  1. It’s possible to visit your spouse in the United States while your  application is pending. In order to do so, you would need to apply for a tourist visa. But before pursuing this option, it’s important to understand the challenges and risks involved. First, you would need to convince an immigration officer that you plan to stay only for a short time and would leave the United States before your tourist visa expired.

If you don’t have any immediate plans to live permanently in the United States, it’s best to be clear about that in your tourist visa application. You might also want to prove that:

    1. You have employment or educational commitments in your home country that prevent you from moving permanently to the United States at the present moment.

    2. You have a confirmed travel plan with a clear date of return to your home country.

But there’s another hurdle to overcome after that: When you arrive in the United States, a U.S. Customs and Border Protection agent will inspect, or question, you at the airport. You’ll be asked to explain why you’re visiting. The CBP agent would then decide — at their discretion — whether to let you enter. You must never misrepresent your reason for visiting the United States, either on an immigration form or before an immigration officer or a CBP agent. You also must never lie about being married to a U.S. citizen or green card holder.

  2. If a green card holder  leaves the United States and wishes to return, the person's trip must be for a temporary visit, not because that person's "real" home is elsewhere. Making your home in another country can lead to the conclusion that you have "abandoned"  your U.S. residence. U.S. Customs and Border Protection officers have the power to decide whether returning green card holders are living outside the United States. If they believe you are, to take steps to have your green card revoked.

If you stay outside the U.S. for more than one year and do not get a reentry permit before leaving, then in order to come back again, you must apply at a U.S. consulate abroad for a special immigrant visa as a returning resident. To get this visa, you will have to convince the consular officer that your absence from the U.S. has been temporary and you never planned to abandon your U.S. residence. You will have to show evidence that you were kept away longer than one year due to unforeseen circumstances. Such evidence might be a letter from a doctor showing that you or a family member had a medical problem. If you do not have a very good reason for failing to return within one year, there is a strong chance you will lose your green card.

  3. If a green card holder (lawful permanent or conditional resident) leaves the United States and wishes to return, the person's trip must be for a temporary visit, not because that person's "real" home is elsewhere. Making your home in another country can lead to the conclusion that you have "abandoned" (given up) your U.S. residence.

U.S. Customs and Border Protection (CBP) officers have the power to decide whether returning green card holders are living outside the United States. If they believe you are, to take steps to have your green card revoked (cancelled).

As the coronavirus pandemic continues to spread around the world, the U.S. Government has suspended visa services and canceled related non-emergency immigrant and nonimmigrant visa interview appointments at U.S. Embassies and Consulates around the world.

United States of America, Department of State

    U.S. Embassy & Consulates
    in Pakistan

Information for visa applicants regarding novel coronavirus:  As of 17 March, the United States Embassy and Consulates in Pakistan are cancelling routine immigrant and nonimmigrant visa appointments.  Your visa appointment stands as cancelled.  We will resume routine visa services as soon as possible but are unable to provide a specific date at this time.  The MRV fee is valid and may be used for a visa application in the country where it was purchased within one year of the date of payment.  If you have an urgent matter and need to travel immediately, please follow the guidance provided at our GSS site to request an emergency appointment.

Due to the suspension of IV services, Embassy Pakistan recommends that IV applicants consider postponing visits to a panel physician site to complete a medical exam.  Medical exam results are valid for a maximum of six months.

  5. To qualify for a visitor visa, you must establish that you do not have an “immigrant intent,” the intent to remain the U.S. permanently. This is a basic component of most temporary U.S. visas. The U.S. government wants to know that you will return before your visa expires. Unfortunately, the form I-130,  filed on your husbands behalf, signals that he intend to live permanently in the U.S. at some point in the future. Consequently, people with pending immigrant petitions run into more scrutiny when applying for a temporary visitor visa.

  6. As of March 2020, the State Department has updated CEAC so that while administrative processing is pending the status will show as “Refused.” It further explains that if you are subject to administrative processing “your case will remain refused will undergoing such processing.”

Administrative processing is a black hole and it may take longer than 180 days. Follows up to check on the status of administrative processing after 30 days. During AP i know you have to wait little longer but If you think your case is genuine in the end you will get the Visa. Do not worry too much. Best of luck!

  7. U.S. Mission India posts, in light of the global COVID-19 pandemic, are cancelling immigrant and nonimmigrant visa appointments from March 16, 2020, onward. Your visa appointment stands as cancelled. Once Mission India resumes regular consular operations, appointments will be made available and you will be able to reschedule.

In accordance with public health recommendations, beginning Monday, March 16, Mission India’s American Centers in New Delhi, Chennai, Kolkata, and Mumbai will pause in-person programming and close public access until further notice.

  8. Well consular officer has approved and printed your visa. Passport is ready for pick up or may be they already mailed it. Try to check it with your mail carrier. Normally  people receive it with in a week after your visa is printed and issued. Jan 3 is long long time ago and do not trust on " USTRAVELDOCS, (however, says this: 'There is no status update available for the passport number submitted". ), because some times they do not update  " USTRAVELDOCS,". Good luck.

  9. Hey guys

In the page my uscis.gov, it jus says "in process". Is there some other place that we can go look at to check the status?

I havent even received my SS yet, I entered on the 19th of Feb. Should I be doing something about it?

Well you can also check at  https://egov.uscis.gov/casestatus/landing.do. Normally both have same messages. For SS card You can  visit your local SS office.

Well  if USCIS mailed it on the March 4th  then  you will  find it in your mailbox  by tomorrow or Monday. Good luck!
  11. I already tried to contact USCIS on Dec 27 and I received a standard reply that "we should receive our green card within 120 days" and that we should contact them once 120 days have passed. I guess I'm going to give it another try since we are at 105 days already. @Girl-S thanks for your advice!

    ^                           ^                       ^                               ^                                   ^                                    ^                                      ^                                 ^                                  ^                                ^                                      ^                                   ^

Well if you have 105 days already, you are very close to getting your Green Card. Because in these days most of the people are getting their Green Cards near about 120 days. I got mine on Friday after 125 days of POE. Once you are near to 120 days, you will notice the date change once or twice. And then the top message will change from Fee received to  USCIS has accepted your application, petition, or request for processing, to Card is being produced and then Card was mailed to you. Once they start working on your file, with in 10 days Card will be in your hands. I saw update on Feb 19, 20 and then the Messages started to change every other day and they mailed my card on Feb 25th  and i received it on the 28th. I think  we have to wait long time for our Green Cards because of backlog. I know It is very frustrating. But try to be positive and gain strength, and confidence  by other peoples experience. Congratulation to all of you who already got their Green Cards and Best of luck to every one who is waiting for their Green Cards!
