    I’ve talked to some people who got theirs within 3-4 months time after biometrics appointment, but again that was pre-pandemic situation 

    I really hope it doesn’t take this long to get EAD and AP !! 😯😪

     

     

    Receiving your EAD right before your green card, or not at all (because you receive your green card first), is not uncommon.

  2. Did our biometrics this Monday. In and out, ten minutes. Our daughter had hers scheduled in October in another state, but they didn't care at all, so long as we had the appointment letter.

     

    Also a note, my wife has her married name on the I-485 and her maiden name on her passport, but they told us to leave the marriage certificate and other proof of name change in the car. They didn't need it for the bio appointment.

    I think the time frame is that they need to update our case in some way within 90 days since the last update (similar to how we have to respond to RFEs within 90 days). So for July filers, we're coming up on that deadline for many of them.

     

    As an engineer, I also think that with the number of cases they're working with, it's unlikely whey would be going through them one by one, checking everyone's date, and making sure they haven't had an update in the last 90 days. If it was me, I would search the cases for receipt dates in July, that are still stuck in the service center (i.e. not waiting for interview) and mass send out an RFE for a birth certificate. This is why some people with bio appointments are getting RFEs. There's just too many cases to be checking them granularly like that.

    Again, I'm speculating here, but if I was running the place and had tens of thousands of cases and thousands of people under me, this is how I would be meeting legal mandates.

    Trying to find a deep meaning of them asking for the same documents, which were in the package and scanned in online documents by them...

    The running theory is that they issue those redundant RFEs in order to meet requirements for a case to have an update of any kind within a certain amount of time. RFEs are the only update they technically can issue without moving your case forward, and since they can't move it forward yet, they just issue a random RFE. Some of it is hearsay, but I think an alleged USCIS employee confirmed it on reddit.

    Recipients of K-1 visas can file for an SSN immediately after marriage, they don't have to wait for work authorization. The SS card will say that you are not allowed to work without an EAD card.

     

    As far as EAD, it all depends on your service center and can vary greatly for unclear reasons. Unfortunately, a lot of folks are getting their EAD only 1-2 months before they get their green card, which is not a great sign.

    The people at the biometrics facilities are contractors. All they know are fingerprints and photos and where to put them.

    I'm crossing my fingers we don't get an RFE like others have here for documents that were included in the original package.  That is very frustrating to hear about-- hopefully it is easy for you guys to resolve.

    It's possible to reuse your biometrics from a previous time you did it, although there are people I've talked to who've had to do a bio appointment every time they apply for something. I believe your application status will indicate that they were able to reuse biometrics data from a previous process when someone at USCIS makes that call, however.

  8. Got an RFE notice today over Lawfully. It's asking for I-864, birth certificate, and marriage certificate, all things I've sent them. 🤦‍♂️ I feel like the lockbox contractors dicked something up when they separated the AOS apps for my wife and her daughter.

     

    The only thing I might be wrong about is that the birth certificate was translated in the origin country, with notarization and apostille. Maybe it needs translation in the US?

     

    But they didn't mention anything in the RFE about that not being enough, which makes me think they just lost it.

    I'm in a Whatsapp group for summer filers. Looking at the July folks, there are 25 of us and 15 have had theirs scheduled. Although, it's not a perfect record. It's possible some of the remaining ten left the group or did not update when they got theirs scheduled.

     

    But I think it's safe to say you're far from the only one. Another lady in the group from Queens, NYC hasn't had hers scheduled yet and she filed in March I believe.

Had a double celebration this week: my wife got her bio appointment scheduled and our K-2 daughter finally got her adjustment application accepted and receipt numbers issued. 🎉 Seems like our daughter will be on an offset schedule from my wife since her part of the application was accepted later, but I would think the two of them would share their priority date.

  11. Just a small update on our front, we filed a Change of Address a week ago (8/16) for our K-1 AOS applicant, which would change our field office from Washington, DC to Miami, FL. The queue in Miami is about 20% smaller than DC, but of course, we're going to have a delay due to the transfer... Still it was only a month since we our application was even received, so it shouldn't delay things too much.

     

    We haven't even received receipt numbers for our K-2 AOS applicant, so we haven't been able to file a Change of Address for her yet. I'm wondering if there is a COA process for someone like that, technically in the middle of adjustment but no receipt numbers.

    Still waiting. PD July 14th.

     

    Generally, I've heard it takes at least a month, but can take longer.

    She said that if the package was being sent back, she would have a number to give me but apparently there's nothing still. :( 

     

    Saying "no receipt" worked by the way, then 77 minutes wait.

    It's not unusual. More than a few people get their first text message notifications over a month after the date of receipt. But with something where they will definitely reject it, you won't get notified at all until you get the package back in the mail. Just the way it works, unfortunately.

    Since it's stuck at the lockbox, you could try their email address: lockboxsupport@uscis.dhs.gov

     

    It's not clear to me why they're taking so long to reject it as it's a straightforward rejection. Perhaps they review the entire list of documents to make sure everything else is there as well to make sure they send you complete instructions.

    It can take a while sometimes for unknown reasons. There are people I've spoken who had to wait over a month. When they rejected part of our application, they stapled papers together, so they'd be pretty hypocritical if they delayed you for the same reason. 😂
