/9 & 7/10/08 Went back to SSA, card still not received - Denied opportunity to apply for replacement ----- TRIP 4; Went back to SSA again to apply for a replacement card - Talked to a supervisor this time, POE people entered his last name incorrectly ----- TRIP 5; went to get David's ID thru the State, denied - instructions wrong on website; measles test inconclusive, another test needed; requested new lease

7/14/08 SSA called me in regards to problems at local SSA office

7/15/08 INFOPASS appt to fix POE name input error and then went to airport to fix POE name error

7/17/08 Received SSN card in mail and went to get state ID

7/21/08 State ID received in the mail and tested again for measles immunity

7/29/08 MMR shot #2 given and dropped off papers at Civil Surgeon (CS)

7/31/08 Picked up I-693, completed by local CS, (I paid $25, don't be fooled)

8/3 - 8/6/08 Worked on forms I-485, G-325A, I-864, I-765 and I-131; sent to Chicago - YESSS!

8/11/08 NOA1 for AOS, EAD and AP; 9/2/08 Transfered to CSC; 9/4/08 Biometrics

10/24/08 Rec'd AP; 10/27/08 Rec'd EAD; 11/24/08 Rec'd GC

No, the correct answer is indeed C9. A6 would be useless. It would only be valid for as long as the I-94 is valid. By the time your I-765 is processed, your I-94 may have expired and you would have wasted your time. The C9 category will be good for 1 year. C9 is for anyone applying to adjust status or register permanent residence. That is you if you came on a K-1, got married, and are not adjusting status to obtain a green card. You are doing AOS at the same time right? A6 is equivalant to the EAD stamp some get at the POE (valid for the life of the I-94), and if you file for EAD without filing for AOS (under category A6), it will cost you $340.

06/19/2008 - both AOS and EAD touched because of biometrics

05/18/2009 - Welcome Letter received

06/12/2009 - Second card production ordered email

06/19/2009 - Approval notice send email

06/22/2009 - Green Card received

04/09/2012 - Applied for Citizenship by Express Mailing N400 to NBC

K-1 holder is C(9).

Why ? I don't know- i called uscis they said us, c(9).

I asked the questions on vj, they said me c(9).

Now my I-485 is at California service center :whistle: and i din't receive RFEs

David does not already have an EAD as he did not enter through a POE that gave him a stamp...

Did you read this last sentence in the instructions under K-1 visa holders:

Any EAD application, other than for a replacement, must be based on your pending application for adjustment under (-c)(9).

Only a replacement EAD would be (A)(6), all others should be based on the pending AOS (-C)(9)

K1 visa here ...filed my AOS with ©(9) ...... got transferred to CSC without RFE.. approved and GC received!

I just saw in your timeline that your husband applied for a State ID and received it....I never thought of that possibility!

I thought that only US citizens can get one?!

What's the deal with the State ID? Anybody????? :huh:

I just saw in your timeline that your husband applied for a State ID and received it....I never thought of that possibility!

I thought that only US citizens can get one?!

What's the deal with the State ID? Anybody????? :huh:

Hi! I checked out our Motor Vehicle Administration website and knew that people could get an ID card that wouldn't be a driver's license. I just followed the rules and after he got his SSN, we went down with all the required documents and got him one. Mind you, this was before his I-94 expired. He wouldn't be able to get one now because it is expired...

I would check out your local MVA type place online and see what the requirements are. If you're already into the AOS process, you might have to wait until he has the papers.

I was super paranoid that he might lose his passport/visa as he was carrying it around for ID. I knew it would be safer for him to just have the State ID for every day use!

i had santiago file for a learners permit lol... it expired july 28th now i wondeer what shld i do to take the road test.. but actaully the real expiration date on the id says 2013 ...

its not a biggie but was just curious what to do when he takes the road test !

Has he already passed the book test? I don't know in regards to taking the road test... have you checked online with your local DMV/MVA?

Yes he passsed the written test, he needs to take the road test but the learners permit has a regular expiration date for 2013, but in red on top of his name its says exp 7/28/08 i think meaning the visa?

i wonder now if with that he can go take his 5 hr class and then take the test!!!

Right. And, if you don't do it like that, it's a huge headache. Believe me, I remember. Had to refile paperwork and pay more money.
