    US custody law is based on the principle of stability in the child's life. courts rarely order that their lives be turned upside down to accomodate the changes their parents decide to make in their own lives. phils law is prolly similar, or should be, from a psycho/socio perspective. these kids should stay in familiar surroundings and with the majority of their family, in their current schools, and remain with whichever parent is willing to make that happen.
    when i divorced my first wife i "made it happen" and was awarded custody of 3 grade school aged children. the courts found their mother, who effectively abandoned them by moving 30 miles away, to be unfit for custody on this and other basis.
    so you fled responsibility in phils, overstayed illegally, and have now found a sucker to legalise you and want to regain your dignity by reclaiming the children you willingly abandoned? for their sake, i wish you poor fortune. their interests weren't important to you two years ago. it was all about you. things seem not to have changed.

    1.) Americans have kept up with the times as well as any other nation. in America a high score in math or science is not bought from an instructor in yuan, or acheived by a "shooter" (in china, a shooter is a person who takes tests for college students, entering the examinations with the consent of a bribed proctor. this is common practice).
    2.) blaming immigration is valid, as long as US companies hire indians on H1b to do tech support in USA because they are cheaper than an American graduate with the same skills (salary differential is 20-30%, headhunter shops fees included, no benefits package included, and you can cancel their contract easier than firing a USA employee). blaming immigration for the shortage of all kinds of jobs stateside is not xenophobia (xenophobia is an unreasonable fear of different types of people, what you are seeing now is a reasonable reaction to unfair competition).
    America does not need people to fill it's vast empty spaces. they are fine just the way they are. you must be chinese to think that unfilled space is a bad thing. American export is not shrinking, it is expanding, and it is not affected by second world countries "improving their internal manufacturing production". second world countries are increasing the environmentally destructive manufacturing processes without improving them (look at the environmental wasteland that china has become. the fish refuse to live in the rivers there, and the trees refuse to grow. it is a dead place even compared to what it was 20 years ago). germany, china, and USA are all in the same ballpark in terms of international currency valuation of exports, and neither germany nor the USA is doing it with factories financed by state mandated business loans made to state owned enterprises without expectation of repayment (non-performing loans, in which china is the world leader).
    as for china's attempt to stimulate it's internal consumption, well, that is stifled by recognition of the instability of chinese politics, the starvation wages imposed upon the vast majority of chinese people, and the sheer greed of the remainder. most people in china save the majority of their money because there is no health insurance or retirement or disability insurance, much less unemployment insurance. most urban skilled labourers (machinist or electronics assembler, for example) make about $250 USD per month, and cannot afford the ipod they are putting together after paying $20 per month for a walk up unheated masonry tennement, a dollar a day for cheap streetside food, sending 20% of their salary home to parents who are struggling on the unmechanised and unelectrified farm, and spending the balance on new skinny jeans with glitter on them. and by the time the ipod hits the streetside dealer it is marked up to 150% of what it costs in USA anyway, due to the greed of the vendor chain.
    and i'm not even gonna mention the fact that 80% of chinese are living hand to mouth on the hand cultivated farms with an average salary of $150USD per year from profit on agricultural goods taken from the soil by the sweat of their backs.
    no thanks. the rest of the world got nothing to show us, and can stay the way it is. falsified economies like china's will fail soon enough, and we don't need their teeming masses creating any more drain on our society. i've lived there and seen it close up, and i like it better in America, just the way it is.

    some of us understand that marriage is viewed differently in foreign countries, and that the last thing an imported spouse wants to do is go back to their home country with empty hands. after all, their family is expecting big cash out of the deal, and an easy lifestyle on the back of the immigrant and his spouse. too bad Americans do not see marriage in this light.
    maybe this guy should have gotten to know his wife before he married her, and maybe he should have done some research on the difference between American women and middle eastern muslim women. maybe he should have thought things through before reachign for the brass ring. too bad, but his own failure to examine these questions is his responsibility, and he must play the game with the cards he is dealt, or he must fold the hand and back away from the table.

    there is a presumption that this woman entered on basis of the marriage and intent to pursue it, despite the fact that it is a 10 year card.
    the fellow in question should send the card back to the issuing agency with a cover letter indicating that the marriage did exist legally, but was not cohabitive, and that she does not live with him and has not since (whatever date). he should indicate that he was not involved in the process of obtaining the card (how could this be? he needs to provide sponsorship documents for her to get the visa). he should report that he was not told of her intent to immigrate, nor has she contacted him since her arrival, preferring to live at a different address. USCIS will sort this one out, and possibly determine that she entered fraudulently, especially if he did not provide the docs as required in the following guide:

    if she falsified one step of the process it is fraud, plain and simple.
    if your buddy did provide the docs, he has less ground to stand on. this process is lengthy and full of opportunity for him to shut it down. if he failed to do so and still wants her out of here he should see a very good immigration attourney. this being an indian case, i would suggest he take the issue to rajiv's forum, immigrate2us.net

    suggested hardball game plan:
    1.) keep the kid in bulgaria by any possible means to keep her there.
    2.) allow time to lapse since her last entry into US. 18 months at minimum, so the green card dies.
    3.) tell her you want to take the kid to USA to see your family and that you will file paperwork for her as soon as you arrive.
    4.) file divorce in abstentia from USA location.
    5.) forget about her.

    to clarify, there is no good ending for this case.
    marrying in USA will result in an unadjustable status. still illegal and deportable.
    marrying in USA and returning to home country for CR1 will trigger a 10 year ban on departure that may be waiverable, but is generally not. see an immigration atty on this.
    leaving and attempting K1 will result in 10 year ban and likely K1 denial, even with waiver attempt.
    leaving, marrying in home country, and trying CR1, same result.
    don't hang any hope on "immigration reform" it ain't gonna happen in any form that will help you.

    intent to immigrate is sometimes inferred on AOS attempt if the girl had no ties to russia when she left. (it would be good if she had an open job, apartment, or other assets in russia when she came here)
    it is sometimes inferred if she married within 30-60 days of entry. (it is better to wait 90 days+)
    it is sometimes inferred if she had an introduction by a friend or family member that had status in USA to another friend or family member with status in USA (this one is against you).
    it is sometimes inferred if she would have no legitimate attraction to the USC she is adjusting on (significant age, educational, economic, or other background issues)
    it is soemtimes inferred if the partners have little kowledge of each other, including family, etc.
    it is sometimes inferred if there is little evidence of comingling of assets to demonstrate by interview time (quicky marriages leave time for little more than a shared bank account, and perhaps medical insurance)
    it is sometimes inferred if there is no evidence of cohabitation.
    it is sometimes inferred if there is no evidence of a formal wedding ceremony.
    it is soemtimes inferred if there is a history of past marriages or K1 applications involving foreigners that involved immigration interest.

    On March 20th, something truly extraordinary happened. On the eve of the health care vote, a group of black Democrat Congressmen (eschewing the private tunnels they usually use to cross from their offices to the Capitol) chose to walk en masse through a crowd of protesters, confident that the knuckledragging Tea Party goons they and their media pals have reviled for a year now would respond with racial epithets.
    And then, when the crowd didn't, the black Congressmen made it up anyway. Representative Andre Carson (Democrat, Indiana) insisted he heard the N-word 15 times. He's either suffering from the same condition as that Guam-flipper from Georgia, or he's a liar. At a scene packed not only with crews from the Dem poodle media but with a gazillion cellphone cameras, not one single N-word has been caught on audio. (By contrast, see my post yesterday for how easy it is to get it on tape when real epithets are flying.)
    I disagree with John Lewis (Democrat, Georgia) politically but I have always respected him as a genuine civil rights warrior. And I feel slightly queasy at the thought that he would dishonor both the movement and his own part in it for the cheapest of partisan points - in the same way I would be disgusted by a Holocaust survivor painting a swastika on his own door and blaming it on his next-door neighbor over a boundary dispute.
    But that's what the Democratic Party has been reduced to - faking hate crimes as pathetically as any lonely, mentally ill college student. Congressmen Carson, Lewis, Cleaver and the rest have turned themselves into the Congressional equivalent of the Duke University stripper. Except that they're not some penniless loser but a group of important, influential lifetime legislators enjoying all the privileges and perquisites of power, and in all probability acting at the behest of the Democrat leadership.
    Isn't that what societies with functioning media used to call "a story"?
    Apparently not. As they did at Duke, the brain-dead press went along with it - and so, predictably enough, did much of the Republican leadership.
