EB2-NIW Waiting for Interview Letter in London 2023
appleblossom replied to OnPoint's topic in United Kingdom
Mine was AP for just couple of hours, before it changed to issued. I had no reason (links to high risk countries, TAL occupation etc) for it to be 'proper' AP though. Hopefully yours changes very soon too, congrats! -
Yes, she can start it, she could have done that as soon as she had her green card. The only difference is processing times - her child will be considered an 'immediate relative' if she's a citizen, but have a preference category with her as a green card holder. So she should get the application submitted asap (see the guide at the top of the page for more info on the process), and then once she is granted citizenship she can send proof of that to upgrade the application.

That's I-129 applications - it's 6 months for I-129f's. https://egov.uscis.gov/processing-times/reducing-processing-backlogs -
Ah, ok, that's all good then. So just give it time and it will turn up I'm sure. Sounds like the state credit union account made a mistake in not accepting it. It's proof of permanently residency status. Might be worth printing this out to show to people if you have any issues with it? We had the same with my daughter's Bank of America account, even though they'd accepted it fine for us and our son, they had an issue with it for her opening an account for some reason. She just printed this out and took it in and a manager sorted it and opened the account for her. https://www.uscis.gov/i-9-central/temporary-i-551-stamps-and-mrivs

That's odd, the status should say that payment has been received - has he definitely paid the GC fee? Is he using the right receipt number to check the status? It takes up to 90 days after entering to receive the plastic green card, but as said above, he's already got a green card which is valid for a year from his entry date. That should be all he needs for bank/driving test/employment etc.

Yep, as Boiler has said, check with the consulate. Make sure you get it in writing if they will allow it.

EB2-NIW Waiting for Interview Letter in London 2023

Yes, you were DQ'ed in June then. So hopefully an interview letter soon. The tables are in the thread above, scroll up and you should find them, although I'm not sure if it's been updated recently but should give you an idea at least, it's not hugely different now to how it has been for the past couple of years. Best of luck. -
What do you advise I do?

I think any non-immigrant visa is likely to be refused from what you've said. But you can certainly try, you may as well give it a shot and see what happens. -
One ways are usually always more expensive than a return, as the airline has a duty to return you to the country of origin if you're refused entry, so they price that in to a one way. Most people just buy returns, but that's for when they chose not to use the return leg. I flew on a return which I made sure was flexible so I could just use it some other time. But you seem to be saying your husband wouldn't travel on the first leg? So I'm not sure that would work, as the return may well be cancelled if he's a no show for the first flight.

There's a table on various posts with timelines on - please do fill in your timeline as well as it helps hugely. But figure about 3-4 months from DQ to interview as a rough guide. Good luck. -

When were they DQ'ed though? That's the pertinent info. -

Having a rental property isn't a tie, you can rent that from anywhere in the world. Are you sure your visa was only for a month? That's very unusual (most are 10 years, multi-use) and sounds like there was an issue from the start. What was the actual reason given for the refusal last time? J1 is also non-immigrant as said above, so you'd still have to show you will return to your home country for that. If you really were only given a one time use B visa, then I would think your chances are incredibly low, as that indicates there is something on your record that they're concerned about. -

They were lucky, a lot of Pakistanis (particularly males) do get put in to AP as Pakistani records are so poor and extra checks are needed. Please complete your timeline to help others, thanks. I wouldn’t add it personally. please fill in your timeline to help others, thanks. -

Depends on when he was DQ’ed. If it was only August or September, then no, no backlog. Please fill in your timeline to help others, thx. -

Have you ever worked in the US or overstayed? Proving you didn't overstay should be easy enough, so I wonder why your B2 was denied. I suspect that option 3 may be your only choice - you can try again for a tourist visa though on the off chance it's granted. But if that's refused, I don't see you getting a J1 either, with a USC parent. As you're not an immediate relative it'll be a long time until a visa is available to you, and adjustment of status won't be an option. -

It's nothing to do with him now unfortunately. It could only take a couple of weeks (depending on the reason for AP), but it could also be quite a bit longer. There's a long running thread about the DS-5535 in Montreal which may be worth a read - It's usually due to an occupation on the TAL list, or link with a high risk country (Middle East, Pakistan, etc).
