Candy/SadanNasir reacted to Kathryn41 in Possible visa fraud... what now?
    Mustafa,
Simply put, you are wrong. It is perfectly legal to enter the US with a B-2 visa (tourist/visitor), get married - whether you have declared that intention or not at the time of entry - and return home at the end of the visa. You have NOT violated the terms of the visa. You have not committed visa fraud. You will not have difficulties during the later immigration interview.
The correct information has been stated over and over and over and your refusal to see it does not change the truth. It is perfectly legal to enter the US with a B-2 visa, get married and leave the country in order to start the proper immigration process with a spousal sponsorship and spousal visa to immigrate to the US.

As this thread has become a stand-off between the correct information and someone who refuses to recognize they are wrong, I am now closing this thread to further discussion so as not to confuse other VJ members who are in this same situation.

Geez, Mustafa, you keep stretching this with hypothetical scenarios that introduce fraud into the process, and then make the HUGE jump to the conclusion that marrying with a B2 visa is illegal. By using your logic, I could claim that it's illegal to drive a car in San Francisco because if you intentionally run over a pedestrian then you might go to jail.
Many people have used B2 visas to come to the US and get married. Many were completely honest with the consular officer, and even showed them the wedding invitations and other documents related to the wedding. They got their visas, came to the US and got married, and left before their visas expired. No laws were broken. Getting married in the US while on a B2 visa is NOT illegal.
Where people run into problems is if they stay in the US after the wedding and apply for a green card. It's not legal to use a non-immigrant visa like a B2 if you have the intention of immigrating. Your intention when you enter the US determines whether applying for the green card is illegal. The marriage itself is NOT illegal, but it does make you eligible to apply for a green card while you're still in the US, which MAY be illegal, depending on your INTENTIONS. It is because of the possibility that the marriage may lead to a fraudulent green card application that CO's in many countries will refuse to issue a B2 to someone if they state they are going to get married, and NOT because it's illegal to get married with a B2 visa. If you can convince the CO that you'll leave the US after the wedding and before your I-94 expires, then they'll give you a B2 visa so that you can come to the US and get married.

Evidently, there is a significant language barrier preventing effective communication here. The OP....IS, IS, IS.... and MUST, MUST, MUST file an I-130 petition for their foreign spouse as there's no other available path to immigration based on the marriage. Getting married was legal. Staying afterwards is what would have been illegal. For some reason, this distinction is flying high over your head.
It should be noted that most of the world's people would be wasting their time applying for a tourist visa to the USA but those who have one, are free to enter the USA and marry. Staying afterwards is a separate issue.

I agree, sadness, stress and loneliness can compound feelings of being devalued and foster negative projection of fears. Do confirm your suspicions by speaking with him. I hope your fears are unwarranted; if they're aren't I wish you luck and strength. I'm so sorry you're feeling sad.

Not really. It's all about Brian. Brian is not Jesus.
Brian: I'm not the Messiah! Will you please listen? I am not the Messiah, do you understand? Honestly!
Girl: Only the true Messiah denies His divinity.
Brian: What? Well, what sort of chance does that give me? All right! I am the Messiah!
Followers: He is! He is the Messiah!
    Brian: Now, fuckoff!
    [silence]
Arthur: How shall we fuckoff, O Lord?

Typical. Belgium have not 'banned the burka' they have prohibited the wearing of any clothing, mask or covering that covers the face entirely, or almost entirely, in public places for what they term security reason. People who want to cover their faces entirely must do so in private. That does not stop them from being able to wear perfectly modest clothing in public, including wearing a covering over the hair if so desired. Personally, I do not see it as being a big deal. Of course some people just want to be able to have the opportunity to do absolutely everything, even if it's pointless just so they can say 'personal choice'

And it's still not your call to make. Say you'd actually get to ban the burka. You would then have stripped those women that choose to wear them of their freedom to do so and those that are forced to wear them wouldn't suddenly pop up on the streets in regular clothing either. Chances are they'd then be forced to remain in their home. So you'd inadvertently strip them of the freedom to move about. And the burka in their heads is still there all the same. What an accomplishment.

Takes a lot of assumptions for that to be clear. Last time I checked the Bill of Rights, freedom of religion and expression was still a part of it. Why do people with a different belief and value system have to conform to yours? Where in the Bill of Rights do you have the right to dictate to others what they can and cannot believe?

And you're most certainly free to wish that. But that doesn't exactly have any bearing on their right to live where they live. You know, some folks are annoyed by the smell of garlic and curry that some folks carry with them. Just sayin'...

So people have strong belief systems. Belief systems that differ from our mainstream. And that's why they can't be tolerated? The first amendment of the Constitution be damned? Are we really that weak that we can't have a small fraction of the population follow their - from our point of view - odd belief system? Are the Amish threatening to us? Surely, they don't assimilate - never have and a lot of them very likely never will. Kick them out too because we just can't stand them little buggies they ride around in or that ridiculous attire they wear?

Is it a choice they make or are we making that choice for them by excluding them because of their religion?

I don't know. My wife likes to dress in her native attire from time to time simply because it's part of her identity. Certainly, when she attends church she'll wear Ethiopian dresses. That doesn't mean, though, that she's resisting assimilation. Either people are free to express themselves or they're not. Are we prepared to deny people the right to choose what they wear?

There was a very interesting commentary in the German media today regarding this issue making a very basic and very valid point: The issue is the burka in rather than the one on the head. Banning the burka addresses merely the symptom rather than the underlying cause. What's the most likely result? Surely it won't be the desired liberation of women but their incarceration in their homes.

You are speculating. You actually "know" nothing; you are assuming. If this person is indeed trying to enter into a fraudulent marriage, you'll need proof, which could be as little as an utterance from her. Until then you should observe, perhaps inquire, but not interfere . . .

Have you ever been to rural towns in East Texas where people still speak German.. Or how about them funny Amish people who speak Pennsylvania Dutch and dress funny. Or what about those people in Louisiana that speak Cajun French. Do you have problem with all those people too because they did not assimilate into the mainstream Anglo-Saxon American culture??? My piece of advise to you is to stop being so judgmental and understand that not everyone is going to assimilate. Some people will cling on to their roots and heritage and that is their RIGHT as an American.

If not, are they merely shy, introverted types; cold, rude individuals; or frozen with fear that they'll try to say something and sound stupid or ignorant? From the regular sandbox, or the cat's box, si man?

I love those ethnic stores and go inside to check it out all the time and discover a lot of little delicacies and treats from around the world. There was a huge Ukrainian immigrant population near where I grew up (most of them spoke none to little English)and I used to wander into their shops and discovered their delicious tortes. I also made friends with them and they showed me kindness and an understanding of a culture that I would probably never come across if chose to be upset that they were not trying to assimilate. Right now, there is a Filipino, Jordanian, Mexican & Colombian shops around my neighborhood and I'd rather go there than to Walmart!

So I am left wondering where all the chest-beating-mouth-breathing-illegal-screaming peeps are here who talk up a good game, yet when are presented with someone who has been living here illegally for more than a decade - not a peep is made. Me thinks there is just a lot of empty hateful rhetoric spewing pu$$ies round these parts.
