hey.atay1230 got a reaction from EO & FO in Worth it to apply for K3 visa?
Sorry, new to the site. Not really sure how to use it.
  2. Thanks

To file jointly you'll have to paper file and also file the form to request an ITIN and send all the documents they want with it.
If you file MFS you can file online, no ITIN needed.
  3. Thanks

Doesn't matter. You're married, so you can file jointly and get a better tax deduction.

    Explanation:

"If, at the end of your tax year, you are married and one spouse is a U.S. citizen or a U.S. resident within the meaning of Internal Revenue Code (IRC) section 7701(b)(1)(A) and the other is not, you can choose to treat the nonresident spouse as a U.S. resident for tax purposes. This includes situations in which one of you was not a U.S. resident at the beginning of the tax year but was at the end of the year, and the other was not a U.S. resident at the end of the year."

You must file as married. At this stage, your spouse most likely doesn't have SSN, so you can either file separately by paper, or apply for an ITIN and file jointly.

No worries.  They will see what you submitted.  They don't just read summaries.

Look in the K-3 Process subforum (in the main Forums list just above this one).
Start at the top of the threads and read every one that appears relevant.
    Good information there.

None.  Zero risk. No regrets. No reason not to try it.

If you leave them both blank, USCIS will place the I-130 on hold, then it will require an I-824 to move it to the correct location.  This would cause a delay of more than a year.

    This form has dual purpose

it is also used when the person is in the US and AOS here after a K1 visa
Leave it blank/  he is not adjusting here
He will interview for spouse visa in Casablanca
it is always best to pull up the I 130 instructions and follow them

it will cost u a huge fee to correct it later if u fill out a US office/  one VJ  member did it wrong and is now paying the price / its over $500 to correct it

Do not leave 62 a-c blank.

Fill in 62.a-c. Failure to do could result in the I-130 being stuck at USCIS.    I would put "N/A" in 61.a-b.
