Was going to ask if you ever filed i864w when you sent i485 petition..but obviously from your post above, you didn't..right? Wondering if the rest of us that had a previous i485 with i864 included need this here i864w due to VAWA?💁 for those wondering what this is 👇👇👇

I-864W, Request for Exemption for Intending Immigrant's Affidavit of Support

Use this form to establish that applicant is exempt from the Form I-864 requirements.

Yes, with the God's will- getting there.

So here is the timeline for Chicago office:

April 25, 2017- Filed VAWA application. Had 3 Prima facies extensions.

August 6, 2018- RFE for GMC & abuse evidence.

October, 2018- Received my RFE response

    January 7, 2019- VAWA approved

    January 11, 2019- Received EAD (C31).

February 1, 2019- Filed I485, I131. Included my medicals along with the application

March 11, 2019- case was transferred to another office.

    September 25, 2019- Interview notice

The online status didn't change since March 11th.

So average i would say 8 months from the transfer date.

Will keep you posted how the interview goes.

Today I had my AOS interview and would like to share my experience with everyone here. I was nervous and calm in the same time cause I knew God will be with me and guide me through. My attorney could not accompany me as she had something else scheduled. A very polite lady called my name 15 min after the appointment time, leaded me to her office and sweared me in. Took a picture and my indexes fingerprints.

    Asked me about:

    *my Id/passport

    *general questions out of I485

    * why did I overstayed

    * about my past/current work

    * DOB(s), important dates of when I got married, divorced and so on.

    * didn’t mention anything about my VAWA or marriage whatsoever.

asked about my form 864W, which I didn’t have and didn’t know that I should and she said I will get a RFE about it. Therefore a decision about my case has not yet been made.

The whole interview took 25 min exactly but for me it felt like an entire hour.

Right now I am still trying to come to myself down, and I think all went well, otherwise they wouldn’t ask for the form. 😋☺️ Happy I am over with it, even though still have to wait.

Anyone knows, can I submit this form in person to drop it off to the office, or should I wait for the RFE and have my attorney submit it?

Thanks everyone for all the help and guidance. 🤗

    Thank you hon

You can inform yourself online, or go to the County Circuit Court and they usually have people volunteering to help you fill up the forms and explain the process. They will recommend the right petition for you. If there are no kids involved and no other assets to share than it’s easy. Each state/county have different laws and processes but usually the first step is to file the petition for dissolution of marriage. And from there on they’ll tell you what you need. Good luck with all.

Following the inputs so far, and from other sources, I think the interview letter is more generalised...than customized..I still have my interview letter from just last year inviting my spouse and I to our marriage based interview..study your letter and go with all the documents it says to bring!👍

Yeah, they do mention all the originals documents along with any us certified translations (if any) but also they require pictures, residence proof and so on.

i recall there was someone here asking if they need to provide divorce decrees from the previous marriages- they specifically say: ALL. So, better to obtain them ahead so that when time comes not to stress about it.

    Thank you all!

You should have the request of documents in your Interview Notice! Do you have a copy?

my personal/humble advise: bring your I360 packet with your passport, Birth Certificate, Divorce Decree if you have it, DL or ID and whatever else is in the letter.

I have the letter, and of course i will bring everything i have, but was wondering how everyone's letters look.

    Hi all!

Do you think it makes sense to file an Travel Permit right now after VAWA approval?

If filed, will I get a different receipt number than my VAWA case?

I used to have one on my combo card but is now expired.. I also don’t have a copy of my original I-485 to attach to this application. I do have an interview notice from it, is it enough to file along a copy of my VAWA approval?

thanks in advance for your reply!

It absolutely makes sense to file for an Advance Parole document if you are not requesting renewal of another combo card based on your already filed I-485 application. The Advance Parole will have a different case number. So if you plan to travel in the next year i'd say get it. From the VAWA approval to the interview is another 8-12 months.

Who must submit the G28 is JUST THE ATTORNEY representing you, if you don't have an attorney representing you then you don't have to file form G28. G28 is a Notice of Entry of Appearance as Attorney or Accredited Representative.

I do have an attorney though, but i filed on my own to save some money. What are the chances for the to application to be rejected? I still indicated my attorney's address for all correspondence. The reason i am asking now is because the checks was cashed... so if it gets rejected, it means no refund.

I've never done it myself before..but since you're being represented and it's on file at the USCIS end..you should require that! Also my VAWA approval letter states that all further correspondence should include a form G28! Read yours, also the deffered action status..I recall reading it in one of them..a couple of days ago..👍

Ok....I didn’t include the G28, so i’ll Wait either for a denial letter or a RFE. They received my I765 on august 20 and on september 4th they updated the online notice that they reviewed the fingerprints and will assign it to an officer to work on it. So we can determine at what stage in the application they realize they need an attorney appearance.

The notification of this post just woke me up and I'm just laughing😄😄 after reading this! @ annoyed look! 👀😏 LOL! My attorney sounds irritated as we mostly do this over the phone ☎ or e-mails! Still she sends it out to NBC! But if I ever need to renew EAD again..I will just do it myself..the sending of course, after requesting the G28 from her! The obvious explanation is that they don't know the first thing about VAWA! 👎😏

If we file for renewal ourselves we need to request G28 from the attorney on the case? What if I didn’t send, Will it get denied? Thanks.

Then take it to HR . That is just like a traffic police not accepting a DPS Temporary paper license while you wait for the plastic to be mailed to you .

Yes, you're right. They keep sending me reminders that i won't be eligible for work like for a year ahead- like give me a break :) , but i am waiting for the last month to send them the notice (or the card if it arrives in time).

If your job fails to accept the 180 days extension while they wait for the actual Employment documents to be mailed to you then by law you need to report the company to the appropriate labor authorities. If my job (a federal agency can accept the 180 extension I don’t see why most jobs can’t accept that .

It shouldn't be a problem with my boss, but the lady in payroll department is a pain in the ARS :D

Ok great! You're almost there..there's nothing wrong with having two EADs..LOL I had two as well..now.awaiting the renewal of the other!😊 my only thought is that you may have your Greencard sooner and may not be needing them both again!💁

Mostly i am annoyed that my attorney didn't do her job right. That is all. I can leave with 1 EAD, no problem.

  16. 4 minutes ago, Stillwinning!!!😊 said:

Yes you should have that as well..not too late now! Also you should be getting an interview notice any time now..did you get transfer notice for i485..when? Did you receive courtesy letter....when?

Transfer Notice received in March, 2019 (at least online says it was transferred. Don't know if the notice was received as they go to my attorney) no courtesy letter as my medicals are good till February, 2020.

EAD is for the same purpose to work and if you already have one C31 and in August you sent renewal no need to waste time on filling EAD C09... My honest opinion.

I know but C31 expires in December and was hoping that the C09 may come before that. I do have the 180 days extension letter, but you never know with the employers. And even though i can explain that they should consider the extension i just didn't want to get into details with them. Thanks though.

Sure can usually attorney sent all package together I485/ I765 / I131 weird your lawyer did not, anyways yes you can filed I-765 include a copy of your I-485 receipt along with the I-765 and I-131. If you paid the fee for I-485 don't need to paid for I-765 / 1-131 but if you waived the fee you need to also request a fee waiver for the I-765 which is form I-912.

The simple answer is YES you can!😊👍

Thanks girls! I guess she never applied for one. Maaannn!!!! she really deserves her attorney fee 😶

I might send the request myself, 2 EADs are better than 1 and who knows when that interview will be scheduled ;)
