Marriage to USC on TN Visa (USC Not working)

Hi all,

 

Thank you in advance for any help,

 

I little bit of background, I met this guy three year ago. 2 years ago we got engaged and moved in together (we have plenty of evidence like him being added to my car insurance, authorized user on my credit cards, phone plan, iCloud family account, etc). I'm a software engineer from Mexico working on a TN Visa currently making ~130k annually.

 

Now we want to get married and file for AOS around January next year. Only issue is that my fiancé is not working (he's currently launching an app and has no income). Is my salary enough to satisfy the household income without requiring a sponsor? (we have had a lot of issues getting one) is 10 months left on my visa enough time for processing?

03/05/2020 -- Package delivered to Chicago Lockbox (Rejected)

04/20/2020 -- Package delivered to Chicago Lockbox (Rejected)

05/04/2020 -- Package delivered to Chicago Lockbox

05/14/2020 -- Checks cashed. Case numbers received (4 SMS)

05/19/2020 -- NOA1 Hard copies received

12/03/2020 -- Biometrics appointment notice received (Appointment on 12/21)

12/21/2020 -- Biometrics appointment

02/25/2021 -- I-765 New Card Is Being Produced

10/07/2021 -- I-765 & I-131 Renewal Package received by USCIS

02/23/2022 -- I-485 Interview was scheduled

Your salary is enough.  Just make sure you include a letter from the employer in your I-864 stating the terms of your employment (either clearly saying or implying that your job will stay when you get a GC).

 

As for the 10 months, that should be enough time to get EAD, so you should be fine.  Make sure you apply for EAD.

It should be fine. I was under similar circumstances. I would try expedite the EAD just incase it takes longer than usual, you could use financial hardship as a reason? Since your husband isn't working and you are the sole provider.

July 5th, 2018 Married in New York

Aug 7, 2018 - AOS package sent  (I-485, I-130, I-130A, I-864, I-131, I-765 )

Aug 17, 2018 - Received NOAs via e-notification (email/text)

Aug 29 - RFE request for missing form

Sept 6, 2018 - Biometrics appointment

Sep 10th, 2018 - Requested USCIS to expedite EAD under "severe financial loss" 

Sep 16th, 2018 - Received letter from USCIS requesting  documents to  support expediting of EAD

Sep 16th, 2018 - Documents supporting EAD expedite faxed to USCIS

Sep 25th, 2018 - Requested help from congressman, they've filed on their behalf

Oct 3rd, 2018 - Told by congressman that USCIS has rejected my request to expedite

Oct 3rd, 2018 - Case ready to be scheduled for interview

Oct 10, 2018 - Received update that my EAD card is in production

Oct 16, 2018 - Received EAD and AP combo card in mail!

Nov 8, 2019 - Got an email saying my Interviewed is scheduled (finally!)

Dec 18, 2019 - GC Interview

Dec 19, 2019 - I-485 and I-130 approved! Green card ordered :)

One more question, how should I fill the form I-864? Should I submit this or should my fiancé be the one submitting it with my income?
