    The OP stated that in his original post.
    Section 319(a) applies to individuals who have been lawful permanent residents for three years as the current spouse of a U.S. citizen, and continue to be married that U.S. citizen spouse.
    Section 316(a) applies to spouses who have been lawful permanent residents for five years.
    OP: Make an infopass appointment, if the letter you got says it was denied because you are ineligible to apply under 319(a) then there has been a mistake. Hopefully on their part! Best of luck!!

    Seriously, if this is a major struggle for you, you probably should rethink the whole marriage and immigration thing. It only gets harder from here.

    I think any time you marry someone you don't really know, there's a high potential for problems.
    The system as it is now isn't conducive to getting to know a person, or to really spending time with them. You meet someone (often online, these days) and think you're in love. Of course, you can only know part of a person online, the part they want you to see. Then you get caught up in the romance of it all. It's a perfect love story - you're destined to be together, but the bad guys (the government) are in the way. You have to overcome it all to be together! The problem is that you're so caught up in the romance of it, you don't stop to actually look truthfully at your "relationship" for all its flaws. When the fight is over, so's the romance, so's the fantasy, and reality can be very disappointing.
    Well, that's the way I see it, anyway...

    But If you think this is an international marriage problem only, then you are mistaken.

    I understand that it's frustrating. But you can't blame this on USCIS. I volunteered full time when I got here, before I even applied for AOS I had a full time 'job', I just didn't get paid. Get off your butt and start living your life, you'll feel a lot better for it.

    Starbucks offers good wages for there entry level employees and can actually grow into some good money if you get into management.
    The benefits are pretty good as well.

    The police certificate you get from here http://www.acro.police.uk/police_certificates.aspx it is £45 for standard (10 working days, not including dates of receipt or dispatch) or £80 for 2 working days, also not including dates of receipt or dispatch. Mine arrived back in 10 days from posting it using the standard service.

    Yep, a person has to be born on US soil. McCain was born on a US military installation which is considered (although open to debate) as US soil. Even my daughter who was born in a German hospital to two US parents cannot ever become president because she was not born on US soil.

    My man will earn lots more of my respect when he attempts anything, including delivering pizzas, so he won't have a big gap in his resume rather than finding excuses why he can't find jobs.
    Even when he applies for another professional job later on, he still can proudly tell the interviewer "I'd rather do something to bring the extra cash to help my family with gas money, as long as the work is honest and hard work. That's what America is about."

    I think the obvious thing, at least to me, is that there are some jobs, but OPs Husband feels that they are beneath him. The biggest thing that needs to happen is a reset and for him to understand the impact that it's having on the family. I work on a team here in California where at least 5 members are from out of state (New York, Oklahoma and Florida) and they travel home every weekend. Sometimes you gotta do what you gotta do.
    PS: With a New Zealand accent I would have thought he woudl make a killing bar-tending.

    I am no expert on the matter, just a guy who did a lot of reading on the matter. It seems to me like you would be better served with marrying her in her country, and then applying for the marriage visa. The reason I say this is because my understanding is that a marriage visa can be used more than once to enter the US, whereas a fiancee visa is a one time entry visa, so if you went with the fiancee visa you'd need an Advanced Parole to reenter (apparently those take 3 months to be in hand) or a Green Card (which apparently takes 6 months to be in hand) after marriage to reenter the US.
    Again... Not an expert. Just a guy who knows how to use Google
