  1. Yes it is very likely you will be refused. It may slip through but that will be an error and leaves you open to action in the future if the dates are re-examined You should be refused as the divorce may not yet finalised but it is no longer a bonafide marriage because the divorce is in process. Withdraw the N 400 Reapply under the 5 year rule once you are 90 days out from being an lpr for 5 years
  2. Skirting a line that I wouldn’t be getting close to… Is it worth the worry and possible rejection? I would be withdrawing the N400 and refiling under the 5 yr timeframe when that comes round. Safe and easier all round
  3. One of the challenges of the immigration process is managing life in the midst of feeling like life is on hold. It’s not easy to do but the day its all done and you are together, the length of separation will be in the past. Look for ways to deepen your relationship despite the separation.. it can be an amazing time despite the difficulties.

  5. You can meet and marry now and apply for the spouse visa. The time for the spouse visa to be processed will be 18 months or so and you then have 5 months or so to enter the US on that visa. That fits with the time you still have to stay in Singapore to finish your studies. You become a resident the minute you enter the US .. And do not have to go through any other processes before you are able to work That’s how it’s a better way .. if you enter on a fiancé visa you must then marry, apply for adjustment of status and a work permit .. both hefty fees.. And wait months at least for the work permit and over 12 months for your lpr status. or she can move to Singapore ..
  6. You can marry now and then file for a spouse visa It won’t be any quicker but it’s a much better path to permanent residency
  7. Yes You can marry using Utah virtual process before you visit or when you are there together. File the I 130 after you have all the documents in hand including evidence that you have met after the date of the ceremony Do you know why it was denied .. This is important as you need to be able to address this issue even when married
  8. I’m not familiar with the military application process but I’m assuming the interview will be the same as all of us non military. After the n400 application is approved, you should get an interview letter which outlines what you need to take with you for the interview. Follow those instructions .. The lower list is the interview requirements
  9. Are you applying for adjustment of status for her from her current visa or is she returning home and interviewing through the consulate there ?

  11. Please check .. Do they want a hard copy of the online form or a completed copy of the paper form. Two different things. Also, you still have to sign it .. be it on paper or online. No matter who actually mails it or presses the send button, you are legally responsible for its accuracy. Don’t skip that.
  12. The online form is probably designed as an interactive form in that your answer in one question will dictate what the next question is. The online DS 260 for immigrant visa applications is the same For example, if your marital status is single never married it’s not going to ask for your spouses details If you identified as a military personnel application, this would explain why you are only asked for one address The paper form has to cover all possibilities and applications have to complete all that is applicable to their situation and use N/A for those that don’t apply Like other vjers ,, all the person who instructed you on this process Don’t file both paper and online
  13. Agreed. It’s usually due to the quality of prints taken .. can be equipment failure or that some people fingerprint whorls just don’t print well.

  15. You cant. You are now in line for an N interview appt. You will get one when your application reaches the top of the pile Some consulates have a 12 month plus backlog of those waiting for interviews
  16. Occasionally there are persistent issues with getting good quality fingerprints. My experience was that poorer quality prints get rejected but this isn’t addressed immediately.. rather it seemed to get sent by to the back of the queue. Maybe get your Congressional rep involved if out happens again after this round
  17. Probably go to secondary inspection just to avoid slowing down the line for the property being you . Have all your immigration paperwork in order including documentation for your vehicle and for any personal effects and household goods you are bringing with you. POE will check these documents and confirm your address but not it’s not a second interview

  19. It does not need to be reported to USCIS. She must do whatever is necessary to replace the passport asap. I would recommend applying for a new one asap, usually the application requires a reason if it is not yet expired. For a lost passport, they will likely ask for a copy of the police report

  21. It is unlikely to have any impact. Correcting it when asked and volunteering the background information was the best thing you could have done. There is a difference between not really understanding and intentional misrepresentation .. You were the 1st not the 2nd. A review status is quite normal. Should be clear on a few days.   22. Lucky but that can change in a flash. Flirting with CBP problems? Yep .. getting closer every time he tries to enter . It would be v difficult to see how he could substantiate his US residency with that history .
  23. What was the interviewers response to your “no”. How did the interview end ? Were you given any paperwork at the end ? told anything?
