    First of all, I have no idea why you are even getting involved. Let them both hang themselves. Its not your problem.
    Second, does the wife know that divorce does not release her obligation to her husband? meaning, Married or divorced, she signed papers to be his sponsor. Unitl he becomes a citizen, she is still "responsible" She should really read up. I'd send his cheating a$$ back to where ever the Fug he came from. That is just too much drama for my taste. Get out from under that lead weight on her shoulders. Turn his a$$ in to immigration and let him get deported.
    It all sounds so fishy to me.
    Do yourself a favor and walk away. Tell them you have no idea and leave it like that.

    Only 6 months and he has betrayed his wife who paid all of the expenses for him to come to the U.S. and be her husband. I hope he gets denied removing his conditions of his 2 year green card. People like him make me sick to my stomach. His wife is the victim. What a shame.

    I don't think the married couples are more legitimate, more power, or more painful. (Unless there are kids involved, then yes, it is way more painful than people with no kids. That doesn't mean your pain is invalid, it just means that carrying your own pain, plus the pain of your little ones is worse than just carrying your own.)
    Marriage might just be a piece of paper, relationship wise, but it's also a legal contract. As such, there is a legal commitment there that someone coming in on a fiance visa doesn't have. For instance, when I moved to the Netherlands, our relationship was filed as a civil union. So we were living together, etc, but it could be dissolved immediately by either party without having to go to court. We were only entitled to those assets that we brought into the relationship, etc. As a married couple, we would need to divorce in the court (thus dissolving the legal contract between us) and split up our marital assets 50/50 because that's the way the law works in that country. Fiance's do not have that legal contract in place, is all that I'm saying. And I think that having a legal contract should work in the favor of those who are married, which does not seem to be the case, currently.
    I don't think that fiance's should be slowly adjudicated. I think they should hire more people and speed up the process for all of us.
    And if you want to get married, you don't need a fiance visa to do so. You can do it on a tourist visa, you just can't adjust your status or immigrate. My husband and I got married here in NJ while he was on a tourist visa, and then we went back to the Netherlands. You only file for the fiance visa if you're planning on immigrating. Yes, you need to adjust status afterwards, but you get to stay with your spouse while you're doing it. I really do understand, I've done it, and it sucks having to go through that, but it's a completely different kind of suck when your spouse can't even visit you (without a serious chance of being denied entry) for months or possibly years.
    But I honestly don't blame the K1's. Not one little bit. I'm jealous as all hell that they are getting their files processed so quickly. I miss my husband so much there aren't even words. I cry every day. My kids cry every day. And I HATE the USCIS for doing this to all of us. But it's not the other petitioner's faults.

    Which sucks. When I moved to the Netherlands, I spent more than 2 years waiting for my residency permit, during which time I was not allowed to work, go to school, even be insured. I married my husband during that time, because we weren't willing to wait for some stupid government agency to get their heads out of their butts. But the difference was that we were together. We weren't separated overseas from each other. We also didn't have children.
    I'm sorry, but as far as I'm concerned it should go IR/CR/Fiance if there NEEDS to be a priority. IR people should be VERY easy to adjudicate because you don't stay married to someone for years and years, possibly living together in another country for that time, just so one spouse can get a GC. But we shouldn't have to make this kind of distinction. The crappy service given by the USCIS means that we turn against each other instead of working together to get something done.

    Yes, the UKBA is God's gift to the world when compared to the USCIS. They are so fast and efficient. I got my marriage visit visa in one week. It was great.
    When you're going through this process it never feels like it will end or "happen". I can't even imagine life with my wife here and once she's here we'll remember this process for a long time because it put our relationship on hold for two years, effectively. The pain will stick with us for a long time coming and I don't believe anything will get better. In fact I believe the process will get longer and things will become permanently worse. It also doesn't help one's psyche when we have a child on the way I won't be able to enjoy for the first year and a half of its life.
    I don't think the person was blaming K-1s, but rather the system for disenfranchising people who are already in a legally binding relationship, but don't get treated with the same processing speed and efficiency as those who aren't. It's very unfair. Yes, we've all heard the stories of the total 12 month processing times for K-1s. But the difference between that and current MASSIVE I-130 backlog is that USCIS actually fixed the problem, whereas now it doesn't seem like they care at all and no end to the backlog is in sight. The current 12-16 months for just an NOA2 for I-130s is here to stay, I'm afraid. Call me pessimistic, but that's the truth. How can you understand how frustrating it is, given the fact that we're already married and we're treated worse than people who aren't married (not saying they're bad, please don't think I am)?
    Nope, after the NOA2 is issued it's pretty much the same (minus the fact that CR-1s need to file an AOS. Actually, I think it's shorter for K-1s after they get their NOA2 because they don't spend a lot of time at the NVC from what I've read, and also get to schedule their own interview date, which CR-1s aren't allowed to do. Someone please correct me if I'm wrong. The NOA2 part is the one that causes CR-1s to be so slow because right now it's taking anywhere from 12-16 months, whereas K-1s are getting their NOA2 in 2-3, it appears. Terrible is an understatement for the current state of I-130s.
    It's more than ridiculous. It's outrageous and puts so much undue stress on married couples, especially those who have children like my wife and I. Be thankful you went the fiance visa route and aren't being tortured just for trying to bring your spouse to the United States as a tax paying citizen.

    Marrying in the US is legal whether planned or unplanned, as long as you return home before your passport stamp expires. Adjusting status after getting married is illegal if that was your intention when you entered the country as a visitor.
    Adjusting status after getting married is only legal if it wasn't your intention to do so when you entered the country. You might need to prove it wasn't your intention, and if the interviewing officer doesn't believe you, he has the power to initiate removal proceedings and if he feels extra Hitler-esque, can slap a ban on you too. But in reality, most people do get away with it. Personally, I didn't want to gamble and just went home to do the CR-1. It's taking a while to get everything together, but it will be worth it in the end.

    No. Not until he becomes a citizen, leaves the USA, dies or works 40 work quarters. The gov't will most likely come after you for anything because you're the primary sponsor.

    Thank you.. I want to share with you that I am happy for you. My experience has been horrific at times.. but still I would never want to take away from the joy and happiness from anyone once it is over for them. I would like to find away to make it known.. that the immigration system is a joke.. lol. It is! Not the entire country.. I have never said that. I am sad to leave my home. But I made this choice.. I am fine with that. I just would like to see that it stops hurting people like this.

    I come from a military family. My brother barely knew my dad growing up because he spent so much time in Iraq, and my mother was sent into severe depression due to his absence. So I understand the desire to protect that which you've fought for so hard, but KhunKazuri is right, even if his/her tone may have been a bit harsh. There is no benefit to mindless jingoism or the attitude that you can't say anything negative about your country. Protesting and making your fellow citizens aware of when things aren't going as they should is not only a right, but a responsibility. It's the reason this country exists and we are no longer colonies of the Crown.
    This isn't a city mouse, country mouse thing. It's a matter of holding your country to the appropriate standard of compassion, and in doing so setting aside your differences and grudges to do what is right and just, and that has nothing to do with where you may or may not live.

    To think this sometimes is the first government experience that people from all over the World experience just to be happy or a family in America!! WOW The whole immigration system is a joke, and a disgrace. There's no consistency, no humanity, forget compassion or understanding. Your just a greenback and a number.
    Don't get me wrong, I have long overcome my lack of patience with this system. Because if I hadn't I would have gone cuckoo with this process. In the beginning I think I did a little. LOL. ( 3 years running) This by far has been the roughest, most taxing, trial that I have ever been through. Giving up careers, children, family, money... all for the American Dream of, Marriage 2.5 kids a dog and a white picket fence... HA!
    The biggest shame.. and disgrace.. is this is what the country was made from!! Immigration!! But to think about the mounds of paperwork that immigration has to go through...and to have no rime or reason to THIS system is scary. How in the world can they keep out who they want to? Or let in who they should? When they have no idea where your file is? Who has it? How long it will take for someone to look at it? AGAIN.... How can they keep out who THEY SHOULD?!?!?
    Cause that's the whole point! Right? Keep us safe? Keep out the Bad guys/people? ... LOCKS ONLY KEEP OUT GOOD PEOPLE!! Honest People!! Bad people.. don't use locks! What a joke.
    Then to hear/ read all the stories about.. ohhhh.. She was "one hell of an actress". or. "he used me to come"..( I know... cause I was one of them years ago) Divorce.. shortly after Greencard stories. sigh... People barely knowing each other and getting married .. to divorce shortly after getting here. What a mess!.
    I personally have one hell of a back story! Speaking from experience at the Stress that this process puts people threw.
    I voted for the current president cause I truly hoped that... this immigration system would get better. HA! I feel so bad for ALL OF US... No matter what the story is, no matter what the situation is... GOOD BAD UGLY AND LONG!! I FEEL SO SORRY for all the HEARTBREAK that everyone is going through. Again...So sad that USA immigration is such a joke.. and FAMILY and HAPPINESS can be truly shattered.     Completely agreed... I have long become indifferent to this situation.. this immigration. If god is trying to teach me patience.. he is doing a good job. As I stated also to this reply as you did. It doesn't matter the situation.. if it's "NO" fine.. it's "NO".. LOL. But don't drag me and my children threw years of money, separation, and sometimes... deep despair. Just pick up the damn file.. read it.. make notes.. say NO.. and tell me that if I want to be with this man.. I can't be in America. Period. End of story... Fine. Then I/ we all can then make educated decisions on what to do next with our life. But.. this bull ####### of months and months and years and years is torture. Watching my daughter hug the computer screen of Skype and say "nite nite daddy" is something no one should go through... especially... my TWO YEAR OLD. Family first.. in America..??? HA! ALL #######!

    It doesn't matter and shouldn't matter.
    If he is qualified to immigrate then it should be done as efficiently as possible. If not then publish a clear cut and irrefutable guideline so folks don't waste their time and money.

    To the OP... In my experience Canada has a Social System, and if she needs assistance with housing I am sure that before you BOTH leave HER country you should start there. She may need to go back to work. She may need to work out staying with Friends. She may need to see if she can stay with MOM. You will be separated.. and she will need to survive. You seemed concerned for her.. then You may need to figure out how to afford housing in BOTH countries.
    Original poster.. I am speaking from experience.. trust me when I say.. I am a single mom, thanks to our choices on how to handle this immigration situation. I am here in the US with a 2 year old and WE have to send each other money all the time back and forth until this is all over. I housed my husband in Canada for 6 months to get us through the Birth of our child. I traveled back and forth thru a Michigan / Canadian winter until 2 days before I had our daughter. All I am saying is... it wont be easy.. but you can do it. Stop crying, think logically, and figure out a means to an end. This will be over soon, and you will get thru it. But don't break the rules, figure out cheaper housing for her in Canada, and file for your visa.

    Let's see;
    His overstay is less than 180 days, right?
    He has no "Petition-able Relationship" at the moment other than Fiancé, right?
    Since his overstay doesn't incur any ban other than his ability to use the Visa Waiver Program again and he does have an unused airline ticket from the US to Belgium...
    Why doesn't he opt for Voluntary Departure in lieu of being deported?
    The advantages:
    1) Smaller blemish on his immigration file.
    2) Avoids being deemed as inadmissible so there should no need for a waiver at interview time.
    3) Gets him out of detention and on the plane ASAP.
    Then you can file for K-1 ASAP and get the ball rolling.
    Someone else please tell me if I'm missing something...
