    I guess asking a question means it is ignored like the advise you have already been given. You have so far ignored the rules for filing a petition, ignored the requirements for a petitionable relationship, ignored what we have offered, ignored the question I presented in response to you request for a question about facts. You can ignore us all you want. But ignoring the rules and requirements is just causing you to throw your money out the door. I hope the fantasy togetherness is good enough for you ,because your refusal to work in the rule and regulations is going to make it so that phone sex is all you are ever going to have. Personally I think we have all wasted too much time trying to show an extremely reality challenged person where the issues are. When you really want to know come and back, until then enjoy your pretend sleeping together , it is all you are elgible for.

    You still travel as a citizen of your home country. That being said many embassies look at who else as given you visas in making their decision. Having a visa/greencard from the US is frequently worth tons of bonus points in the decision process. You have to apply but you are probably going to get more positive responses.

    I am not hijacking the thread and if you really want to know what to prepare for my best guess would be a letter of denial before the petition ever gets out of the country. If not then certainly it will never pass the interview stage, because of the fact your don't have a positionable relationship as far as USCIS rules are concerned. The only way I would think it is salvageable would be to get the marriage consummated any way possible before the interview. You may not be able to travel but the instructions for filing the I130 are pretty clear and you fall into the WHO MAY NOT USE THIS form category. Your are looking for advise on non existing photos when you should be more worried about creating a relationship that will allow you to file the petition in the first place. At the moment you would have better luck filing a fiance visa and requesting a wavier of the 2 year meeting requirement. Ignoring the filing rules is never a wise thing. It is hard enough to get a visa from your consulate following the rules. Your proxy marriage isn't valid for filing purposes until it has been consummated. So the proof you need to come up with is that the two of you have done just that. Without that your chance of getting a visa are about 0

    The issue is your husband practiced bigamy. This is in violation of US law. If he did so while he still had a green card he may be in a bit of trouble for that. What the cleanest , but rather expensive thing to do would have you file a divorce nunc pro tunc where the judge backdated the divorce. You have to convince the judge you were under the belief that you should have been divorced at some prior point in time. That would validate his current marriage, which could then be cleanly terminated , allowing him to re unite with you.

    Is there an overstay issue from coming over when you married ? If you overstayed while waiting on your AOS and it was not forgiven then you may not be eligible for a visa waiver entry anymore. You may only be able to travel on a visitors visa.

    There are a lot of technical people that have 30k and a friend in the US. If it were easy to get the visa, half of Nigeria and India would already be here with "tech start up companies" That is why they impose all the additional conditions.

    Nigeria tends to pick couples that they have doubts of and will go to the area where the Nigerian person lives and ask around about the relationship status of the person. They conduct this type of query both before and after the interview. It really depends on when they have staff in the area. It happen most frequently with couples with a number of red flags where the person lives near Lagos or Abuja

    6 months basically. You have to file and then wait 6 months. Yo can get a pack of papers from the courts and do it yourself. The pack costs you about $15 . You can probably download all the forms also.

    My case was rather exceptional. The CO demanded that Joseph prove our relationship by providing "details" of what I do at work. He couldn't, she denied the visa and I filed an attempt of espionage report through my employer.

    Record in Nigeria are terrible. Are the 2 places close ? Just be prepared to be asked about it. I know place names change over the years ,even here in the US. It shouldn't be a big deal.

    If you have lost your booklet it is available online at Welcome to America Read pages 17 and 18 for the things you are not supposed to do. Voting in federal elections is clearly listed. Oboma fever is probably the worse excuse for forgetting the rules of permanent residence.

    correct, that's what the visa bulletin is for. you have a waiting line and when the priority date becomes current, that means there is a visa available for everyone with those dates. between NVC contacting your uncle, the filing and completing the paperwork, sending the file to their country and then having the interview takes time.

    After dealing with the USCIS useless line calling NVC is a joy. Just call and have your case number handy. They will tell you if the petition has been sent and if you are nice to them they can look into the system and tell you if an interview date has been granted. It really helped us because Joseph has trouble with the ON/OFF concept of computer operation ( we now have a pile of Dummy's books )

    There are two issues here. One is that she arrived on a K1 visa and she can not adjust status with anyone other than you. She would have to leave the country and start out all over again. The second is custody/visitation of a child. If she has taken the child and you don't know where the child is you call the police to report a parental kidnapping. If you know her address you go to the local court and file for an emergency child protective order. If you feel she used you for a green card then report her to ICE

    It may not be seen as fraud but the best thing would be to document that the ticket is a loan and not a "gift" . If you give them the ticket then you may be seeing as paying for your sisters way to the US. write up a promissory note and make some small payment plan and you can present that if something happens and if it is questioned.
