Being here illegally is ILLEGAL. I'm not sure why people think its not. 10 years, 20 years or 2 years...if you entered illegally, that is deportable. Read the immigrating laws. Its very plain.
The new administration is vowing to prosecute anyone who enters illegally. I would not doubt the fact that the DOJ is now following the laws already on the books, that there will many more deportations. They aren't playing anymore. It has nothing to do with nice or mean people...it has to do with the rule of law and respecting the laws in the United States.
The sooner your husband leaves, the sooner you'll know if he will be granted a visa. Its not up to Mexico, its up to the Dept of State at the U.S. embassy in Mexico.
BTW, I recently knew a guy from Costa Rica who was here 20 years..had to go back to Costa Rica and finish the process... He waited 15 months..and he wasn't deported. That's just how long it takes. Consider all the backlog in Mexico...you need to plan for a long stay. Its a definite possibility.

You don't need to pay for an expedite. Mine was completely free and informal. My lawyer old me it was a waste of time so I did it myself.
My reason : that my employment was ending I wanted my husband here to help pay the bills. That's it.
We filed I601 waiver end of Aug. Expedite approved mid Oct. Husband entered U.S. January 18th.

If he's out of the US, the waiver gets filed after a refusal. The waivers being sent before the interview are the 601a waivers they file while still in the U.S..
Your lawyer is correct. You'll need the denial paper from the interview to include with the waiver. Looks like You'll need the I601 and I21

The excuse they use is further security checks...our I130 took 11 months. The last5 months they gave us the additional security check excuse. I had the senators office checking once a week the last 6 weeks.
The state dept only took 30 days because I followed the guide on this site. The waiver only took 4 months..I got sick of these people and asked for an expedite. It was approved. So it went fast from there..
I was told that all processing has been slowed down recently since the new administration took over. My friend now works in the state dept processing passports .
Nobody knows when it will pick up ...

I'd say the administration has slowed processing down on everything. I read something online about it. Sorry I can't Remember where.. Just the other day actually. Depending on what the DACA deal turns out to be and the chain migration decision.
I think I read it on www.dmldaily.com ..you'll have to search through the articles.

That's just saying they want you to stop contacting them. Been there...done that.
They literally do not care how much your want to see your husband. Just chill and wait for the answer. It could be tomorrow and it could be a year from now. I'm sure our president has put in place some very strict vetting procedures.

The waiver approval doesn't guarantee a visa. The embassy has the final decision.

You have to wait for the RFE...otherwise it's almost guaranteed it will be lost...plus, what if the RFE has more requests ? Then you will be sending more information.
The additional information you want to send now has nothing to get paired up with. Its not like they go looking for your waiver package and file it together with new information they receive before it's with an officer. They receive SOOOOOOO many packages everyday.

Did the brother file papers for him after the adoption? You don't automatically become legal...he would have had to follow the correct procedure.

We did not have another interview. They just called him to pick up his passport. He did have to get a new medical exam though...
Costa Rica is really easy...they will tell you if they need another interview.

We filed the waiver Aug 28, 2014...requested an expedite in mid Oct. Expedite was approved Oct 20th. His waiver was approved Dec 17th. The holiday kind of interfered so he didn't enter til January 17th, 2015. I'm reading now that it's taking18 months...
We used a lawyer. His only offense was a tourist visa overstay. No other crimes. He had a 10 year ban.

My waiver package was about 3 inches thick...done By an attorney...it's way more than just filling out forms...and I had at least 3 serious issues...And many secondary issues.
My suggestion is to get a lawyer who's experienced in waivers...the last thing you want is a delay because your package isn't complete

If they say 9 months..I would assume longer. .back in 2013 my i130 took 11 months when they said 5 months...just be ready...the back ground checks and vetting is no joke these days

I never received notice that my expedite was approved. You should call the uscis Ana ask to speak to tier 2.
Just note..our expedite was approved Oct 2014 and it went fast after that but he didn't get his visa until January 2015.
Expedite doesnt mean he enters as soon as the Expedite is approved..it just Expedites the waiver adjudication. It still needs to goto the consulate. And he will still have to comply with their requests..if any.

I had a 601 waiver expedited. Look back on this site to late 2014. My husband ( soon to be divorced) entered the U.S.January 2015.
My reason for expedite was my unemployment was ending. I needed him here to help pay the bills. My lawyer told me it would never get approved...we filed they waiver late August 2014 and the expedite was approved October 2014 ( if my memory serves me) it's in my timeline I believe.

Well, usually you should contact the consulate yearly to let them know you are still perusing the waiver option. A simple phone call to the USCIS will let you know if the I130 is still active. Why would you wait for them to answer an online form?????? They probably won't answer specific case questions anyway. Just by entering the case number on the automated system should give you the active or inactive answer.
Waivers are not just filling out a form. There's also a fee. The consulate would have given you a paper during the interview letting you know which waiver your husband is eligible for. It sounds like you're guessing. Was your husband removed? He might need 2 Waivers. I 212 and I 601.
That's why you need to speak to a tier 2 person at the USCIS or someone at the consulate.
If the I130 is not active, they might require you to start over.

And honestly...she visited him twice...that's expensive...so she's not doing that bad.
I know plenty about raising kids alone.. And even now nothing is easy.. However I never collected welfare or foods stamps. I was offering a suggestion. It's sad to see people waiting for foreign spouses when the immigration process is so long. I watched so many scammers use citizens for green cards..even having kids with them. They get what they want and roll after they have the green card in hand.. My friend waited for her Mexican husband..she thought he was being faithful in Mexico while they waited for the waiver...pft. He was living a whole other life. He had a girlfriend and even a new baby..my friend had no idea . when he got here...he took off and she hasn't seen him since. Stuck being the sponsor on the affidavit of support.
I felt so bad for her...I never thought it would happen to me. Another friend got scammed by her Dominican husband. Another friend scammed by a Costa Rican. All recent. That's why I suggested the OP should take care of everything here. Do what needs to be done. Don't stop her life while waiting.. Time passes too fast..what if his waiver doesn't get approved or it takes another year ? Not that I personally care..

I actually heard that things have slowed down a lot at the service centers. Per my friend who works at the state dept in D.C.. There is a hiring freeze at the state dept. She said secretary Tillerson doesn't plan on lifting it any Time soon.
When people post on a public forum, they should expect different views.
I learned that the process is long and no matter how much you cry...it is what it is..
I also learned not to trust ANYONE.

I will even go as far as to say YOU have no idea about immigration...do you Even know why you were asked to file a 601 other than the fact that he's in Mexico now?
If you already have an approved 601A. Then having to file another waiver is suspect. Has your husband called the USCIS? Have you contacted your congressman? Senator? Did you make an info pass appointment? If you think you have a reason to expedite, why wouldn't you just request one? My expedite didn't pull my file from the process. They went in the computer and approved the expedite. My waiver was approved with a fax request from me.
Please don't accuse me of not knowing the process...I know it too well. 😂😂😂

By the way...my expedite was approved in 3 days...my reason...well...my unemployment benefits were ending and I needed my husband here to help pay bills...(i was laid off) you should have read my threads..my lawyer told me it would never get approved so I filed for an expedite myself. I waited 3 long years for him...it wasn't worth it. If I could turn back the clock. .I would never EVER have put my kids through that. They deserved better.
I never told you to give up. I told you what happened to my neighbor. Immigration is unpredictable. You could be waiting years. Especially with our awesome New president in office.
My point is to suggest to you to worry about what is TODAY..not what is unknown. You claim you have class...well.then don't come off as a victim. All I hear is excuses on why you can't do this or that... He's not here...worry About today...complaining about your bills and then not doing anything about it because you are waiting for his approval is just silly . I lived through it. I know.. I have many many bills..I have 3 kids. There are subsidized daycare programs and church programs that Will help you. The help is there.
To me...classy is taking care of your children.
Have a plan B. Nothing is fool proof.
I'm not trying to be mean. If someone told me to stop being stupid back then..I wouldn't have wasted 6 years with my ex. I've been on VJ a long time..

Expedites are usually for dire situations...not situations of everyday life..Bills are a reality for everyone.
Honestly..you should probably learn to be self reliant. I wouldn't count on a quick approval...drugs are serious and Jeff Sessions is weeding out the bad hombres. No joke.
Its a privilege to come here..not a right...and if you can't follow the laws..they Will definitely weed you out.
Everybody has money issues. My neighbors wife moved on because her husband was never getting approved. Even after an approved 601A.. And he never mentioned drugs.. They just said no. Have a nice day.
My opinion is that they approved his waiver so he would leave the U.S... so they could Deny his visa.
I heard rumors that he is trying to come back illegally but I haven't seen him...

As I remember, you can't file the I601 until you goto the interview and they give you permission to file it. You need the instruction sheet from them. Its very difficult to get an expedited waiver. Your long wait isn't a reason to expedite. I suspect the Trump admin is finally taking a long look at all applicants. They are not obligated to hurry, especially with that caravan coming. I would even bet the timelines will get even longer. When DACA first started, it slowed everything down because the USCIS made those the priority.
If you file another I130, it will just get flagged because there's already one in process. That's a waste.
