    Yes I spoke to Tier 2 multiple times and they expedited my petition. And I clearly mentioned in the letter sent to USCIS (when they asked additional information to expedite my case) that I am currently in India. 
     

    I am permanent resident of Canada. And I didnt leave US without AP document. If you read my first post on this thread I mentioned it there that I was given 30 days emergency travel document because of my fathers illness and i couldn't travel back to the US within its validity because of Corona Virus. Thats the reason my pending petitions was expedited. In fact I only requested to expedite my i-131 nothing else but I see all my pending petition’s status changed on the very day my i-131 got approved.

    I understand AP isn’t a guaranteed admission. At least I can appear at the port and will take both my current AP and 30 days expired AP that I received before leaving US.

     

    and ofcourse you have never seen anything like this before. Neither did I.

     

    I haven't seen airports locked down for weeks because of pendemic.

     

    Someone was earlier telling me that you might have to do spousal visa as my pending petitions were gonna get abandoned.

     

     

  2. Yesterday I have received an update on all three petitions.

     

    i-485: Ready to schedule an interview 

    i-131: Approved

    i-765: New Card being printed

     

    Even though my i-512 (30 days travel) was expired last month and I am still outside the U.S.

     

    I spoke with the USCIS tier 2. And had to fax some more information to National Benefits Centre. Including my expired I-512 and my ticket details that I Couldn’t travel back to the US within the validity of AP.

     

    Now both my travel document and EAD or it might be a “combo card” will be delivered to our address in the U.S. and we are currently in India. Me and my wife are planning to go to Canada first. And then get my travel papers delivered to us by our family member and drive back to States to seek parole at the entry port ?

    We have already used our K1 visa. We have married in December 2019 and filed adjustment of status in December 2019. My AP that I filed with I-485 is still pending only biometrics were taken. This 30 days travel was emergency travel document (I-512) issued by local office right away on the appointment because my father passed away. So I needed to travel. And there wasn’t lockdown at the time when I travelled it happened 6 days later

  4. Need advise please!

    I have a pending i-485, i-131 and i-765 after entering US on K-1. Fingerprints were taken in December 2019.

     

    while we were waiting for my application to process, my father became ill due to liver cancer. I went to local field office and I was issued an emergency travel document by USCIS office for 30 days expiring on April 11, 2020.

     
    Me and my wife flew to India on March 13, 2020 and had our return ticket booked for April 8, 2020. My father passed away the next day we came to India March 15, 2020. A week afterwards country went into lock down and airports are still closed because of COVID-19 and we tried our best registering STEP, Tinyurl and everything possible to be back in the stars but just couldn’t make it Even though it was very sensitive time on our family.

     

    Now what should be our direction ? Embassy’s are closed until May 3, 2020 and USCIS contact Centre in the states is telling me that they are NOT able to help because I am not in the US.

     

    What can we do to be able travel back to United States ?

  5. Hi, I am currently in India for a family emergency with an Emergency travel document issued by local USCIS office Valid till April 11, 2020. I had my return ticket booked for April 8, 2020 directly from New Delhi to SanFrancisco. Because of situation due to Coronavirus Airports are shut down in India and not sure when they will resume operation normally. My flight has also been cancelled. What can I do in this case? I just spoke to USCIS Contact center but they said they can’t do anything and suggested me to speak o CBP. 
     

    FYI my I-485 along with I-131 is still pending. Finger prints were taken about 3 months ago

    As long as you enter the US on 27 Nov, you will be fine. But that is really close. Just make sure there is no flight delay or something that's gonna make you late a day or two. But yes, as long as your AP is valid, you will be allowed in. 

    My K1 visa is expiring Nov 28th 2019. And I am driving from Canada. Will it be an issue at POE if I enter on 27th Nov? Tried reaching Montreal Consulate for the same question but they haven't yet replied.

    It's all about that. Thanks for all the information. i will see if I can do some volunteering work for my current employer. So that this 8 months or whatever time's gap don't create any alarms for my future employer. 

  8. Thanks for the input guys. The reason i was thinking about keeping my job was that my K1 was delayed by 4 months. I was even refused once and meanwhile I got a nice job opportunity that I decided to take as I was in Administrative processing for my k1 over two months. And now I am working for about  3 months, and  US consulate asked for my passport and approved the application today.

    I appreciate you guys sharing  your knowledge in this matter. Considering the amount of wait I had to do and how things changed for me during this time, I think i will compromise with my profession. Instead of going down another year in waiting. 

  9. Hi, I just got my K1 visa approved from Montreal Consulate. And k1 is a single entry visa. In my understanding, work Authorization is only provided for the time  K1visa is valid till. 

     

    I am an aerospace engineer in Canada and as soon as I enter United States I wont be able to work. 

     

     

    Any experts out there, who are able to throw some light on it ?

    Is there a way I can go to US register my wedding, file settlement of status and work authorization and come back to Canada continue my job ?

    Note: i am a permanent resident in Canada. Not a citizen

  10. I am a permanent resident of Canada  but originally from India. Came to Canada about 5 years ago as a student.

    I did masters in engineering here in Canada and I have been working for almost 3 years.

    I had my K-1 visa interview at US consulate Montreal.

    July 24, 2019. My visa was refused.

     

    My passport was returned to me and my case was under administrative processing.

    I had a B1/B2 visa on my passport, officer cancelled it as well. Stamp says (Cancelled without Prejudice).

     


    July 25, 2019. Embassy asked for my resume through an email. It was sent right away.
    August 30, 2019- Montreal Embassy asked me for my Passport
    Sept 3, 2019 -- Passport was sent to Consulate
    Oct 23, 2019 -- Case status update to "Application Received"
    Oct 25 2019- Case Status went back to "Administrative processing "

    Still waiting for my passport/outcome from the consulate.

    Any experts or  applicants of similar journey out there able to comment on this whether what is happening ?

    There were two of them in line standing with me. We spoke for about 40 minutes or so, they asked me few details and I asked them the same. What I mean by born Canadian citizens was someone who was born here. Did I say anything about skin or facial feature! Did I say someone with a yellow or peach skin was granted a visa? I was just trying to agree to the point that yes there’s surely more background check for people like me who become residents but aren’t born here. On top of that, whatever my mentality is about skin or facial feature is None of your Business. I am here to seek help and find out what experts think of this case. Please don’t take otherwise.

    Overall I'd say do not stress, just be prepared for extra patience. It's good that they gave you your passport back in the sense that, you aren't trapped in Canada while you wait. Good luck! 

    Make sense! I can relate very well to my case. As I saw few Canadian citizens (actually born citizens) just going in and out of the interview rooms with their visas granted under three or four minutes.Thanks again for your inputs and the knowledge that you guys shared is definitely helping settle down the stress. Let’s see how long it takes!

Typically they are checking for any backgrounds/skills/associations that might raise red flags. Your engineering background probably triggered the need for more info. For example I've seen people get scrutinized for backgrounds in areas like biochemical engineering, nuclear and stuff like that. You should be able to dig up some past threads about it. From what I've seen, it typically just means a long AP as they conduct further background checks, but I can't recall ever seeing anyone post about being denied after this.

    Thank you for your comment Meghan. That’s what I figured when I did some research after I came home. Officer did ask further questions on my work and responsibilities, more in detail about robotics
