  1. I would keep it simple - After being married, you discovered that you and your wife are physically and emotionally incompatible, she has now abandoned the marriage and disappeared and that you plan to file for divorce or an anullment. The links provided by @Melancholic Mage above give you a great template and since you just filed last month, I would send the letter to the service center listed at the bottom of your I-797C receipt notice you received for the I-130.
  2. OP - I can't tell you how important the last part of this is. PROTECT YOURSELF. Please. You even mentioned in a previous post that you realize what lengths someone as desperate is this will go to immigrate here.
  3. Like everyone said before me here.... waste NO time withdrawing the I-130 and I-864. Get the letter written today.
  4. Because while a "Legal Ceremony" makes you legally married, a big church wedding, with family, friends and community involved is stronger evidence of a bona fide marriage and intermingling of friends and families.
  5. The K-1 visa application will NOT have an invoice ID. You cannot create an account in CEAC as a K-1 visa applicant as you are not allowed to upload anything there. As asked before, when you check the status of your case in CEAC, does it say "Ready"?
  6. If this does happen, just make sure that you follow up with the medical office to be sure they send it to the embassy. I would also be pressuring them beforehand to try to get them to send it before your interview so that you can avoid this scenario.
  7. Assuming you are approved otherwise (i.e.: No other disqualifying issues), you will likely be given a 221g "Refusal" pending receipt of the medical exam by the embassy. Once they receive the medical, your application will go into the normal administrative processing necesary to issue the visa
  8. K-1 visa applicants do not create an account on CEAC as they do not upload any documents there. When it's time to create the DS-160 you don't need an account.
  9. It’s the $260 if filed concurrently with the I-485
  10. Ah ok so this was right after you guys married... Did you guys not send in much marital evidence with the application?
  11. Just curious… when did you file the AOS application? It’s not in your timeline
  12. This will include sending not just proof of a joint account but the actual statements showing you both using the account
  13. After going through this whole process just to risk it all to have a party? Admittedly as @Crazy Cat said, the risks may be small but the consequences are huge. I would not even be in the same zip code of an event that could be misinterpreted and jeopardize everything I have worked for. Just my 2 cents since you asked
  14. Yes!! It’s the only way we knew when Jaycel’s EAD Card was going to arrive because even though the status on her I-765 says “Card Was Produced”, it still says the tracking number is “Unavailable” and she got the card delivered almost 2 weeks ago. LOL
  15. Yes they can include just the joint sponsor's income. They would include a tax transcript AND a W-2 form from the joint sponsor. Normally USCIS does not want a W-2 with the IRS Tax Transcript except in cases where they filed "Married Filing Jointly" and want to exclude the income of the spouse. See below from the I-864 Instructions: If you provide a photocopy of your Federal individual income tax returns, you must include a copy of each and every Form W-2 and Form 1099 that relates to your returns. Do not include copies of these forms if you provide an IRS transcript of your Federal individual income tax returns rather than a photocopy unless you filed a joint income tax return with your spouse and are qualifying using only your income.
  16. Just remember that for K-1 AOS they realize you won’t have a ton of evidence immediately upon filing. What we’ve been doing since we filed, as we get more evidence, joint account statements, utility bills, etc., we use the “Documents” tab to upload “Unsolicited Evidence”.
  17. You can either try to contact the medical facility that performed the exam and see if they will email you a copy of the DS-3025 or you can send the packet without the copy included. There is no requirement that you provide a copy of it with the I-485. It just serves as a reminder to USCIS that you had a medical exam abroad and to look for it in your A-File. They should see by your filing status on the I-485 that you are adjusting as a K Visa holder and know to look for the medical file. You really should try to get a copy of the DS-3025 however for your own records.
  18. The Return Envelope that you send to the Embassy will be for them to return your report of marriage that they sign and stamp. That would go to your address in the Philippines. The one from the PSA you have to go into their website and request and you would then put your US address in the request with the PSA
  19. This is why everyone keeps saying to pay no attention to the My Progress tab. It is wholly inaccurate and means nothing. After my wife’s biometric appointment, for her I-765 it went from 3 months to 40 months. It stayed at 40 months for a week and then went to 7 months. It stayed there for 3 or 4 days and then went up to 14 months. It stayed there for the next 3 days and then she got an approval notification. Don’t torture yourself with that tab. I know how hard it is to be separated, Jaycel and I spent a year apart waiting for her K-1 visa. Just keep the faith and just know it will be worth it in the end.
