You need to find a civil surgeon that will do just the vaccinations and not insist on a whole new medical. They can be hard to find, so call around and look in the thread kitthekat posted about civil surgeons that don't rip you off. You need the MMR and Tdap. No varicella since you already have a history of chickenpox, and no flu shot because it is not flu season. You can get the shots at the local health department or family doctor for cheaper and take the records of getting those, any other shot records you have, and your DS-3025 with you to the civil surgeon. You can also let the civil surgeon give you the missing shots to get everything done all in one place. It is up to you. Yes, you need the MMR booster, even if you had those when you were a kid.
-
TBoneTX reacted to kitthekat in Pls help with AOS EAD AP checklist
first you will need the vaccinations done - you can get this done at your local county health clinic, walgreens, etc. anywhere that will give you documentation proving you had the shots. these are often done for much cheaper than at the civil surgeon's clinic. if you are between 18-64, you need MMR and Tdap. You don't need varicella because St. Luke's marked "VH" on your DS-3025, which means you have had chicken pox before. You don't need the influenza shot because it is not the flu season.
then, you need to take the papers/records showing you received the vaccines to the civil surgeon and ask him to transcribe them onto the I-693. look through this list of civil surgeons to find one in your area that will not try to charge you for a whole new medical that you don't need: http://www.visajourney.com/forums/topic/231026-civil-surgeons-who-dont-rip-you-off/ - some of the reviews have prices listed as well.

The OP stated this in their first post, and why I advised them in the first place that they would need to see a civil surgeon for the I-693 if they did not get all the required vaccinations marked off on their DS-3025.
This thread filled up with needless confusion, and ended up coming around full circle anyway. Hopefully others that read it will be able to understand the correct info, or just read Nich-Nick's post.

TBoneTX reacted to kitthekat in Pls help with AOS EAD AP checklist
please be more careful next time before advising someone they don't need the I-693 as this causes the very confusion that has happened in this thread. the advice given to the OP was accurate up until you told her only the DS-3025 was required. this is also not the first time you have been premature in telling people they don't need the I-693 when it turns out they do, because of missing vaccines. -
TBoneTX reacted to kitthekat in Pls help with AOS EAD AP checklist
you are confused and still missing out the section that both kay and i pointed out. the special medical conditions are only relevant to needing a new medical exam. that has nothing to do with the vaccination requirements, which K1s must meet.
kay posted a link earlier to someone who specifically received an RFE for missing rotavirus vaccination. did you take the time to read it? that had nothing to do with under-educated adjudicators, but submitting a DS-3025 that was not properly filled out, that is why an RFE was issued. you are free to search VJ for many other such cases where people have received RFEs for incomplete DS-3025 forms.
if the couple in your story sent in a DS-3025 that was complete, it is not surprising that ultimately they did not need the I-693. i don't see how the story is relevant, unless you have access to a copy of their DS-3025 that shows they were missing vaccines required for their age group and still did not need the I-693.
again, it is not helpful to tell K1 holders that they only need the I-693 if they have "special medical conditions". they also have to meet the vaccination requirements set by the CDC for new immigrants and should first check if their DS-3025 is filled out correctly. if the DS-3025 is not filled out correctly, they may be exempt from having to go through the full medical exam but will still need to get their vaccinations transcribed to the I-693.
please could you post a scan of your DS-3025? we can then see if there are vaccines missing that are required for your age group.

To add to what kit already posted from the USCIS page about K-1 visa adjustment of status applicants, and in response to you telling me to read slower.....
I think you need to read slower, and more. I DID post the instructions straight from the I-693 form instructions found on the USCIS site here back on post #7. > http://www.uscis.gov/i-693
Read the instructions.
Page 5 #3 c. (2) of the I-693 instructions> http://www.uscis.gov/sites/default/files/files/form/i-693instr.pdf
No one has been saying everyone needs a new medical. We have all been agreeing that no new medical is needed. What you keep skipping over is that even when no medical is needed, you still must comply with the vaccination requirements. If there are missing vaccinations, or the DS-3025 is not properly completed, then you still need the civil surgeon for the vaccinations transcription onto an I-693. No medical, just the vaccinations.
What has been posted here are all facts, not rumors and opinions. It comes from the instructions. The person getting an RFE for an incorrectly filled out DS-3025 that I posted a link to was also a fact. It can, and does, happen. The clinics do not always give all the vaccinations needed and/or fill out the DS-3025 correctly.

Yes, in such cases a vaccination record is all that is required - one that is filled in properly. In the OP's case, she has mentioned that she was told she needs to get more vaccinations in the US. Until we know what vaccines those are, we should not be advising her that she does not need the I-693.
And, since you asked for a USCIS link, here you go:
If you received a medical examination prior to admission as a K nonimmigrant, then you are not required to have another medical examination at time of adjustment as long as:
Your Form I-485 is filed within 1 year of your overseas medical examination The medical examination did not reveal a Class A medical condition If you did have a Class A medical condition, you received a waiver of inadmissibility and you have complied with the terms and conditions of the waiver Even if a new medical examination is not required, you still must show proof that you have complied with the vaccination requirements. If the vaccination record (DS 3025) was not properly completed and included as part of the original, overseas medical examination report, you will have to have the vaccination report completed by a designated civil surgeon. In this case, you are required to submit Part 1, Information About You, Part 2, the vaccination chart, and Part 5, the Civil Surgeon's Certification, of Form I-693 (in an envelop sealed by the civil surgeon). Please see the instructions for Form I-693 for further information.
From: http://www.uscis.gov/green-card/green-card-through-family/green-card-through-special-categories-family/k-nonimmigrant That same information is also in the I-693 instructions. The part in bold is what you are missing. Without knowing what vaccines they have or have not received, you cannot make the conclusion that they do not need the I-693. -
TBoneTX reacted to kitthekat in Pls help with AOS EAD AP checklist
vaccines can be had for much cheaper at the local county health clinic. if you can find a civil surgeon who is willing to simply "transcribe" the vaccination records from local clinic to the I-693 at a much cheaper cost, that is an option to consider.

TBoneTX reacted to kitthekat in Pls help with AOS EAD AP checklist
in post # 5, you said: "The I-693 is NOT required with the I-485 with the K-1 unless there was a special medical condition noted (rare)."
in post # 6, you said: "A copy of the DS-3025 is correct for most, exception would be those noted with a special medical condition."
in post # 8, you said: "Not talking about a medical, talking about the need for the I-693 for the K-1 AOS... that is not required."
in the thread i linked earlier, you said: "DS-3025 that you received from St. Luke's is all that is needed for AOS unless Candy had specific medical issues that were noted"
none of those statements are entirely accurate because you are implying that the only reason a K1 would need the I-693 is if they had special "medical conditions/issues", e.g. the class A conditions the USCIS liaison you quoted was referencing. however, if a K1/K2 does not have the required vaccinations for their age group properly marked on their DS-3025, they do still need to get a civil surgeon to fill out page 5 of the I-693, i.e. the "vaccination record". it would be helpful if you could include that caveat in your advice to others so they do not mistakenly think they are exempt from needing the missing vaccines just because they do not have any class A/"special" medical conditions. alternatively, they can just post a scanned copy of their DS-3025 (if available) so others can advise if anything is missing/out of order.

TBoneTX reacted to KayDeeCee in Pls help with AOS EAD AP checklist
You are contradicting yourself in your own words here. You are arguing that no I-693 is needed at all, then stating that is needed if vaccinations are missing. That is exactly what I was saying and pointing out. If the DS-3025 is not properly filled out and all the required vaccinations were not given, then they need to see a civil surgeon to get an I-693 for the vaccinations, not get the whole medical again. It does not matter if they are from the Philippines. The same instructions apply to all countries.
Sometimes the DS-3025 is not marked off correctly by the panel physician, and sometimes they are missing vaccinations that are required. I have seen posts from people from the Philippines post about it, and seen people from the Philippines get an RFE for missing stuff too. One issue in the past with the Philippines exam was that rotavirus was being left unchecked. Some got by with no issue because of it, and some did not. Here is one example : http://www.visajourney.com/forums/topic/460191-ds-3025-rotavirus-row-blank/?p=6634976
Telling everyone from the Philippines that they definitely do not need a civil surgeon for an I-693 is bad advice.
I moved the post from the regional forum because filing for AOS is not specific to the Philippines.

TBoneTX reacted to kitthekat in Pls help with AOS EAD AP checklist
don't you think you should at least try to find out what vaccinations the OP is missing before advising that she does not need the I-693? case in point, this thread, where you argued that the OP did not need the I-693, then later recanted because you realised you misread. it has less to do with what country the OP is from, and everything to do with what is marked on their DS-3025.
OP -- if you post a scanned copy of your DS-3025 with your personal information redacted, members here will be able to see if anything is missing.
-
TBoneTX reacted to KayDeeCee in Pls help with AOS EAD AP checklist
That is true. A new medical is not required. However, the OP mentioned not getting all their vaccinations. If you do not have all the required vaccinations marked off on the DS-3025, then you DO need to see a civil surgeon to get missing vaccinations and have the vaccinations transcribed onto the I-693. Not everyone can just send in a copy of the DS-3025 and be fine. Some countries do not even give vaccinations or the DS-3025. The required vaccinations are important, not just the fact that no medical is required. The detailed information contained in Nich-Nick's post is completely accurate.
Page 5 #3 c. (2) of the I-693 instructions>
Even if a new medical examination is not required, you must still show proof that you complied with the vaccination requirements. If the vaccination record (DS 3025) was not properly completed and included as part of the original overseas medical examination report, you will have to have the vaccination report completed by a designated civil surgeon. In this case, you are required to submit the vaccination record and page 1 of Form I-693.
