Let's take a deep breath. If you both are a good citizens and have not had problems with the law and you meet all the other requirements then you have nothing to be worry about. I don't know your local laws about your husband hanging out with your son but I hung out with my step-son many times without problems. Sometimes it's best to just stay in one thread and ignore all the static that some others can create.

You have no reason not to keep moving forward. You'll look back on this and wonder why you ever worried this much. Smile

I think I’m starting to get paranoid that I’m going to accidentally say or do the wrong thing or break some rule I didn’t know about and screw everything up. And everything is on the line with this! I just found out that if my fiancé hangs out my son while I’m at work, there’s a chance that could be considered illegal? I never in a million years would have thought. And for some reason I totally thought working remotely would be ok. I don’t know how many times I’ve worked from my computer while traveling without even considering that I might be breaking some kind of laws doing so! It’s a lot to process. I love having these forums as a resource, but it’s definitely causing a lot of anxiety.

Hello everyone! We just got approved!!! USCIS got our I29F on October 17, 2019. I have Canadian passport.  Previously married. I did not send a cover letter, so that wasnt a problem hehehe.  Moving to next step. Got everything ready ❤

Oh, wow. That's crazy. Yeah, there's definitely not anything that would indicate we're married or anything to hide about the situation, so it's surprising to me to hear that it's a good idea to be vague. The engagement was his friends holding up a sign that said, "Will you marry me?" he got down on one knee, proposed, I said yes, and then we went out for drinks. Very typical engagement, I would think.

Oh, thank you. That’s interesting. Are you able to point me to any resources that address this, by any chance? It sounds like the best option is just going to be for him to wait until the K1 is approved before he comes out here for any length of time. He will need time to wrap up his freelance work anyway, if he’s not able to continue with it once he is in the US.

It’s unfortunate that this whole process is so complicated and there are so many ways you can misstep along the way. I’m so grateful for this resource and everyone on here who takes the time to help others through this!

I get it.  For the record, I have seen petitions denied because the USCIS did not believe that both parties intended to marry each other within 90 days.

Well, shoot. I'm worried now that I included too much. The and/or made it a little unclear, I guess. I figured I would err on the side of being thorough.

Thank you. This is very helpful.

Yes. Don't tell me there is some  kind of rule against this as well?

Yeah, it's difficult either way. I definitely wasn't ready to get married nine months into our relationship, but at this point I would feel completely confident in that decision, so it's easy to look back and think "Oh, if we did it this way, it would have been easier."

And that's so cool! I've heard it is such a beautiful country. It has been very difficult for him to no longer have his home and his family. He was in the middle of his masters program in Spain when things got really bad and hasn't been back since. And I've actually spent quite a bit of time in Ireland (small world). We have family in County Galway.

It's not worth the risk unfortunately. My current employer proposed the same thing too, but I am going to wait until I have my EAD. It can be a long wait...but again, the risk isn't worth it.

A lot of people seem to suggest CR1 for this reason (and there are plenty of valid reasons why CR1 is better than K1...but it's a personal choice at the end of the day). Anything seen as work or something that could lead to work is a no go until the EAD is in hand.

p.s I used to live in Venezuela, Anzoategui...apart from all that happened there...i still miss it sometimes!

I would suggest reading this thread regarding a recent member's SO intending to do (and previously doing) freelance work in the US while visiting:

More hours because...he would be watching your son while you work?

    See the above thread again.
Technically the first 90 days would be allowed as he has authorization but no evidence of it, so self-employment is probably fine. After 90 days and without an EAD or green card, it would not be allowed.

Freelance would generally fall under self-employment. That means both the employer and employee would be the visitor in the US, which would be unauthorized work.

Thank you so much! We actually received an email from them with a pdf. I am waiting for my fiance to send it to me to see if it will suffice or if we need them to send us more. We've also applied for a general police clearance from Switzerland so I hope that this plus the police report, ticket and fine receipt, we'll be fine.

Hi guys! Congrats on the NOA2s for everyone who has recieved them so far! Here is our update:

On my Visa Tracker app (iPhone) I received a notice on Jan 30th that an RFE was sent out. I knew it had to be one of two things: I didn't include a "Beneficiary's Statement of Intent to Marry" and I didn't thoroughly read the information about arrest records and missed the part about including documentation.
I called the courthouse in my hometown Friday morning and they told me anyone could pick up the documents. My son and I were already planning to head down for the weekend to visit family, but since we wouldn't be there until the evening, my best friend came to the rescue and got there before closing. My fiance was able to print and sign his letter and had a friend send it through DHL Saturday morning. I read rumors about it needing a "wet signature" so I didn't want to take any chances. As I was outside shoveling snow this afternoon - we got a foot (!!!) overnight - I received both the DHL package and the RFE and I was right! They needed both of the things I was anticipating. I'm so grateful to have been able to get both things done in record time.

I just finished putting together my response. Is it excessive? Should I include more? I have some pictures from our engagement as well.

I have a feeling this will be a great week for approvals! Give 2 more weeks, the October filers will get their NOA2s for the most part. I just have this feeling based on how it's been moving in recent weeks after New Year's. Let's see if I'm right. 😄 Good luck!
