    That is not the point, Gary. The point is the "accuracy rating" was referred to (by a Global Mod) as if it is some sort of statistic we can lay our hands on.
    Since there is no such statistic,(and I'm not a moderator so I can say so) the comment IMO looks like some sort of officialdom pronouncement as to the credentials of a member.
    Frankly, since there was no real reason to circle wagons around this member in the first place, it really just looks like unwarranted favoritism.

    It is a stupid, probably unnecessary response. If Pushbrk said soemthing against TOS, then pull the post and penalize Pushbrk. Otherwise nothing needs to be said by a moderator. It is not a moderator issue and there is no requirment that Pushbrks (or mine, or your) answers meet the "courtesy code" of every VJ member.
    In my opinion, and i am not a moderator so I can say so, I would give Pushbrk a much higher than 95% accuracy rating. He has made some 15000 posts. You think you can find 750 of them where he is wrong?

    What troubles me (besides the pulled-out-of-his-poophole-95%-figure) is that the post was a moderating action *AND* personal opinion in the same post. Makes it seem like an "official" endorsement of the advice being handed out by a particular member.
    And quite frankly, if pushbrk gets a pass in that thread for being rude, then why doesn't everyone else get a pass? If pushbrk's special form of nastiness is to be tolerated, then certainly calling him out as a "rodeo clown" should also be acceptable.

    Actually, I did too. I was so scared, at first, of being lambasted for asking a stupid question that I did take the time and trouble to read the guides. I joined a bit later than you, probably a short time before you took a break from the BS. I don't think it's a failing at all to want people to use the board in its entirety and to its potential. The guides, FAQs, timelines and such are such a valuable source of information and new users should definitely be guided there. I totally agree with all your points about reading and then asking questions.
    My annoyance is not with those who are experienced and generally constructive about pointing people in the right direction. My pet peeve is with those personalities who take on an expert, negative and impatient tone with anyone below them in the immigration food chain and also get defensive with those who may well be qualified to correct them on the quality of their information.
    As a point of interest, whenever I've had a complicated question to ask it has usually been better served on some of the other immigration boards, which tend to be less judgemental and where many of the good people from VJ took a break from the BS.

    I concur. I also think of your use of "supposedly" as suspicious.
    It is ENTIRELY possible but given you arrived ALREADY married then the risk of denial and a lifetime ban is far too great. You are more than welcome to try but I would be remiss not to warn you about the very serious risks if you are denied (it's not guaranteed you'll be denied but IF you are... very bad).

    I agree with you about not leaving the US as overstay will be forgiven upon approval of AOS.
    I don't understand why you associate AOS to CR-1 Visa though. CR-1 is an Immigrant Vias and upon use the beneficiary is issued a 2 year conditional greencard so their next process is ROC (Removal of Conditions) 21 months later.

    Dont go back to your country, as long as you already submit your applications to USCIS no need to worry, Like my K1-visa will expire tommorow and my 90 days already expired last january, We just sent our AOS package last saturday and I dont hear from USCIS yet. I think no reason to be worried.

    Good point about speaking/writing English. That is really the only way it would make sense to me. Whatever works for the couple though!

    That information is OLD. About a year ago they rewrote the rules about authorization for work and the K1 and stamp does not qualify. You need an EAD document if you enter on a K1. However one on a K1 cost $340 and take 60 days so at most you get 30 days work for $340. Not worth it. If working is an issue marry quickly and file AOS as the EAD is free then. As far as telling about the filing NEVER lie to an immigration official. They may already know from their computers and lying can cause you trouble for misrespresentation

    To the OP:
    I don't really anything to add other than the fact that you have gotten good advice here. You have to decide whether the risk is worth it to you or not, and in your case, there is definitely a risk.
    Just because you want something to be a certain way doesn't make it so. Just because someone doesn't give you the answer you want to hear doesn't mean they are wrong, or accusing you of anything.

    And you're getting good advice.
    Think about it, if it looks suspicious here how do you think USCIS employees will view it.
    There are laws to prevent someone from entering on a Non-Immigrant Visa and adjusting to immigrant. The requirements for said visas are different.
    It isn't uncommon for Alien Spouses of US Citizens to be denied Visitor's Visas or even turned back at the Port of Entry because of suspicion of immigrant intent.
    If you are 100% confident that you can convince a complete stranger that your intent upon entry was to return to Hong Kong then go ahead and file for Adjustment. Just be aware that there is no room of Appeal if denied you may be hit with a charge of misrepresentation which would result in a lifetime entry ban.
    Personally I wouldn't risk it even if I had a 90% chance of success because that 10% chance is too much of a risk when it comes to being with my wife.

    Yes but your spouse's quarters of work also count towards the immigrants 40 quarters. AND if you AND you spouse work it is counted as double time. So if I work 8 quarters while my husband does, that's 16 quarters. Here's a link: http://www.dshs.wa.gov/manuals/eaz/sections/CitizenRestricFSP.shtml so yes it can be more but it can also be less. It tends to be less though.
    I also notice the OP said that remarriage means her I-864 is cancelled so I thought I should directly answer that.. no it doesn't. If he, or you, remarry, you are still responsible for the I-864 until any of the conditions previously mentioned by "3600rs" (post 6) are achieved.
    PLEASE NOTE that divorce cancels out the sharing of work quarters as mentioned in the link I posted. Please read the link to save confusion as to my meaning. When I say spouse, I mean spouse, not FORMER spouse.

    That's what I meant when I said submitted. It was meant to mean "accepted". I'm sorry you were confused.
    Also what was posted in the link I gave. I am well aware divorce cancels it out but I didn't have time to cut and paste EVERYTHING in the link. I was directly replying to someone elses post on it and not the OP's. If you see the quote i replied to, they said that 40 quarters tends to be 10 years or MORE, I provided proof of it being able to be less. Had i not posted the link to further explain my point I would understand your objection, but given I posted the link, and people have the ability to select that link and read the info themselves, I didn't feel I needed to spoon-feed every single piece of information on there. I was making a point that required further reading. Again, sorry you were confused.

    This is ideal. There have been a few posts (and a couple today) where a religious ceremony has been done and yet the marriage not registered so the K1 is still available. Then when arriving in the US you will need to legally marry your fiance.
    If you family wants it to be LEGAL in June/July then you may as well cancel the K1 petition and send in the CR-1 process but you can only do this AFTER you're married so this will mean your new wife will start from the start again, and have a wait time of around 8 months-ish from after your wedding.
    if you DON'T legally marry her then you should be able to be together in the US around 4 months after marriage. I would do a religious and non-legal ceremony in June/July and a legal one in the US when she arrives, personally.

    It is my understanding that you would be denied. She was told not to enter again for five years, and she did. She broke the law, even a waiver would not cover this, even if you married her. She probably is going to get a life ban for doing this. My advice is to go back to her home country if you can and try living there.

    Oh, si man -- TOS violations, baiting, & personal attacks are definitely report-worthy, & I've reported some myself. It's the "that advice is so straightforward that it hurts my (or someone else's) widdle feelings" that I object to, si man.Point: Despite pushbrk's reputation (deserved or not) for harshness, has anyone noticed the changed tone as of the new year? Take a look for a while, starting with existing posts & continuing with new ones.
    Point: The most toxic VJ member that I can think of during my time here, RebeccaJo, is no longer. Thanks be for that, si man.
