  1. @Captain Ewok Give it another 48 hrs. This site is managed by volunteers and sometimes life gets busy ! Thx
  2. It’s 50/50 chance that you will get the SSN. Shouldnt be but it is. Wait another week then get an appt and go to the SSA office and apply.
  3. It’s good to hear from you !! I’m so glad that your journey has led you through better times. Yes you apply under the 5 yr rule. Good luck.
  4. The visa is for entry only. Once the visa expires she can no longer enter the US but will need to apply for a new visitor visa in her home country On entry using her visitor visa , she is granted a maximum stay period by the CBP officer. She must leave the US before that date ( find it on the I94 entry record associated with her most recent entry ). Even 1 day overstay will cause issues with a new visa application If her visa expiry date is before the I94 “end of stay” Date, she can stay until the I94 date. The visa must be unexpired when she enters. It doesn't have to still be unexpired when she is leaving
  5. Not an uncommon situation. Many like you don’t have records with their A number on it .. Not an RFE trigger.
  6. All this out outlined on the website https://www.uscis.gov/policy-manual/volume-12-part-d-chapter-3 She should submit documents that show she maintained her residency despite the >6 months out of the country
  7. It can be quicker if there is a queue to use the GE kiosk.. even if they are using facial recognition only It doesn’t show up on the cbp officers screen so you have to show the QR code that you get when you use the app.. and the officer scans that.
  8. LPR can apply. https://ttp.cbp.dhs.gov/
  9. Looks good. GC holders don’t have I 94 records Hope this goes well for you ! It’s great when its all in the past and then get the new passport .. bye bye USCIS !!
  10. If you can get the new one in hand before your interview then yes.
  11. @narayan333 Adjusting from a K1 only requires an I130 if the marriage did not take place within the 90 following entry using the K1. Please give us your timeline of entry date and marriage
  12. A police certificate relates to the person’s time in that country .. I’m assuming you titled that document “police certificate first marriage “. That’s not really an accurate title. It is a police certificate Were both her names.. before marriage and married name .. listed on that application/certificate ? If both those names are listed on the official certificate, remove the incorrectly titled one, submit the certificate under the correct title (police certificate) and submit the original marriage certificate
  13. I think this is a good “probably what happened” scenario. Send what is listed as missing and resend the police certificate you sent already. You have to give them what they “want”
  14. I’m confused by the “ police certificate”. Can you post a picture of the RFE letter with personal details redacted ? That will help us ..
  15. I’m certain that you need to add the marriage certificate. Death certificate means nothing without first giving proof of the relationship Dept of State information gives alternate documentation accepted if the marriage certificate is not available https://travel.state.gov/content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country/India.html
  16. Under their post wording is a quote button. Tap that and out opens a post window with their post copied onto it and you then type your post under that then hit “submit reply” below your post
  17. Moved to Bringing Family member of USC to America as this reflects the situation for OP
  18. As stated. Use MPC. No entry is guaranteed but there are way bigger issues than questioning someone in your situation.
  19. File immediately. Then keep building documentation that demonstrates the relationship.
  20. We received the same letter as OP, even though my son’s previous years income as well as current income was above the minimum. So our experience was slightly different to the scenario you outline.
  21. Its a standard response to the many I 864 that are “borderline” for many reasons. To be totally safe, have the joint sponsor forms all completed uploaded and in hand for the interview. The interviewing officer has the final say. Having a joint sponsor already to go can avoid delays if the IO determines one is needed.
  22. Yes. They ask about previous denials cancellation or overstay
  23. You address the issues listed one by one .. fully and completely. Read and reread the instructions again as they tell you what to do. Read literally .. just what it says.
