Thank you everyone for sharing their expertise in this topic. This was a learning lesson -- though there are a few who could have been more kind and less accusatory in their posts. I posted here looking for advice, not to be lynched for something I didn't realize was a legal issue. At no point was I advised, not by lawyers we've consulted (who have told us we need to get married before they'll be of much help), by my school, or through my independent research, not to leave the country simply for being engaged.

All of us on this board have had to navigate this process, and I hope for your sakes that your advisees had been kinder, and less judgemental than you have been. That said, I appreciate the wisdom and my fiancé and I will have to reconsider our plans.

This is what I don't understand -- people can be engaged for years before actually intending to marry. Similarly, people can have no intention of marrying, and then end up married after a weekend in Vegas.

I still have my Canadian apartment, and all my finances are still through my Canadian banks. That is to say, I have kept my Canadian ties with the intention of returning to this apartment once my time in the US is completed. Those plans did change once I met my fiancé, but that doesn't mean I'm entering with misintent, does it?

It went from 'Fingerprint Fee was Received' to 'Fingerprint Review was Completed' after the appointment.
There were no other updates in between. The appointment date was only mentioned in the Biometrics appt hardcopy. No where else...

A lot of people who filed in December seem to be having this issue. I've seen this in the K1 - AOS  forum too

People who are deciding the OP was purposefully being fraudulent, this forum is to help people, not to be judgemental jerks. Present the facts.

OP is entitled to AOS regardless. Since the original thread was in the visa forum and in the initial post the OP indicated they wanted a spousal visa, questions were answered as such. If her mind has changed since entry, then her circumstances may have changed and she can AOS.

It makes it easier for persons with the thread mentioned tourist or student visas so having specific threads doesn't hurt. If they wanted it all together, I am sure the Admin or Moderator would have fixed it by now. Dont focus on the filing December filing thread. Persons are mainly looking at the type of visa they got and then go from there.

The process is same but the documents submitted are slightly different. And the issues we have are slightly different too. For example - AOS from K1 and K3 Family based Visas forum wouldn't be able to address issues such as what happens when someone has a H1B visa pending, what happens when someone is here on an F1 OPT... I can go on.. But I'm pretty sure no one on that forum will have an idea as to what we are speaking about.

No, now you can bring it during the interview as long as the form was signed  within 60 days from when the application was received by USCIS. Please see more info at their website: https://www.uscis.gov/news/alerts/uscis-policy-manual-update
During biometrics they are not allowed to check your application or receive anything from you. All you do is take picture and fingerprints and thats it. If they require more douments from you, you will receive a notice in the mail with the request.

Based on reading comments, I am giving it the 30 days time-frame  to see if I will hear anything and also for the holidays to fully pass.

PP31 got a reaction from fs2439 in Walk-in Biometrics Experience
    Hi all,

Wanted to share my Biometrics appointment Walk-in experience. I received the Biometrics Appointment letter yesterday with the appointment date of 1/10/2020 at Fort Worth, Texas - I expected them to schedule it in Charlotte, NC but I was suprised that they picked the ASC closer to my husband (My husband lives in Dallas but I live in Charlotte and I am visiting him for the holidays)

I went this morning to a different ASC location - Dallas, TX instead of Fort Worth, TX. The officers who were checking people in asked me to wait for someone - probably the Manager or incharge of that ASC. She asked me why I was there before my appointment date and I told her that I live in Charlotte and I had my flight the next evening. She asked me when I was going to come back and I said not until February. She asked me to show her some proof and I showed her my flight tickets. Then she wrote that I was allowed to proceed on my Appointment Letter.
Another person who walked in after me was sent away and asked to come back on the date specified on his Appointment letter.

So I guess if it weren't for the flight tickets, I would'nt have been allowed to proceed either.

12/07/2019 - AOS package mailed via UPS
12/10/2019 - UPS tracking showed that it was delivered

Amscott said the money orders haven't been cashed and no notification as yet so still waiting.
This really tests your patience but I just say it is because of the holidays.

It took around 21 days for me to receive my NOA1 in the mail when I sent all my paperwork at the end of Oct. I would allow 30 days due to the holidays.
