I think its a losing game for her. She maynot get any property from you, but if the marriage has been for a year or two, the judge can order some support based on your income but that support could be few months to an year, and if you are already supporting her after separation thats counted as credited towards your total support obligation.

Alexmat1 got a reaction from OldUser in Can you delay the Oath ceremony
I had filed for I-751 (petition to remove conditions on my green card) and US Citizenship at the same time. I got my green card and also my citizenship interview on same day. Passed through both. My GC is now approved and thus I qualify to take the Oath. But I have a few things to take care of in my home country before I renounce their citizenship (they dont allow dual citizenship). And the nature of the work will take many months to accomplish. Also requires me travel there in person, sign a few papers etc for me to get this done.  I will not be sent a Green card (since USCIS perceives I am going in for Oath ceremony and becoming a citizen). I talked to USCIS and they said they can give me a stamp (I-551) on my passport. I have also been sent a letter with a Oath ceremony date.
    My queries are:
    - Can I postpone the Oath ceremony to several months later ? During this time can I get the Green card issued (the physical card instead of the stamp on passport).
    - If I cant postponse Oath, and then decide not to take the Oath (as doing that would void my rights to get the property in my home country transferred or sold. Once I am not a citizen I have no rights), can I file for US citizenship again after I get things done at my home country. I dont have to remain there for long time, so I expect to keep my Green card safe by only being out of US for max of 2-3 months.
    - If I dont take the oath ceremony and thus abandon  the opportunity to US Citizenship for now, will that mean I can now get the plastic Green Card (10 year). Would  me not taking the Oath jeapardize me future citizenship application ?

Yes I had filed it while going through my divorce. Because it was delayed, my I-751 was denied once. So I refiled the second time after few years. And it was lagging so I applied for citizenship as I had completed 5 years.

    Alexmat1 got a reaction from PR&PR in I-751 September 2020 Filers
I submitted my application on 11th, it was received 14th, but I still havent received  a receipt number or I-797. I called up USCIS and gave the A number and they said no I-751 is in their system. They said it should take 15 days max from the day they receive to generate a receipt number. I submitted a fee waiver, but they said that shouldnt delay things. I am worried if its lost at Lock box. My USPS tracking shows it was delivered to lock box on 14th.
Anyone in similar situation ? Any advises  ?

Even if you get it, and if you have a friend who can check your mail, you can call and reschedule if you are out of the country. Chances are the date of biometrics might be months out and you would have time to get back and not have to postpone.
I think you will also get to know if biometrics is issued if you sign up for USCIS online account.

From what I have read Extension letter plus expired card is valid to travel. That said most big airlines know this policy. Lets say you are taking a smaller local airline for one of the legs for onward journey to US, they might not understand the extension letter. You might have to convince them then. Carry USCIS memo or any such information pertaining to travelling on extension letter with you to prove that its legal to do so. Airlines are always worrying about ferrying a passenger with invalid visa to US and getting fined for that.

Thanks @Stiven26 for the response. I was thinking I was the only one wasting so much of time on this. I wish USCIS made all this online so a lot of man hours could be saved.. All this for just a one time read by USCIS officer ! and then its shredded or stuck in some storage and later shredded..

What is the trick to join them 😉 It can help many others here. If I can think of its if you use the two metal pieces as strings and then use the flat metal bar (that you usually use only on top) on either ends and bend the bend pieces that you used as strings into the metal bar. slide over the sliders. Is that what you did ?

Thanks for the idea. Thats great creativity.
You must make a youtube video, many would benefit and so would you (with the $$ from youtube) 🙂

Oops  I highlighted most of my 300 page plus package, highlighting the important things. I thought its easier for the officer if I highlight my name , address etc in a bank statement which is crowded with many other information. Would have cause an issue ?

Alexmat1 got a reaction from SalishSea in I-751 - USPS vs Fedex & Hardship Waiver
    Hello,
    1) Mailing:
I would be sending this early next week. I was planning on using Fedex to send this in. For the same price , Fedex arrives two days earlier than USPS. However Fedex always requires  a signature when delivering to a business. They said I can give instructions while mailing the package that signature is not required.
Has anyone faced issue with Fedex mailing in of I-751 ? I assume no one will be available to sign the delivery of I-751 at USCIS esp if they are running most things remote because of pandemic. If someone has any inputs pls share.

    2) Hardship:
While I am using the waiver based on Good faith marriage option (I am divorced), I was also advised to use the waiver due to extreme Hardship option too, as a backup. Is this advised.
As one of the reasons of hardship (apart from me not being able to co parent my child), I read somewhere that one can mention any significant credit card/financial institution debt, which cannot be paid back if I am out of US. Is this a recommended reason to give, or will it backfire, if I show debt (and thus a poor financial status).

    Thanks

Alexmat1 got a reaction from mushroomspore in I-551 Stamp with a very old denial letter
I went through a divorce. Applied for I-751 before the two year period, and USCIS send an RFE asking for divorce decree. Case was dragging in family court, so couldnt send that and I-751 was denied and denial letter sent in 2016. The divorce case went through trial and was finally over in 2018. The letter contained the standard language that I can expect an NTA.
I wanted to reapply for I-751 after that, but waited for several reasons. Now I have an immediate need to travel outside the country for 3 weeks (if I can travel and reenter US safely) . I dont have time to gather all evidences and reapply for I-751. Also I feel if I restart I-751 I will have to wait for biometrics which will again delay my travel. I plan to reapply the I-751 once I am back in the country. Even if I apply I-751, the I 797 extension letter doesnt make any meaning as it is extending the status of a already expired GC, which would mean its still expired. Thus I assume I-551 stamp need not be based on the second I-751 but can be based on the earlier denial letter ?

    My questions are as follows:
    1) Can I go to USCIS and get I-551 based on earlier I-751 that was denied in 2016. Since technically I was told to wait for an NTA, and while waiting for it, can I ask for a proof of GC on my passport ?
    2) Infopass at USCIS - I learnt there are no more online Infopass appointments. In which case can I do a walk in (assuming #1 above is possible)
    3) My passport is expired so I have applied to renew it (it takes about 10 days in expedited mode), so can I get the I-551 stamped on I94 ? Can I then travel with this I94 and the NEW passport and Re enter US successfully
    4) Lastly I receive Medicaid and Food coupon benefits - with the recent Public charge evaluation at re entry done by CBP , would this affect me ?
    5) Would I be treated as without status and thus receive a 10 year ban on re entry (even if I get the I-551 on I94) ?

Advise me pls. I read through many topics on this forum but nothing to the point.
