  1. i did say in earlier post my case was sent back to USA for a NOID -notice of intent to deny reason- big age difference i appealed and won married over 12 years and he's a citizen overcoming any obsticle immigration can throw at u is a matter of knowing things that can help like the 601 waiver how to fight a NOIR or NOID all 3 of the above have to have REAL and VALID documentation to prove your case is just CO said my husband did not know what books i read (stupid) but i produced a dated text message showing i was researching and reading online to help my mom as was writing a book CO wants proofs not statements our government likes a paper trail of evidence for any visa Best to u both allah yessir
  2. not paying the fine can be detainment the way Korean site states it/ doesn't say a crime and they notify (or can notify ) the person's country of residence thru the embassy
  3. OP u want a yes or no answer which does not exist in this case overstay in a foreign country- not a big deal jail time -is mental illness of intending immigrant- is and u will need to explain the illness and show the treatment and show he is not harmfull to himself or others travel to Columbia- means extended AP after an interview BUT in short this offense is not one that automatically disqualifies him for a visa Not every criminal offense will negatively affect your green card application. Under U.S. immigration law, three types of criminal convictions make you “inadmissible.” This means if you have a conviction for any of these three types of crimes, you can’t get a green card: Aggravated felonies Illegal drug involvement Crimes involving moral turpitude In your case all factors will be viewed by the CO at interview and that person makes the decision CO looks at totality of circumstances together 8 years -is in your favor crime is not a felony- in your favor income mental illness- get it diagnosed and treatment to help your case education job history US residency all these are considered and CO could approve after the necessary background checks we actually have no way to give a yes or no but read the 601 waiver and understand what happens if case is returned to the US
  4. Is Super speeding a felony in Georgia? A: The Super Speeder is a financial penalty, not a felony or criminal offense.Apr 6, 2016
  5. What happens if I overstay my visa in South Korea? Travelers who overstay a South Korean visa may be fined for each day spent in the country beyond the expiration date. The amount of the daily fine can vary considerably and will accumulate every day until the fine has been paid and the visa validation resolved. In most cases, this can be done upon exiting South Korea. Under no circumstances will travelers be able to leave South Korea without paying the fine and refusing to pay any fines could lead to further sanctions such as detainment.
  6. when we respond , we will cover the entire situation so, please do not get offended Nitpicking? sorry just trying to help and nitpicking is what the CO will do at interview read the info given look up any references like for the 601 waiver knowing all this will help u /no one here knows your entire situation but traveling to several countries does not really help a CR1 / the embassy will have to review your packet when it comes to the embassy / the CO decides and when a person puts travel history on the ds 260 , it triggers extra security checks for all countries visited making for a long AP (administrative processing ) after an interview even hiring an attorney is not helpful / they don't represent the person at an interview
  7. yes, people have overcome jail time or other issues from the Korean site: Remember that when traveling abroad, any incidents or concerns regarding your travel visa, documents, or passport can be reported to the embassy representing your nationality. so, read up on what happens if the CO gives u a 221g which can be for additional documents or can be for a denial and case returned to US for a NOIR or NOID very helpful to know about a 601 waiver , and what happens for NOIR/NOID and many of us go thru this extended process / i got a NOID and appealed it and won its is possible to overcome a denial / just understand the process completely also if he has a mental illness, document it and show the treatment he is receiving
  8. people try to help and some of us, like me, will be brutally honest not to be cruel but to tell u the ups and downs of this process u need to be fully aware of how the case will look to the CO so, i will wish u good luck but please take heed to what our experienced VJ members say to get thru the process and receive a visa for your husband and yes, all his travel and all his stays in other countries are relevant and travel to a country that produces 70% of the world's cocaine and is known for its illegal drug trade is going to affect his application too he will have to fill out the ds 260 and all travel is on the form now, for Korea, get the report in full form the country submit the copy with your petition if Co is concerned , they will tell u if u can submit a waiver the CO probably does not care about the overstay but will be concerned with the jail sentence which can be overcome with a waiver (if CO mentions u can apply for one) U don't have to live in Moroc forever but your spouse visa process will take a few years (normal is 2 and with waiver u r looking at 3 or more) file your US taxes keep a US residency with a state DL license, US bank account , owning property or mail going to relative where u would live if here have income needed to support the visa according 125% of poverty guidelines and a joint sponsor if needed hope all the above helps / really we do try to help incha yekbel
  9. We tried to open one in Moroc when i was there but bank would not allow unless i had been permanent resident for a year and a half so, i got his POA, filled out the tax forms for year married with the W7 to get his ITIN used that # and POA plus copy of his National photo ID and our marriage certificate to add him here to bank / he could not have a debit card till he came to the USA but ITIN are used by foreigner individuals working in the US (legally) to do banking You can still get a bank account with an ITIN, or an individual taxpayer identification number. ... ITIN: What it is and how to get one Fill out the required W-7 form, available in English and Spanish. Submit proof of identity, such as a passport or driver's license, along with a completed federal tax return.
  10. email the embasssy and they will schedule the interview usually the case when one is cancelled and our tourist visa works that way-pay the bank and get a receipt
  11. i should add u are looking for less paperwork for a government that depends on paper trails Paper-trail definition A series of documents providing evidence of one's actions. (idiomatic) A written record, history, or collection of evidence
  12. no, u do not repay the fee / if she paid the fee twice -to who? many pay directly to embassy at interview and sounds like someone ripped her off because of covid the fee was even extended / not sure when that will end or did end as K1 's are still backed up from covid i may not know the month but i do know u don't have to pay this fee a 2nd time unless its a new petition
  13. just saw the main topic how did your dv go to NVC?
  14. sorry, my error i have been off a month since this year started happens when u retire and don't need to keep track of times and dates i no longer have to get up, dress out or go to bed at a certain time and honestly , i mess up why didn't she attend the 10th interview and just go into AP ?
  15. read what immigration attorneys say about the social media info needed on ds 160 or ds 260 https://www.kolkocasey.com/immigration-and-firm-news/social-media-ds-160-and-ds-260 u don't have to disclose ur password but many visa shoppers use multi media to search for possible prey to sponsor them (like being on multiple dating sites, or having an abundance of foreign friends for marriage possibilities) u don't need to be a specialist to read twitter posts /they are not encrypted or to see a list of friends on Facebook unless u block the feature (and that would raise concerns so don't try it) Whatsapp and Facebook messages are encrypted Basically it also serves like passing a law that says "no hand held cell phone while driving" no police officer is out riding around checking for this but if u have an accident, this law can be used to deny an insurance claim if u r texting or talking on one and if u are granted a visa in the US , and then they find out u have misused the visa , they can go into the social media and use it to prove marriage fraud , or someone on a B2 is working in the US If u ever watch border security posts on youtube, the officers (especially in UK and Canada) check cell phones to make sure the person is coming into the country legally and CO's at embassy have asked a person to open a cell and show them messages and contacts And be happy its not the DS 5535 as there u have to give cell #'s of all family members too However, this addition to Forms DS-160 and DS-260 is a good reminder that applicants seeking immigrant and nonimmigrant visas can safely assume that the U.S Department of State is carefully reviewing their social media presences to verify that the information disclosed on those applications and during consular interviews is truthful.
  16. Did u cancel the interview for the 10th? if not, attend it and no one has to pay the fee twice unless they cancel a visa and have to reapply embassies do get fussy when an interview is rescheduled 2 times
  17. sorry your site says IR2 dv lottery cases still go thru the process to validate each and every document some need more work and security checks than others and some have a spouse and /or kids to include in the checks
  18. when u say outside processing times , are u referring to getting the embassy case #? If so, the USC can call and ask for case # if u have the case # Are both fees paid to NVC and the supporting documents sent in for the AOS and ds 260?
  19. u can not compare dq times as the numbers reflect visa differences like a sibling visa could pass thru USCIS and be on hold in NVC for a visa # therefore the fees and supporting documents are not yet asked for (so no DQ) if u know these are same as yours (a IR2) then do u know that the fees are paid to NVC? Do u know these cases have sent all doucments in to NVC for them to be approved? do u know these cases have met the income requirements? do u know the officer doing the documents and how fast or slow they are to complete each task? Do u know if any of the slower cases received an RFE ? Do u know if any of the other IR2's are on hold by the petitioner waiting for the IR 1 to catch up?
  20. there is not clear whether they seem satisfied with our marriage evidences. We were told to go home and wait for mail if they will request RFE or approve it. going by what u said as your statement above reads If u marked either the box on I 765 or I 485 for USCIS to request the card from SS, it will be produced -not fast- but in their own sweet time
  21. not sure why u would want to study in the US just the application fee and fee to hold your place for confirming your status are expensive and now without the husband and place to live while going to college in his city, there would be room and board fees not sure why the F1 visa when you had already married, i am sure CO suspected "visa shopping " to come to the US faster than the spouse visa. IE: reason for denial to be approved for any student visa, 1. college with SEVP credation and pay the SEVP fee to get the needed I 20 from college 2. funds to show u can afford the tuition 3. proof that u intend to return home at end of studies If u had submitted these with the application instead of taking them to interview, they may have considered the F 1 visa reminder this is not an immigrant visa and yes, the LDR is hard on all of us but when relationship is strong , it works i would give up on anyone who is up and down on feelings and threatens wilthdrawal of visa / no one is worth that kind of uncertainity
  22. If u marked the SS box USCIS will do the work for the SS # if and only if, they accept your marriage as bona fida and issue your green card, Ead and AP as u say they were skepical of a real marriage
