    You would think that in this day in age, one federal government agency would be able to read the data from another one. They could simply ask for permission or just do it when you submit the form and pull that information directly themselves instead of having people gather & print off a bunch of printed documents that they will likely never look at to begin with.

    Assets and savings are not used unless you are trying to qualify with them for sponsoring. If the joint sponsor makes 125% the poverty guidelines on income alone there is no need for assets of any kind or bank information of any kind to be listed.

    Neither. 
    3 is the answer: his household size plus the intending immigrant. Your spouse doesn’t count for this one. 
    Additionally, your spouse will still be your main sponsor, so he needs to fill out another I-864

    I am under the impression that she would be able to use her German license (with a translation) in SC for a year, and the EAD estimates I see on VJ – which is actually one of her bigger problems with this whole process and honestly ridiculous – are safely under that.

    Since you already booked the appointment, might as well attend.  Your wife might get lucky and encounter a knowledgeable SSA employee to handle her SSN application.  That said, be prepared for disappointment too, as some VJ members who applied for SSN after getting married had trouble with the process.
     
    Whatever you decide re: SSN, don't delay filing the I-485 package.  File ASAP.  As mentioned above, SSN is not required to file I-485.

    Too late to apply for a SS card at a local office now.  Now that you have married, she won't be able to get a Social Security card until she has an EAD (or receives it as a result of marking the box on the I-485 or I-765)....maybe up to 8 months after applying for Adjustment of Status.  I see no reason to attend the SS office appointment now. 
    A SS number is not needed to file an I-485.  File the I-485, etc. as soon as you have the paperwork ready.

    My goodness, what a rude agent you got there. I am sorry about this interaction and that you didn't get any help, but also happy your congressman was able to get some insider info (even though vague) and your case may be finally returning to NVC!!!!

    Heard back from my congressman, USCIS sent them an email where the brunt of the update was this:
     
    Spoke with someone in a FB group who received a similar message on the same day from their congressman and after following up with USCIS live chat learned that the case had been sent off to NVC already and that the case status will update in a few days. So I tried the same today and had this lovely interaction.

    Heard back from my congressman, USCIS sent them an email where the brunt of the update was this:
     
    Spoke with someone in a FB group who received a similar message on the same day from their congressman and after following up with USCIS live chat learned that the case had been sent off to NVC already and that the case status will update in a few days. So I tried the same today and had this lovely interaction.

    Alright I am going to go all out next week if I haven't heard anything. It will be 30 days since NVC sent it back, and as of yesterday they supposedly still haven't reviewed my case yet. And we are so convinced in FB groups that this is all because of a new hire's repeated mistake on our forms. 
     
    At a minimum I am going to get a Tier 2 agent, 180 day wait to contact them be damned. Should I be attempting to speak with an immigration officer? If so do I get there from Tier 2 or another method?

    Thanks, I think my Senator's office is really trying this time to make something happen. 
     
    It is interesting that we aren't seeing more reports in here of this happening. I am now in some of those Facebook groups an a ton of December 2021 filers had their cases sent back, leading us to think it really was a new employee making the same error on many people's cases.

    This is a really interesting option, I wasn't aware of this. Maybe I should wait for the results of the Senator's office enquiry? Or should I just submit a request to the Ombudsman as well?
     
    Also semi related question: does USCIS make a note if you call too often and can it have negative effects on your case?

    I wrote about this in the March K1 NOA2 thread, but this week we learned that on May 25 NVC sent our case back to USCIS, and according to what the USCIS agents are telling me from the handbook they have, to quote the email I just receieved following a call with a Tier 2 agent:
     
    Some people have said that this is most often a minor mistake on USCIS' end that is resolved in 30 days. I sure hope so. Otherwise I am waiting to hear back from NVC why this happened (I am sure it will be nothing) and hoping that Senator action will result in something. Because 180 days + however many months is not an option for the fiance who currently hates her temporary home and her job that she has kept while awaiting approval.

    When I found out my case had been sent back to USCIS I did a few things:
    - Spoke to a tier 1 agent. They just told me it will take 180 days for the case to be looked at again.
    - Joined a queue for a tier 2 agent. He said we don't have the details yet and I probably would have to wait 30 days. I think he kind of agreed with me when I said "from what I've seen if it's an USCIS filing error it's 30 days, if it's something serious it's 180 days." I confirmed with him that he was saying I should have an update in 30 days. Then he checked their official guidance I guess or something and repeated the 180 days line and basically wrapped up the call. I don't know how to interpret that call.
    - Wrote an email to NVC. No response yet.
    - Began the process of having my senator look into this case. We'll see if anything comes out of that.
     
    Like I said, 180 days would be a deal breaker and we would just start the next phase of our life in Germany, so I'm hoping this gets resolved soon. The shitty part is that I guess at best we are in the dark until the end of the month?
     
    But hey, the dark is a familiar place for all of us trapped in this process.

    I saw another similar situation recently in a different group. Incredibly frustrating. Hope you're able to get some resolution. For what it's worth I contacted both of my senators and both of my reps for assistance, and while I can't actually prove that their assistance helped, I believe it did.

    I just called USCIS and after looking into it she said it could be a minimum of 180 days before we get an update now that it has been sent back to USCIS. This news is probably the death nail on this whole process for us... I am shocked right now...
     
    The only thing I can guess is that we accidentally submitted a DS-160 too early and that screwed everything up.

    I also made an inquiry Monday and just received the usual we don’t have your case and will follow up with USCIS. So bummed but such is life.

    I know it sounds crazy to say this, but 90 days might kill us at this point. She is asking me every day if I have gotten an email from NVC... Tomorrow is 60. We have been living above her grandpa as a "temporary" solution for 5 months now.

    I know it sounds crazy to say this, but 90 days might kill us at this point. She is asking me every day if I have gotten an email from NVC... Tomorrow is 60. We have been living above her grandpa as a "temporary" solution for 5 months now.
