  1. Did some research and will post here for posterity.

     

    What they mean is that they can't figure out what the priority date is for the original I-129F. Despite the fact that I included the I-797 NOA2 for the I-129F, it doesn't contain the K-2's name on it. The original I-129F also has a different spelling of K-2's name. And of course, I also didn't fill out the priority date on the K-2's I-485. For this part, I added the priority date and added a copy of the approved I-129F to the packet.

     

    Spoke to the contact center. It's not clear to me whether it's still a concurrent filing after resubmission, but the filing fee remains at $750.

     

    Regarding I-693, they couldn't give a concrete answer, but gave me the tidbit of advice that I-797C instructions are usually very specific, meaning that if it doesn't mention the medical, I shouldn't do anything further with it. So I resubmitted with the medical folder in its disassembled form.

     

    Still not clear to me about the I-864. Most sources are saying that you still only need it for the principal applicant. I filled out a new one and submitted it just in case. Better safe than sorry.

     

    We'll see how this goes. I'll try to update with results if I remember to. Or check my timeline comments.

    Two for each of I-485, I-131, I-765, or 6 total. Are you submitting anything else that requires photos?

     

    Word is that even just 2 photos will suffice for all three applications, but 6 avoids risk of rejection.

    Sent in the K-2 AOS resubmission today, expected to be in the Chicago lockbox by tomorrow. Best I could make out from internet research, it's because I forgot to write the priority date on the I-485 for her I-129F we did last year (didn't know what it was at the time I was applying; thought it has something to do with expedited applications). I also attached a copy of the approved I-129F to the packet that's in addition to the associated I-797 I sent in last time. I think they could've figured out the priority date without me writing it on there, but I think maybe the Lockbox contractors don't have the authority to correct applications. And a complicating factor was that my K-2 stepdaughter's name was spelled differently on the I-129F because she didn't have her passport at the time of application and so we weren't sure what the latin alphabet version of her names were.

     

    Fun fact: I called in to the contact center to verify this, but despite the fact that I'm now resubmitting the K-2 AOS separately from my wife's K-1 AOS, the price is still $750 i.e. filing concurrently with at least one parent. I'm also crossing my fingers that this means that my step-daughter will inherit my wife's original 7/14 priority date. I also asked about the torn open I-693 Medical; the guy said that while he didn't have a concrete answer for that, generally, the instructions on the I-797C are very specific to what has to be done, i.e. if it doesn't mention the medical then I don't have to do anything further there.

    This is also us. Got NOA1 on 7/26, still waiting on access codes.

  4. Hey all,

     

    We sent the AOS packet for both my wife and step-daughter together. My wife's part of it was accepted, but the portions for my step-daughter were taken out and sent back with a Rejection Notice.

     

    Based on the letter below, what I'm guessing was missing was that they wanted a copy of the I-129F packet as with the approval stamp on it. I'm assuming this because even though I sent in two copies of the I-797 for the K-1 approval, the I-797 doesn't actual mention my step-daughter's name on it anywhere. The I-129F packet, on the other hand, does.

     

    I had a few questions that I couldn't find answers to across the forum:

    • Is my above assumption correct? They want a copy of the approved I-129F?
    • Now that the packets have been separated, is this no longer a concurrent filing? Does that mean I have to pay $1140 for my stepdaughter instead of $750? (she's under 14)
    • They tore open the I-693 envelope. I'm really hoping this doesn't mean we have to get a sealed med exam again (she only did the vaccination worksheet part). It looks like all the papers I sent them were scanned in (they have serial numbers and timestamps lightly printed at the bottom of each page now) so maybe that means the information is in their system for those documents?
    • They returned the singular copy of the marriage license record I sent in for both applications, but they didn't return the Affidavit of Support. To be safe, I'm thinking I should probably send a new one in, right?

    Yes, absolutely. No way they'll make you fly over to some other office. Your case gets forwarded to your local field office as determined by your ZIP code (you can search for it at the bottom of the page here: https://www.uscis.gov/about-us/find-a-uscis-office/field-offices). It's not clear to me when that happens, perhaps after your biometrics & background check is complete (if you need one).

  8. Hey ya'll,

     

    We're planning moving from DC to Miami in the next few weeks. What's the word of advice for switching field offices? We feel comfortable flying back to DC for the interview/biometrics since we have family in the area, but looking at the services center reviews, it looks like Miami is a bit faster than DC: https://www.greencardly.com/#/rankings

    However, I've also heard there's a time penalty when filing a change of address mid-adjustment since it goes to a new officer in the new field office. It's only been a couple of weeks since we sent in the application. Perhaps it's early enough in the process where a change of address wouldn't affect things much?

    UPDATE:  her GC arrived in the mail on Saturday, so 28 (ish) days after arrival.  IR1 good for 10 years.

     

    Now to get her on some Eng lessons so she can study for the Citizens test.

    I wish we had gone that route now, haha.

  10. It went from saying that they currently aren't processing B1/B2, but it's possible to schedule appointments for them although they reserve the right to cancel those appointments. Has anyone had any luck here?

     

    It'd be nice to get tourist visas for my wife's parents or her friends so they could visit us. From what I'm hearing, it may be a while before we get Advanced Parole for my wife and step-daughter.

    Now I'm starting to worry. The pending credit card payment has been cancelled. No text messages. Did they find something wrong and are sending it back?

  12. Just dropped ours off at FedEx. We've been waiting for 2 months for our marriage certificate. Decided to get a certified copy of the license at the courthouse today instead and send a copy of the certificate later if they need it. Very happy to see in the instructions for this thread that the license is okay.

     

    Just a bit disheartened to read that EAD and AP will be processed by February my VJs estimations. We were hoping to visit the old country in September, but doesn't look like we'll get the AP in time.

    The only packet I was worried about being opened was the Med Exam stuff that only the Consular Officer could open.  After that we had the CD for the CBP at our point of entry.  There was no packet of docs.  The stuff (I thought) was in our baggage was just the stuff we submitted to start the visa process and as it turns out, is still in our bedroom in Kramatorsk.  We were both so concerned with what stuff we could bring with, neither of us thought about it.  A translated copy of our marriage doc would be nice to have.  :D

     

    Oh well, we'll manage and our house mate can ship it to us if needed before we make another trip over.

     

    On a cheerier note, her SSA card showed up in the mail today.  I thought we had to go apply for that.  Just waiting for her GC, but we can go open a bank account for her now.  Then an Ebay & Etsy shop for her hand crafts.

     

    Ah, gotcha. I think our process was a bit different because of K-1.
