I-824 is not required. Solution is along the lines of your plan. 1. File I-751 now. Simple cover letter “ Request for Acceptance of Late Filed I-751 due to Extenuating Circumstances/ Good Cause Exception “ Ask for discretion and request favorable adjudication for reasons stated by OP: misunderstood requirement to file w mom, new USC spouse also erred in assumption a spousal I-130 was needed..my dog ate my homework, ( insert ANY treason) though truth will suffice. Heavy emphasis on job loss and hardship as a result of error. ***Include above title on last page of I-751 so it is guaranteed to pass mailroom ••• Use evidence that was submitted for moms successful ROC IT WILL be accepted and conditions removed. In about 2 weeks she will have an I-751 receipt and extension For a copy of spouse I-130 file a free FOIA. -
There is much to be said about the privileges of being an OP. For example one could abort/terminate a thread..or for that matter simply enjoy the community privilege of authorship. .. I have not had hands on experience with such…but a handful of times the consulate added derivatives for interview AFTER NVC had blocked them as aged out. I also confess , CSPA numbers make my head spin..but it is ALWAYS a good idea to email and argue Service error in NVC calculations , …😂 -

Is it possible that is only for poorly scanned copies that look suspicious? Are they giving out 221G's for everyone? Are you 100% sure? If so, are they requesting it for all divorces, or just the latest one? Finally, are they keeping the certified copy or just inspecting it? My original is very old from Thailand. It would be a nightmare if I had to give up my original. Have you heard anything about court papers from the petitioner (not the beneficiary)? Before a scanned copy was alway ok too, Has that changed? You will need to have the beneficiary carry The Original of ALL civil documents This means for BOTH Pet and Ben They will not keep your originals .

It will not bypass AWA clearance time…I feel for you on that .only way to speed that up is NOT to file new I-130 but file WOM lawsuit for delay ( after you get here and secured the AOS is in) You can and should submit FBI and statement that you have no contact w law at all. -

With all respect you dont really know whats in the chat logs. A laywer called it a def. Entering marriage with false intend.. I might not qualify for vawa but why would that risk me coming to US ? Risk presumption you were complicit in some way and paid for immigration benefit.. If you have grounds for marriage fraud, then get it annulment ( not divorce) in Denmark . If you pull that off hats off, you are Scott free and can repost him all day long. -

What you have described will not meet the VAWA standards. ..inasmuch as the multitude of chat logs did not scare, intimidate or threaten you and only now as you filter them through the heartbreak lens do they seem bad. Cheating , relationship stressors and even grifting are par for the course in long distance ..though he may have imagined himself more as a Sugar Baby than a Provider Husband. If your marriage won’t survive the infidelity, future hopes of green card via VAWA are unrealistic. Flagging him w USCIS will shine unwanted attention on you too. For now you are able to come and go as you please..don’t risk it -

On the forms you mark UNK ( unknown) and submit copy of NVC email correspondence. I again point out , for the sake of expediency it’s worth filing a new I-130 anyway. Once you get in prepare I-485 , either copy of previous pending I-130 case number or new I-130, I-765, I-131, I-864 and have her do a medical for I-693. Within approx a week you will have Notice of receipts for all and she will get a biometrics ASC appointment In about a month. If grandfathers health takes a turn for the worst, she can call in an expedite request for the AP ..but I would expect it to be approved 4 months after filing even without it.
