Long Story Short.. Waiting like everyone else here. Today my 11 year old son decided that he wants to live with his Father. Cause you know.. dad's cooler. So... many people here before suggested that I go to Belgium since my husband can't be here yet. Well I stayed in the USA due to my son.. well now that's not an issue as much. The living situation with my son being at his fathers will be a great learning experience for the both of them. So we will see in 3-6 months how that turns out. In the mean time.. I have no reason to be here. My husband and I have been married for 3 years, and have a 2 year old Daughter together.

Now you would think we could be one big happy family. Except how will the situation be if I go there? Anyone no what I have to do to make sure that I can at least stay there through this whole Immigration ####### with America? Can I direct consulate file? Can I go there? How long can I stay? How will this effect immigration here? Since.. 2 days ago I went to the local office that my file is STILL at after 5 months.. and apparently it's in the and I Quote" the pending interview basket" .. what ever the in hell that means? Don't know if it always was in the " Basket"? Have no idea how long.. nor would they tell me that it will take to get out to the " Basket"?..for the initial I-130 interview here at my local office.

I am excited and sad all at the same time.. cause I always saw us here as a family. Now if I have to come back and start all over then that won't be the case.

I just want to spend some time with my husband.. let him be a dad.. let him help with all the single mother things that I have had to do by myself, and tick away the clock at how long it will take for him to come home here.. I have an older child who will marry, my parents are getting older.. I have no siblings or cousins.. so.. I will have to come back due to moral and family values.. I just hope he will be at my side from here and on.

Any help with going there? and what I need to do to prepare.. so I don't get in a bad situation?

How will this effect immigration here? Since.. 2 days ago I went to the local office that my file is STILL at after 5 months.. and apparently it's in the and I Quote" the pending interview basket" .. what ever the in hell that means? Don't know if it always was in the " Basket"? Have no idea how long.. nor would they tell me that it will take to get out to the " Basket"?..for the initial I-130 interview here at my local office.

Okay you already have your petition and its been 5 months? Well DCF (Direct Consular File wouldn't be an option for you until satisfy the requirements to be able to file as a resident. You already filed.

This is what i suggest:

1. Have you gone to the uscis.gov and registerd your receipt # so you get text and email when approved?

2. You need to check with the Belgium embassy to see what you need to do to stay there have no idea if you need a visa or just get in with a passport.

3. Go to the NVC fiers thread and read post #1 and post #2. Both will apply to you. NVC is where yor petition will go after USCIS approves it. There's much gathering to do.

4. Also on that thread is setting up domicile in US really read that.

5. You will need a co-sponsor for the affidavit of support since you will be out the country do you have one? here is the guideline look at hoe many will be in the household of the person sponsoring you.

You can stay 3 months with VWP unless you want to get a visitor Visa, which I have no clue how long those take to process. You can only DCF if you become a LPR of Belgium for 6+ months, but since you've already filed that wouldn't matter unless you withdraw the petition and start over. If you rather live in Belgium for a while you'll need to have an apostilled copy for Belgium of your wedding certif with you. These are pretty cheap to get and don't take too long. Once you're there you'd file it with the city hall of whatever city you'll be living in and apply for LPR. Depending on how much your hubby makes you may or may not need a co-sponsor. They'll give you a temp ID until full residency is approved which takes about 6 months. The resident card is good for 5 years. If I remember correctly it cost about 50 euros for the whole process for us. Not sure if that's changed, but it isn't too bad.

No one can DCF in Belgium regardless of how long and on what status they live there because that option is only available if a USCIS field office is located in the country and Belgium does not have a USCIS field office (see my previous post which I quoted above).

We filed DCF, was that changed in the last two years? Says it still allows it on the info page here.

Yes, it was changed in August 2011. The link you provide is a VJ page that needs to be updated; below is a link from the US Embassy in Brussels that clearly states where an I-130 petition must be filed.

Yes, it was changed in August 2011. The link you provide is a VJ page that needs to be updated; below is a link from the US Embassy in Brussels that clearly states where an I-130 petition must be filed.

Hi Mithmeoi... nice to see you. I am going to Belgium. I got a email from the Belgium consulate telling me what I need to do to go there. The shame is that I have to give up everything here. All I have worked to establish here.. for us to be a family. All these years. I am glad to see that your in the last stretch of your journey. That makes me truly happy since we started here years ago about the same time. I am glad to still be in contact with you after all you have seem me go through. Big hugs to you two.. I am so glad there is a happy story! smile.
