You do meet the 125% HHS federal poverty level for your household size.  However, this is the minimum amount you need to make in order to possibly qualify.  The CO at Montreal has the final say - he/she can request you to get a joint sponsor before approving your husband's visa.  NVC's letter is a recommendation at this point - it is not a requirement.  They will still schedule your husband's interview when it's time to do so.

If you can line up a joint sponsor, then I suggest you do so.  Don't submit it, but have their I-864 ready for your husband to submit at the interview if the CO requires it.

Also, it is likely with the backup at Montreal that your husband's interview will not be until after April 19.  I suggest you to prepare an updated I-864 for your husband to bring to the interview.  Only include 2021 the tax return transcript in this updated I-864.   Years 2 and 3 of tax returns are optional - in your case, it does not help show a history of qualifying income (30K for 2020, 28k for 2019).

Also, if somehow your husband's work will continue when he immigrates, you can add his income to yours.

Sounds like a solid plan.  Thank you for answering.  I appreciate it greatly.

    1.  When did you submit the I-864?

    2.  What did you put as your current income in your I-864?

    3.  How many dependents do you have on your taxes?

    4.  How many dependents did you put on the I-864?

I submitted it in October 2021.   I put my current salary of 55k at the answer and had the letter from my school district stating that.  My salary of 55k is from September to the next September.   I did include 6 months of pay stubs as well.
I have 3 dependents.  So family size of 5 including my children and my spouse and myself.

  3. This will be long so that I can get some good advice.
I am US citizen.  I was previously married and have three kids (twins that are 20 and a 16 year old).  I stayed home much of that marriage.  I did work full time in 2017,2018,2019. I was a mental health therapist in Alabama.  Salary for those year for taxable income was 28k.
2020 the pandemic hit and I switched careers and moved to Illinois to be back near family.  My salary increased to 47k (of course school starts in August so I only have a few months of higher pay and my taxable income is 30k for that year.
    2021 w2’s show 50k earned and 46k taxable income.
I included a letter from my employer stating my salary is 55k for 21/22 school year but of course the higher paycheck only starts each September.  The letter also says that my next year salary will be 57k.
I also included 6 months of pay stubs.
I submitted all doc with that and got DQ but with RFE for insufficient income and to add joint sponsor but consular officer could make final decision.
the min I need to make is 38k.   My current salary is 55k.  Do I need a joint sponsor or will they take all that and we will be ok without one.  Spouse is Canadian.

Well fellow Applicants & Petitioners, we heard from NVC yesterday but they said we submitted an expired doc. The police certificate was expired, which was true. We actually did not need one according to their rules (my spouse left the country over year ago) and I submitted a copy of their rules along with the expired doc. In any case, good enough we were able to obtain a current police certificate while we were waiting so it's no issue. We just uploaded it. But my concern is, will we go to the back of the line again, or will they quickly review this one document? All other documents changed from uploaded to "accepted". The comment they left was:

I’m sorry.  I hope it goes smoothly this time.  It is so hard waiting.

  5. I am the petitioner, spouse is Canadian.  I have uploaded the affidavit of support and using the regular form not the EZ.  I have  my tax transcripts and I will upload those.  I did not have enough income last year (30k due to job change during pandemic and I have 3 kids).  I currently make mid 50k and have pay stubs and a letter from my employer.  Does that get uploaded with the transcripts or in supporting documents?  I just want to make sure that they see I do make enough and have been for the past 13 months.  I also do not want to make a mistake.

  6. Thank you!  The virus has made it difficult for everyone to get everything done in the best way to be able to see their partners and get the process moving.  I just didn't want a huge red flag waving around to make it go even more slowly than it already will.  I think our extensive travel histories to visit one another and our long relationship with proof is probably helpful.  I just wanted reassurance!  Thanks for giving me that!

  7. The State of Kansas. I drove to Kansas and we got married there.  He was on Facetime.  We did the required forms and he had them notarized in Canada, mailed them to me, and then I drove to Kansas City.  We got married in Overland Park.  There is nothing on the certificate itself that says by proxy from the state.  I also have him as my life insurance beneficiary and also the beneficiary of my mutual funds.  We used to see each other every other month prior to pandemic but not the past year due to travel restrictions.

  8. My (US)  spouse (Canadian) have been together for 4 years.  We met in 2016 and began dating in 2017.  We were to get married March 21, 2020.  We obviously had to cancel due to Coronavirus.  We married by proxy in June 2020.  I went to visit him in Canada in July of 2020 to see each other and make the marriage legal by consummating it.  He came to visit me in October of 2020.  I filed the i130 in December 2020.  I received the NOA1 on January 4, 2021.  We have family vacation photos (I have 3 kids from prior marriage) and photos with my family throughout the years.  Do you think the proxy marriage will be a big deal?  We needed to get married to get the ball rolling and I could not visit him (I am a teacher with summers off) unless we were married due to Canada rules about entering Canada as a non-Canadian.  It is obviously too late now to do anything about it but wanted to know if this would be looked at poorly by the USCIS.
