    Do it now! No reason to wait. It may take USCIS a few days or even longer to send the request for evidence.

    I saw someone with 5 weeks. and a few cases of close to 1 month. Quite some around 3 weeks after sending documents. 

    That said, if you haven't yet, use all channels--phone call to USCIS, congressman, senator.

    My senator needs it for my USCIS expedite request. I need to essentially prove that the processing times have practically doubled since Feb / March. HELP!

    I don't know if this will work, there is a website called Wayback Machine that archives old web publications, then you enter the website you want to search back from there, and click on the past dates. Usually there's a capture, but I"m not sure how it works with the USCIS. I tried an earlier date and it says 5-7 months, slightly shorter than the current 6.5 to 8.5 months. (I'm testing using 765)

    TBH, I still believe that the "involvement" of my congresswomen in my Expedite request resulted in a negligible, if ANY enhancement to my self-initiated Expedite request.  Please don't take this the wrong way, but I believe that you probably have been failed to be notified that they didn't approve your Expedite request (for whatever reason), and you are back in the routine processing segment.  Having said that, other than the Attorney route, can you not initiate a NEW expedite request, and reconstruct a ROCK-SOLID supporting-evidence package, perhaps garnering the attention of a different Expedite officer?

     

    Another reason why I haven't come back to the board and just gloated about the stage I'm at now, because so many of US continue to suffer extreme frustration and despair over this process.....

    Hi! Thanks for your input. Could you elaborate a bit about how getting an attorney can offer additional help in this expedite process? I ask because from what I read online, several ppl reported their attorney discouraging them from submitting expedite, while they eventually succeeded doing that on their own. So a bit info into whether attorneys have different channels/approaches would be really helpful to know! Thanks!

    Hi! May I ask, when faxing USCIS the supporting documents, do I put their email on the first page with attn number? Or do I make a separate fax cover page and follow with the email?Thank you!

  7. I have a question...I'm in the requesting EAD expediting process so very sensitive to any kind of updates from USCIS. 

    I received several "we are still reviewing your case and there are no updates at this time" emails and I usually don't pay much attention to them.

    However, today I received this email again, but the "we last took action on your case" part shows May 3rd, which is a reverse back from May 23rd that they showed in an email two days ago. 

    What does this mean? Are these emails totally random or contain some sort of accuracy?

    The only explanation I can think of is, my 485 and 765's last update date is May 23rd, and my I-131 is shown still on May 3rd when its first received.  Does it mean they send emails for the four cases separately, and someone just touched my 131?

Cue me feeling very positive! 

     

    So this morning, seeing that there was no update on the website, I managed to speak to a Tier 2 representative, who told me that actually they have 60 days to review my evidence, and that she doesn't see any record of my evidence or the congressman's office submitting a request. Again I say, oh boy. I see from this thread that everyone has a different experience with this process...any advice/similar experience to me/positivity that you could share would be great! I have a job starting July 6th. 

    p.s. I've already been waiting over 6 months...

    I saw from other's posts that if you expedite through congressman (versus phone call USCIS for expedite), there will be no record online. They go through another channel. 

  9. Hi, for those of you who successfully expedited EAD (or are close to getting through), did you 485 status change to "ready to schedule interview" before you got to the stage of "EAD card in production“?

    Mine hasn't changed for either 485 or 765, below is my timeline

    May 23  Fingerprint review completed on 485 and 765

    May 31  EAD expedite request with evidence submitted by congressman

    June 4   Congressman forwarded USCIS reply "we have requested the file...will receive decision or NOA in 30 days"

    so far, still stuck on "finger print review completed", did not receive RFE for 485 either.

     

    Thanks ahead for any insights/suggestions.

    Hi! When you get help from Senator and Ombudsman, what do you say to them? Do you tell them you already had congressman involved? 

    My congressman submitted a exepdite request for me and received reply that my file's been requested and they will make a decision in 30 days. 

    I plan to reach out to senator if I don't hear back from congressman's end in two or three weeks. I am a bit worried that by getting senator involved, USCIS will give me another "30 day" wait period to start the clock again...Or, do congressman and senator work through different channels?

    Your experience and advice is much appreciated!

    OK, I saw what you mean. I originally was planning the phone call route, thinking I have two months to sort this out. Then one day unexpectedly, I got boss pressuring me to get it immediately coz he can't stand the potential uncertainty. Plus ongoing medical treatments and bills. I got really scared and called local congressman, and his office was more than encouraging, they suggest I act immediately, and took my request and submitted right after. 

  12. Hi guys, I requested expedite through congressman recently based on financial loss. Could anyone who also chose this route share some experience about the timeline? 

    Below is what I have so far:

    Day 1: Congressman submitted request

    Day 5 (the 3rd business day): Congressman forwarded USCIS reply: 

    "We have requested the file and it will be reviewed by an officer once we receive the file.  Your constituent should receive a decision or notice of other action within 30 days of the date of this notice."

    Then what? Have you received similar message? How many days after that did you get any progress?

    Try get a job. Some times these come faster than the EAD! Then you can expedite again.

    Hi, congrats on getting your card!

    I saw that you said you sent 3 expedite request. Could you share your experience a bit? How long did you wait between these requests, and any guess about why the first two didn't work? Thank you!

  15. Hi, I have some questions regarding expedite through phone to USCIS versus through congressman. 

    1,

    It seems that it takes about at least five days from starting the phone call to faxing out the docs. 

    If through congressman, not counting the time spent getting in touch with congressman, do they send out the request and doc at the same time, or do they also have to wait like five days for further instructions?

     

    2, 

    The general consensus here seems to be first use phone expedite and then reach out to congressman to follow up or re-expedite. What is the rationale for following this sequence? Any downside to reaching out to congressman directly?

    I'm not working right now, just a student, but will graduate before starting the job (in four months), so I'm not that concerned about keeping my F1 student status. 

     

    Yes, it doesn't make sense that F1 can't claim financial loss as they are supposed to sponsor themselves. But several posts shows that response from USCIS. It also doesn't make sense that we need to prove that the job offer is pending on valid work authorization--isn't all legal employment of that nature?

    I don't know what you mean here. F1 is supposed to sponsor themselves? Are you adjusting based on marriage or otherwise? 

    I am F1 student, AOS based on marriage to USC. 

    What I mean is, I've seen posts in which, F1 to AOS request expedite, and they got the uscis reply that:

    "It must be noted that F-1 students are required to establish that they have the financial ability to pay for their course of study and living expenses for the entire period of study as indicated on their I-20, thus they cannot claim financial hardship due to the very nature of their nonimmigrant status and maintenance thereof. In addition, an employment offer or start date does not qualify under USCIS's severe financial loss expedite criteria."

    Like, they would say, "we won't be employing @tiantian2 if you don't do this"? Or that you're extra valuable?

     

    If so, it helps I guess, but I don't think it's necessary. A job offer is enough, and the onus is on you, the applicant, to explain why it's important to *you* to have the job, unless you're spinning the "the company will go bankrupt if I don't work for them," which has also worked for a select few people. 

    Yeah, by support letter I mean something in the line of "this person is extremely valuable to us and if she can't start working by that date it will cause blah blah blah..."

    I'm F1 (student, no opt) to AoS, and saw some posts say F1 is supposed to sponsor themselves, so financial loss to self isn't a valid reason.
