  1. Hi guys,

     

    I'm really happy because finally my interview was scheduled. I have a question regarding the interview, does my husband (sponsor) needs to bring his birth certificate to the interview? I'm asking because he's a naturalized US Citizen (we have naturalization certificate and US passport) but we don't have his birth certificate.

     

    When I sent my original packet, I didn't include his birth certificate and I never got an RFE asking for it.

    No, no action on my part. I was fortunate enough to get my EAD on time, for the rest just wait.

    No, they haven't asked. I'll have to provide that at the interview.

    But I cannot expedite without biometrics, and, as I stated in my post, I'm still waiting for biometrics appointment

  6. Hi, I'm a mexican TN visa holder, my visa expires on November 18, 2020. Currently I have a AoS pending, still waiting for biometrics appointment in Los Angeles (ASC reopened on July 27). I'm a bit worried that I would not be able to get my EAD on time to continue working and my question is, would it be possible to file an I-129 to extend my TN (I know it would be denied because of my AoS) but this will extend my work authorization while the I-129 is processing giving me more time to get my EAD. Has anybody try this? Would you recommend to do this? TIA

    Mine was received on the 5th and still no confirmation. Fingers crossed I get a notification next week, getting a little anxious.

  8. A couple of weeks I asked about using beneficiary's income to file for AOS (link).

     

    My timeline is more or less, get married in December, wait for W-2 from work end of January, do the taxes as Married Filing Jointly, wait for 1040. Once we have it the next step is do AOS.

     

    My question is how should we fill the I-864 form? Should I also include I-864A? Should we even wait for the 1040 submit the AOS package ASAP?

    Thank you in advance for any help,

     

    I little bit of background, I met this guy three year ago. 2 years ago we got engaged and moved in together (we have plenty of evidence like him being added to my car insurance, authorized user on my credit cards, phone plan, iCloud family account, etc). I'm a software engineer from Mexico working on a TN Visa currently making ~130k annually.

     

    Now we want to get married and file for AOS around January next year. Only issue is that my fiancé is not working (he's currently launching an app and has no income). Is my salary enough to satisfy the household income without requiring a sponsor? (we have had a lot of issues getting one) is 10 months left on my visa enough time for processing?
