DSWD is the Philippines .. USA won't ask for anything from DSWD.

As long as your daughter is traveling with her mom no one at the airport in the Philippines will ask for anything from DSWD either, they will look for the visas and CFO sticker.

For the USA you will need the visas, DO NOT OPEN envelopes .. and a smile :)

Thank you so much @Hank_ 😊😊

The US doesn't care about DSWD or BI travel clearance. As long as you have legal custody according to Philippines law (and of course all visas are in order), there should be no issues entering the US.

    @AKteacher thank you so much..😊😊😊

  3. Hi everyone! I have a question regarding dswd travel clearance. I know that my daughter is exempted from getting the travel clearance from dswd but I just want to make sure or just out of fear, can we really travel even without it or the immigration won't ask for it when we enter the US soil? Thanks

You can get the sticker at any of the 4 CFO locations.

As for your daughter, she is over 12 years so must attend PDOS once she has her passport with visa.  She would complete PEER consoling

Thank you so much @Hank_. Highly appreciate your kindness.. 😊😊

If you have your certificate already, you are good to go, once you get your visa in your passport you need only to get the sticker from CFO

Thank you. Where do I need to get it? And also, I have a daughter traveling with me, 14 years old. My apologies for asking too much. Highly appreciate your response. 😊😊

  7. Hi everyone! I have a question regarding CFO and PDOS.

I've had my cfo certificate already since 2015 but unfortunately my visa was refused in that same yr.  Do I need to get an updated cfo and attend the pdos?

Your response is highly appreciated.. 😊😊

It's a side effect of the dual nature of K-1s (they're non-immigrant visas with immigrant intent), which means different groups at the embassy/consulate work on them at different times.

The new case created date is when your case was created in the non-immigrant visa unit; until immigrant AP was finished, your case was being worked on by the immigrant visa unit. Usually (but not always), K-1s are only in non-immigrant AP for a very short time while they finalize paperwork and print your actual visa.

Thanks. I tried to check my status today but I could not get in to the system. I thought the system was down. Thanks @Dia pe, after I read your message and tried to go and check my status through non-immigrant instead of immigrant visa section and finally it says "ISSUED". Im just so happy right now. Thanks everyone for helping and giving us the right info. 😊😊😊

If you were given a 221g at the end of your interview and then sent this information in with your passport then Dave and Anastasia are absolutely correct. The immigrant unit is done processing the case and has referred the case to the non-immigration unit for issuing👍

Yes, the consular gave me a 221g after the interview then after 2 weeks gave me another one and asking for my passport. 😊😊

Thank you @boris64 ..highly appreciate the response. 😊😊

If it went from Immigrant Administrative Processing to non-immigrant Application Received, that's good; it means the immigrant unit is done with your case. Next will probably be non-immigrant Administrative Processing, and then Issued.

I checked it again and it says Non-Immigrant Administrative Processing. Fingers crossed, really. Thank you @DaveAndAnastasia 😊😊😊

You'll either get the K-1 or you're in the "too married for K-1, not married enough for CR-1/IR-1" situation.

If it's the latter then now that he divorced the 1st wife you need to re-marry because the first time you got married he already was married therefore that marriage is void. (In the US' eyes, that is.) Then apply for a spousal visa.

Thank you all for your response. That's what I thought so too that we are too married for a k1 visa but because of circumstances and based on what our lawyer said that k1 visa was just right for us since our marriage is void. I do hope that the consular or who ever is examining our papers that we submitted hopefully they will gives us a notification or issue us a visa if not, we are just going to re marry and file for a spouse visa instead.

Thanks again. Highly appreciate it 😊😊

Hi everyone! Hope you can help me with my case.

It's our 2nd applying for k1 visa with k2 and unfortunately i was given the 221g stating that my visa is refused for administrative process last Thursday. The first application was 2015, right after the interview i was given the 221g and noted there "did not reconsiderate the prior marriage". We did not get any email or notifications after a year (2016) the USCIS sent a letter to my fiance that our application has expired already.

We gathered all the documents we thought they needed based on the results on our first application before we re applied for another k1 visa and we also hired a lawyer to process everything but still put under admistrative process. 😢😢😢

    Here's our situation:

We are actually married (2007) through Muslim court.  We're both converted as Muslim prior to the marriage. I was the 2nd wife and under US Law, my marriage with him is null and void that's why we applied for k1 visa. He divorces his 1st wife here in the philippines and we already have a copy of annotated marriage and finality of their divorced. He's been in a failed marriages 5th times in the US (hope you don't discriminate due to his failed marriages 😓😓😓) and submitted all his divorce copy to the USCIS and the embassy here. On the day of the interview just last Thursday, I was asked about our relationship and told him everything including our marriage and told him that our marriage is null and void under US Law but we are married here in the philippines. And then when he checked all his previous marriages, I saw his facial reactions and I knew that it's not going to be okay. Unfortunately, he gave me the white paper(221g) and checked the box stating that your visa is refused for administrative process and gave me back our passport. We've been together for 11 years now. We have 2 kids already and i have 1 daughter out of wedlock.

    Please enlighten me.  Thank you
