    Brother, your intentions may be honorable, but the only thing mattering is what CBP perceives.  That's it.  That's all.  Everyone here is trying to keep you two safe.

    We are not talking about her first entry. 
    We are talking about the upcoming entry. 
    At POE, CBP might decide she is using her F1 visa not to study but her primary purpose for coming to the US is to be with you, marry you and adjust. 

    A 3 month English class with you as her sponsor might raise red flags. 
    Especially because her reasoning behind studying English is she intends on moving to the US (this conflicts with the rules of the F1 visa). 
     
    I will add- F1 students IN SCHOOL married to US citizens are sometimes discouraged from leaving the US because each entry is at the discretion of CBP. 
     
    I wish you and your partner luck but if she doesn’t have a job to return to after the course and the officer doesn’t believe her reasons she might not be allowed to enter the US.

    seeing my fiance while she goes to school is visa fraud? ok. 
    i clearly meant the only reason she chooses US versus UK or other english speaking country is because I also live in US, you call this fraud without knowing what we mean? understand before accusing. 
    education is her primary purpose but like i said, i think you already made up your mind

    The term she would violate that makes her inadmissable is the previously mentioned requirement: an alien having a residence in a foreign country which he has no intention of abandoning,

    - Using the F-1 visa as a tourist visa
     
    - Weak  ties to home.   When my husband visited during the process, he had very strong ties to home.

    It might (might) help if your fiancee visits some other country, even briefly, and returns home before she attempts to visit you.

    Both of us are objective and have been here for years.  I stand by my statements. I remain skeptical that she would return home after the 3 month course.  I think a Consulate Officer and CBP will be skeptical, too.  I see no reason for me to follow this thread any longer.

    The risk is what CBP believes and concludes.
    The agents (everywhere) are under great stress now.
    Even at best, the agents are typically in a foul mood and are looking to nail somebody.
    Their reaction is out of your control.
    Do not risk this, or it will set you back for months/years or permanently.
    A 3-month wait is a trifle, in view of the time frames of this immigration process.
    Be patient and minimize your risk.

    To piggyback off of this, my now-husband traveled to the US during the K1 process multiple time on his B2 visa (not a student visa). Traveling to the US is okay if you have an appropriate visa (and there is still a question if your fiancé can use the same F1 visa, even though it has an expiration of 2025 since she will be attending a different program--but I don't know as much about that aspect). HOWEVER, the border patrol has to believe your fiancé intends to return home. In our personal experiences, my husband (then-fiancé) wasn't asked any questions any time he entered with his B2. They never asked for a return ticket, proof of returning home, and I don't even know if they even asked him how long he would be staying. He went through multiple airports  as his point of entry (Chicago, NYC). That isn't the same for everyone, just HIS experience. I know it turns out differently for many.
     
    The point is, even if you intend on doing everything correctly and your fiancé truly does intend on returning home at the appropriate time, it all depends on what the border agent decides. There is NO ONE here who can tell you which way it will go. It's the luck of the draw of who she encounters, what questions they ask, and how the agent is operating on that particular day. So no one can give you an exact answer. What YOU BOTH need to decide is if this is worth a potential risk. Yes, it may work out very well. But what if it does not? This is what people here are saying.
     
    And on another note, DO NOT DO ANY KIND OF TRADITIONAL CEREMONY BEFORE ENTERING WITH A K1. None. Nothing in her country, nothing in the US. NO Traditional ceremonies or you just went through the whole K1 process for nothing and will need to start all over again.

    Hi Estaban! I did not have the exact same situation you are describing but wanted to share my experience with you in case it is helpful. While my K1 fiancé visa was pending (I am a Spanish citizen, my now husband is a US citizen), I travelled 4 times to the US under the ESTA to come visit him and never had a problem at the border. I know it is not the exact same scenario you are describing because I used the ESTA and not a student visa but this is to confirm you that your fiancé can travel to the US while the K1 is pending. Last time I entered the US without my K1 visa having been approved, I did it for almost 3 months - which is the maximum amount of time I could stay at a time in the US when traveling with ESTA and the period you mentioned your fiancé program would last - and this time the border officer asked me if I had a returned flight ticket home - which I had - and I was let in. In my opinion, as long as you can prove to the officer that after the program is over it is her intention to return to her home country, I do not see why they would not let her in using her student visa which is a non immigrant visa in any case. Hope this is helpful.     K1 is for single people to marry in the US. Marry before and you nullify the visa.

    yes we will return together to her country for real. we will live together in her home country until her interview date. 
    when her fiance visa is approved(it may take more than a year), we will move to usa together and live here.
    this is our plan and wish.

    Dear VisaJoruney community, i have a question regarding our special case. I'm writing this on behalf of my girlfriend (I am US citizen) because she doesn't speak english well.
      She returned from the USA 3 years ago because she finished her internship(student program). She is in her home country now. Her student visa is still valid for 2025. We dated for 3 years and became engaged 2 months ago in her home country and I started the visa process for her last month (K-Fiance visa) and I live in denver.    We want her to enter the USA with her old(not expired) student visa and documents from a language school to study english. We will not get married in the usa. We will not apply for any other visa. She will return to her country in 3 months and finish the fiance visa process in her home. We will not cancel fiance visa application. she will not work here. we will actually return to her home country together.  I just want her to be with me for 3 months and study english here and then she will return back home. She already has a student visa and she found a language school to attend and they said they can send her documents to bring airport. She will go to classes in person. I will pay the tuition before flight. She has enough money to cover expenses for 3 months and I will support her too.   If she try to enter the usa again while our fiance visa is pending(in progress):   1 - Will she have problems at the airport? are we doing anything illegal? she got the student visa years ago for her intership program from collage and she returned on time. 2 - If she get rejected at the airport and sent back to her home, will this affect our pending fiance visa? Are we doing something stupid? 3 - Is there a risk they cancel her visa and ban her for the future visa(like our fiance visa) if she get denied at the airport? Is this worth a try? i can't read any laws to say this is not allowed. I heard people enter with visa when their green card is pending but we want to double check with other people's knowledge and experience.   Thank you very much for your help. Estaban.

    thank you family, you are right about obtaining her first student visa. what you say makes sense and sounds right. things have changed and she returned early but i understand what you mean.
    even if we try it, i know you can't know for sure but do you know if she can get a ban for her entire life for any type of visa for this? it sounds crazy to me but just wanted to ask. even people who commit real fraud gets forgiven when marrying us citizen and my girlfriend will really study and leave, and of course we will be together during that time.
    visa issues is really stressful
