  1. @csh2020 Stay strong - Do what's best for you and your daughter going forward. Once the papers are served, blocking her is the best thing you can do. I might add, get really good at starting a video recording on your phone in case she shows up after all of this to make a scene with you. That way you will have evidence of what transpired.
  2. As I'm digging deeper @hplusj I see 09-283 block I-485s with received dates spanning back to late September 2024 as well
  3. With the I-134 (and subsequently the I-864 for the AOS), current income is king. If you get a job before the time the form is needed, this is proven with pay stubs and an employment verification letter (if your employer will provide one). If that current income is more than the poverty level guidelines for the form, then assets are not required to be disclosed. The I-134 does not require you to provide any info regarding your tax situation except this part from the "Supporting Evidence" section of the instructions: Copy of last U.S. federal income tax return filed (tax transcript). If you did not file a Federal tax return, or if your Federal tax return does not properly reflect your current income, submit copies of consecutive pay statements (stubs) for a minimum of the past month, recent Form W-2, or Form SSA-1099.
  4. You will need the original, certified copy from the court (usually has a raised, dry seal on it) to send to USCIS. Once the case is adjudicated, USCIS will return the originals. I know this all from my experience getting an RFE on the I-129F for not providing the original, court certified copies of the disposition of the case.
  5. So I see quite a few early receipt numbers from 09-283 were received the last week in October and now I see 269 approvals for that block
  6. I think 283 spans Oct and Nov We are 09-286 and we filed Nov 18th
  7. Exactly the right attitude to have during the entire immigration process... do everything in your power to minimize the ability of the decision makers to deny or delay your progress
  8. Maybe another member on here that has been through this can answer... Sorry we filled out a DS-160 for Jacel's visa. But to me the question is the question regardless of the circumstances. You were issued an A# by DHS, so to me I would answer accurately and list the number. When the embassy pulls that number, all they will see is an approved I-130 associated with it and will validate your other listed visits to the USprior to this petition by other means. Just my humble opinion
  9. If you have been to the US before then you would answer yes and put your A# in the appropriate spot.
  10. That is your A #.... Jaycel's was issued on our I-129F approval notice.
  11. This is the best strategy.... If you keep it no more often to once an hour, you should not get locked out. This is how we were able to get Jaycel's appointment. We were checking about once every 65 minutes to be sure we didn't get a lockout. We just happened to come across an appointment that someone else must have canceled because it was the only one available for the whole month when the calendar popped up on that attempt. Just keep at it.

  15. Send her the updated version… While you’re moving forward through this whole immigration journey, my suggestion is to do what Jaycel and I do. Regardless of how small the detail is, do everything within your control to give as little reason possible for the decision makers to make an adverse decision in your case.

  17. You will base your current individual annual income on, exactly that, the current income derived from the gross wages from the paystubs (multiplied by how many pay periods per year). Include 6 months of paystubs (per the I-864 instructions) and if available, an employment verification letter. Whatever this amount is, that is supported by the evidence (Pay stubs, employment letter), you will put that in Part 6., Item 7. "My current individual annual income is:" If the return has already been e-filed and a Tax Return Transcript is available on IRS.gov (or will be available soon), then personally I would wait for that. You will put the amount from the "Total Income" line on the Tax Return Transcript, from whatever year you decide to use, in Part 6., Item 16.a. of the I-864. If you use a Tax Return Transcript as your supporting document, you do NOT include a W-2. You only include W-2s, 1099s etc. when you are using a copy of the tax return (1040) instead of the Tax Return Transcript. Hope this helps
  18. If you are the beneficiary, you do not fill out the I-129F… your petitioner does. All of the criminal history questions are for the petitioner not the beneficiary. You as the beneficiary would disclose any criminal or court proceedings on the DS-160 form prior to your interview for the visa at the consulate
  19. Unless they have been scheduled for an interview, these cases should still be being processed at the NBC. If they determine that it can be approved without an interview, it will be approved there at the NBC. Here’s hoping we all stay there at the NBC! 😁

  21. I’m not 100% sure on this but I think when she enters the US, the CBP officer is the one who stamps her passport as IR-1. Others can correct me if I’m wrong

  23. As a K-1 Visa entrant, she should have already had an Immigrant Medical exam before her K-1 interview abroad.
