Emilini got a reaction from DGF in IR-1/CR-1 Montreal DQ'd private message group goes public CONTINUED
Hi, All. I was able to reschedule - but because of Covid, it's a lot more complicated than the link that is provided in the FAQ's. When I realized I wasn't able to make my March 1st appointment (after much anxiety and sleepless nights), I emailed Montreal (the email they recommend to use) and gave them my information - my passport #, my Case # and forwarded my interview email from the NVC. I told them my reasons (too short notice, working in states, young children traumatized by last 8 mo separation from father, etc). They cancelled my interview. I went to sign in at the interview scheduling website - and they said I needed to schedule an appointment - and that there were none available at the time. Weird, I was expecting to see a calendar, but whatever. I kept checking. At the end of February I received another date - April 9. Well, that's nice and all, but I'm here in the states under an r-class work visa (I'm a pastor) and April 9 is right after Easter...and I can't leave here during the most holy celebration/feast to quarantine and have all my appointments. So, I emailed the consulate again and this time I was first given the following email: "The U.S. Consulate General in Montreal does not handle re-scheduling interviews. Any questions about scheduling/re-scheduling the appointment or any issues with the website of our appointment services contractor should be reported directly to the Official U.S. Department of State Visa Appointment Service using the contact details here https://ais.usvisa-info.com/en-CA/iv/information/contact_us" On the scheduling website it says their call centre can reschedule appointments. So, I called them, however, the person I talked to at the call-centre said that, no, the Montreal consulate will reschedule the appointment only after I miss the April 9 appointment. Ok, that's not what happened last time - but ok.
Yesterday I received another email from Montreal saying: Good morning, Thank you for the notification. Our Visa unit will contact you with appointment availability in late April and May 2021.
So, they have no idea what they're doing and they're just stringing me along - each email is from a different operator. I'm just waiting to see what will happen next. Right now, my husband and I are also in talks with an immigration lawyer who thinks we have a good case for Adjustment of Status. I'm a little nervous about that - because of stories I've heard about denials of greencards and I have been denied entry at the border 2ce in the last 15 years - (the last time was almost 2 years ago). So, we'll wait and see what happens re my rescheduled rescheduled appointment. I wish I could choose the date, but it doesn't look like they're doing that anymore/right now. I also hope that I will receive the vaccination soon - so that may help if vaccine passports will get me into Canada without all the silly border shenanigans.

Hey all, a while ago, I sent an email to Montreal asking them to clarify the Criminal Record Check debate. This is my email to them and their response:
Greetings. I am anticipating my interview will happen in March (I was documentarily qualified on June 3rd 2020)
There is a bit of confusion when it comes to the new criminal record check requirement titled "Criminal record check for personal use". I had my criminal record check done in May 2020 and it was the "privacy record check" which was the check required by the NVC and was approved. Since my privacy record check is not yet expired, am I still required to get a new criminal record check with the new name or will my current one suffice? Please let me know so that I can inform my visajourney peers This is their Response Good morning, Police certificates expire after one year, unless the certificate was issued from your country of previous residence and you have not returned there since the police certificate was issued. If at the time of your interview the following three items are all true, you must bring a new police certificate to your visa interview: You are more than 16 years old; The police certificate submitted to NVC was obtained more than one year ago; and You still live in the country that issued the certificate. The Certified Criminal Record Check requested under the Privacy Act is fingerprint-based is required by U.S. Consular posts in Canada. So, we've decided to try to reschedule my appointment and if that fails, apply for AOS. My interview was scheduled for March 1st. Even if we were in Canada (I'm here on an R-class i-129) it would still be incredibly difficult to get everything done in a 3.25 weeks... childcare, travel, drs apts, etc during a pandemic... not to mention the cost. Please note that on my piece of the database and I will update my timeline too.

Hey all, me again. My husband just pointed this out to me under Who Must Attend the Interview on the NVC website: "You, your spouse, and any qualified unmarried children immigrating with you, must participate in the interview. All traveling applicants required to participate will be named on the interview Appointment Letter you receive from the National Visa Center (NVC)."
My kids (5 and 3) were named on my nvc document received today. The issue is that they are American Citizens and will not be immigrating with me because they're already legit here. Do I need to bring them too? I can just imagine waiting and answering questions with a 5 and 3 year old running (yes they're noisy joyful runners) around. Someone, please help me.

I just sent an email to the montreal consulate about the criminal records check. Hopefully they'll be prompt and send an answer. I'll post what I get in response.
